Two John Doe investigations, beginning in 2010 and ending in 2015, were launched by Milwaukee County District Attorney John Chisholm (D) into the activities of staff and associates of Gov. Scott Walker (R).[3] During the John Doe investigations related to Scott Walker, Milwaukee County Assistant District Attorney Bruce Landgraf had Brekken jailed for failing to comply with a subpoena for credit card records. State law prohibits retailers from maintaining credit card numbers, and credit card companies also prohibit retailers from maintaining card numbers, with high fines for those who don't comply.[1] Brekken filed a lawsuit against Landgraf, which alleged that Landgraf had falsely imprisoned him and "used the civil and criminal processes for purposes other than which they were designed." Brekken asked the court for damages.[4] The lawsuit was dismissed because Brekken had failed to file notice with the Attorney General's office within 120 days of the incident, which, per WIS. STAT. 893.82 (3), he was required to do since Landgraf is a state employee. Brekken argued that Landgraf was on loan from the state to Milwaukee County and that he, therefore, had complied with statute. The judge ruled that Landgraf was a state employee, and Brekken hadn't complied with the statute. The 3rd District Court of Appeals upheld the ruling on April 1, 2014.[4]
