The Iowa Secretary of State is a constitutional officer of the state of Iowa and is elected every four years. The secretary of state serves as the state commissioner of elections, maintains corporations' records, registers trademarks, commissions notaries public and preserves original documents.[1]


Iowa has a Republican triplex. The Republican Party controls the offices of governor, secretary of state, and attorney general.

Current officeholder

The current officeholder is Republican Paul Pate.[2] Pate assumed office on January 1, 2015, following his win in the general election on November 4, 2014.

Authority

The Iowa Secretary of State's powers, term of office, etc. are derived from Article VI of the Iowa Constitution.

Article IV, Section 22:

A secretary of state, an auditor of state and a treasurer of state shall be elected by the qualified electors at the same time that the governor is elected and for a four-year term commencing on the first day of January next after their election, and they shall perform such duties as may be provided by law.

Here is a list of the standard qualifications necessary under Iowa State Law in order to be considered for the Office of Secretary of State:

  • Must be a citizen of the United States
  • Must be a legal resident of the state of Iowa

Elections

According to Article 4, Section 22 of the Iowa Constitution, the secretary of state, along with the treasurer and auditor, are elected to serve for a term of four years in length, which runs concurrently with the term of the governor. The election is held in November and the statewide official takes office the following January.

Vacancies

The Iowa Constitution describes the process for filling vacancies:

A secretary of state, an auditor of state and a treasurer of state shall be elected by the qualified electors at the same time that the governor is elected and for a four-year term commencing on the first day of January next after their election, and they shall perform such duties as may be provided by law.[3]

Duties

The Iowa Secretary of State files and preserves documents, coordinates elections, cooperates with the federal government on the census, and maintains the books and records of the State Land Office. The secretary also administers the Safe at Home program for victims of domestic violence.[4]

Divisions

As of January 24, 2019, the Iowa Office of the Secretary of State is divided into the following divisions:

  • Elections and Voter Registration deals with supervising the 99 county auditors, elections, and voter registration. The division of the office helps the county auditors in telling them which election practices work best. The division also helps in increasing voter registration.
  • The Business Services Division is a records center for businesses in Iowa.
  • The Administrative Services Division and the Communications and Publications Division are involved in scheduling and providing media information, preservation of documents, recordkeeping, and publishing the Iowa Official Register and the Iowa Official Directory of Federal, State and County Officers.[5]
