At his death by drinking poisoned wine, he was said to be laughing to Heaven, and uttered: "If he does not kill me, then he is not fit to be my son."
This implies that Qin Shi Huangdi had him killed. However, most sources I have read indicate that he was forced to commit suicide. One such reference can be found at http://www.royalty.nu/Asia/China/ShiHuangdi.html
