Resumo: O constitucionalismo popular é um movimento teó-rico-crítico contra o monopólio da última palavra pelo Poder Ju-diciário, para refletir o papel das pessoas na interpretação cons-titucional. No exercício representativo do Poder, as decisões po-líticas são ilegítimas quando se afastam da vontade popular, ele-mento inseparável do processo interpretativo da Constituição. Ao lidar com os direitos fundamentais, as decisões técnicas não dão sentido e alcance ao espírito constitucionalmente erigido para orientar o Direito. À pesquisa, colhidos os dados numéricos e bibliográficos, aplicou-se filtragem principiológica constitucional, a partir do círculo hermenêutico a fim de concluir-se fundamentando-se pela postura adequada e inclusiva a ser orientada enquanto função política num Estado Democrático de Direito que tutela interesses de liberdades e direitos humanos.

Através do método dialético de análise revisional da literatura especializada da matéria, concomitante a dados de pesquisas carcerárias recentes, objetiva-se indicar a partir da problematização de democratização efetiva do sistema criminal, concluindo-se no sentido de que uma política de redução de danos responde mais adequadamente a necessidade democrática criminal brasileira.
Currently, the tension between constitutionalism and democracy has been directed to critiques rel... more Currently, the tension between constitutionalism and democracy has been directed to critiques related to supremacy of judicial review. These approaches indicate that the democratic fragility of Constitutional Courts in comparison to Parliaments requires more popular participation in issues involving Constitutional content and, therefore, constitutional interpretation must be opened to institutional dialogue instead of judicial monopoly. However, for this dialogue to happen it is necessary the possibility of dissensus externalization. In the contemporary democratic theory, two main traditions analyze the role of consensus and dissensus. Habermasian deliberative theory evidences rational consensus between subjects through a communicative action. Nevertheless, the overvaluation of consensus is considered an obstacle to the emergence of institutional mechanisms of dissensus. Conversely, Chantal Mouffe’s agonism seeks to reinforce the constitutive role of dissensus in societies. However, her approach is limited to the presentation of an agonistic principle without answering the issues related to the creation of institutional spaces. In the face of these irreconcilable approaches, this paper argues the possibility of a establishment of democratic decisions, which involves institutional dialogue, such as the proposals of the critics of judicial review, in a panorama which consensus and dissensus are in opposite sides. It demonstrates that a rereading of habermasian model of the Democratic State of Law and the presentation of normative proposals to the agonistic approach put consensus and dissensus beyond a dichotomist and confrontational dispute perspective as they are commonly treated. In this sense, it presents arguments showing that an adequate interpretation of Habermas’ thought includes consensus in procedures and dissensus in content. On the other hand, it exposes that aversive conception of democracy goes beyond the deliberative model deconstruction presented by Mouffe and connects poststructuralist ontology with the creation of discussion’s spaces. In conclusion, these reformulations and advances inside deliberative and agonistic theories indicate that the role of consensus and dissensus in contemporary societies cannot be reduced to the dispute of the prevalence of one over the other. Beyond this dichotomy, it is necessary to put these two essentials elements in both traditions in order to promote the dialogue between institutions to overcome the dispute among powers, under which they were constructed, and exert their democratic function.
It is demonstrated that the political parties are indispensable to the exercise of political rig... more It is demonstrated that the political parties are indispensable to the exercise of political rights in Brazil, mainly because they are the exclusive holders of applications. Thus, the multiplication of parties is seen as a positive factor in the electoral process, as it extends the channels of participation. Under representative government, we present the different conceptions about political representation and its impact on French, American and Brazilian jurisprudence. We conclude that the political party has the potential to democratize the representative regime, because it is responsible for intercommunication between politics and civil society actor, as it gives voice to the plurality and influence. This relationship goes beyond the aggregation of individual will and widen representation beyond the traditional mechanisms.
ABSTRACT: Traditionally, in political philosophy the main prerequisites for the construction of a... more ABSTRACT: Traditionally, in political philosophy the main prerequisites for the construction of a fair political community are related to a reasonable consensus on the conceptions of justice and to the solutions of problems in moral disagreements. This paper aims to address issues related to the economy of moral disagreement in unequal societies and it argues how consensus, while a pre-modern ideal elevated to the condition of political dogma by political liberalism and public choice, is insufficient as a structuring political category of a fair political community, since it excludes dissent, and threatens democracy. The neoconstractualist model suggested by John Rawls or Jürgen Habermas can reasonably explain how consensus and public debate are fundamental to choose principles of justice in equal circumstances. On the other hand, in unequal societies, there are previous issues related to the establishment of public spaces that turn consensus, in some cases, impossible. By criticising the liberal tradition, this article concludes that an adequate formulation of a radical democratic project informed by pluralism depends on the interpretation of the “difference” as a condition of possibility of being.

From a bibliographic research, it demonstrates that these manifestations express the constitutive
dissent of democracy and, mainly, the popular sovereignty that challenges constituted powers. It concludes that civil disobedience and the right to social protest are instruments to be taken seriously to deepen democratic culture, as they represent a continuous constituent power not fixed in the State foundation Act, but which is influenced by its current times with the aim to reaffirm the historical constitutional compromise.

Por meio de revisão bibliográfica de textos de filosofia contemporânea e de filosofia do direito, é possível a construção de uma crítica da representação capaz de fundamentar os direitos humanos, sem o recurso ao sobre-vôo dos conceitos metafísicos do jusnaturalismo iluminista, ou tampouco recorrer as ficções legalistas dos positivistas. Este estudo procura realizar uma análi-se sistemática e criteriosa da experiência política e huma... more Este estudo procura realizar uma análi-se sistemática e criteriosa da experiência política e humanitária que os Governos autoritários propi-ciaram aos latino-americanos, e, ainda, a prepon-derância no imaginário da economia sobre a po-lítica, bem como o esvaziamento do político e sua redução a uma dimensão meramente instrumental do domínio econômico. Ainda, demonstrar que a relação entre os direitos políticos e o exercício da ci-dadania, em especial no que se refere ao orçamento participativo, um instrumento de política urbana dos municípios, associado com o igualitarismo liberal e ao igualitarismo, compatível com uma con-cepção de democracia como direito fundamental. Por fim, aponta-se que além de ser um instrumento de efetivo exercício da cidadania, o orçamento par-ticipativo tem-se demonstrado mais eficiente que as decisões políticas no orçamento público. Termina sugerindo a necessidade de se partilhar o controle de constitucionalidade, hoje exclusividade da Corte Constitucional, como demanda de um constitucionalismo popular. ABSTRACT: This article aims to provide brief notes on the constitutional control in contemporary constitutional theory. It addresses issues related to the tripartition of powers and the theory of " checks and balances ". Na sua tormentosa relação com o mundo dos fatos é possível encontrar situações em que a discriminação positiva, ou inclusiva, quer pelo reforço da igualdade, quer pela acentuação das diferenças se faze necessária. Tendo em vista que o direito das mulheres tem pouco indicadores formais na lei, a Lei Maria da Penha é um significativo marco legal de medidas afirmativas em prol das mulheres, ainda que possa ser criticada por alguns de seus já reconhecidos efeitos. Reconstruindo a história de discriminação das mulheres, o presente artigo critica a ideologia sexista machista de organização da sociedade e aborda o surgimento do direito das mulheres no bojo do movimento feminista. O artigo se encaminha para uma reconstrução da história do direito das mulheres no Brasil, e a construção da cidadania feminina, tecendo, por fim, algumas breves considerações sobre o direito feminista e a Lei Maria da Penha como instrumento de inclusão social.

Resumo: Procura interligar e comparar o pensamento aristotélico e as conclusões de John Rawls acerca do tema " desigualdade ". Recorda as conclusões de Aristóteles sobre a escravidão que, para este pensador grego, eram naturais, aceitáveis e desejáveis, não apenas para sociedade, mas também para os próprios escravos. Resume a teoria da justiça formulada por John Rawls, explicando a sistemática da posição original sobre a qual conclui que a justiça está baseada na defesa da liberdade e na aceitação de " uma certa desigualdade " , desde que respeitada a eqüidade. Apresenta as crítica formuladas por Enrique Dussel em face do pensamento rawlsiano. Conclui que o pensamento de Rawls não pode ser simplesmente interligado aos conceitos aristotélicos e que, ainda que longe do que seria desejável, o pensamento rawlsiano pode embasar significativos progressos sociais. Resume a teoria da justiça formulada por John Rawls, explicando a sistemática da posição original sobre a qual conclui que a justiça está baseada na defesa da liberdade e na aceitação de " uma certa desigualdade " , desde que respeitada a eqüidade. Apresenta as crítica formuladas por Enrique Dussel em face do pensamento rawlsiano. Conclui que o pensamento de Rawls não pode ser simplesmente interligado aos conceitos aristotélicos e que, ainda que longe do que seria desejável, o pensamento rawlsiano pode embasar significativos progressos sociais. Abstract: Try to establish connection and compare the Aristotelian thought and the conclusions of John Ralws about the inequality subject. Records the conclusions of Aristotle about the slavery, it, for that greek thinker was natural, acceptable and desirable, not only for the society but for the proper slavers too. Summarizes the theory of justice made by John Rawls, explaining the systematic of his start position on which concludes that justice is based in the liberty's defense and in the acceptance of " one kind of inequality " , since that respected the equality. Presents the critics propose by Enrique Dussel in face of Rawl's reflection. Concludes that the Rawl's thought can't be simply connected to Aristotelian concepts and although far of the desirable, the ralwsian thinking can be base of significantly social progresses.

approaches indicate that the democratic fragility of Constitutional Courts in comparison to Parliaments requires more popular participation in issues involving Constitutional content and, therefore, constitutional
interpretation must be opened to institutional dialogue instead of judicial monopoly. However, for this dialogue to happen it is necessary the possibility of dissensus externalization. In the contemporary democratic
theory, two main traditions analyze the role of consensus and dissensus. Habermasian deliberative theory evidences rational consensus between subjects through a communicative action. Nevertheless, the overvaluation of consensus is considered an obstacle to the emergence of institutional mechanisms of dissensus. Conversely, Chantal Mouffe’s agonism seeks to reinforce the constitutive role of dissensus in societies. However, her approach is limited to the presentation of an agonistic principle without answering the issues related to the creation of institutional spaces. In the face of these irreconcilable approaches, this paper argues the possibility of a establishment of democratic decisions, which involves institutional dialogue, such as the proposals of the critics of judicial review, in a panorama which consensus and dissensus are in opposite sides. It demonstrates that a rereading of habermasian model of the Democratic State of Law and the presentation of normative proposals to the agonistic approach put consensus and dissensus beyond a dichotomist and confrontational dispute perspective as they are commonly treated. In this sense, it presents arguments showing that an adequate interpretation of Habermas’ thought includes consensus in procedures and dissensus in content. On the other hand, it exposes that aversive conception of democracy goes beyond the deliberative model deconstruction presented by Mouffe and connects poststructuralist ontology with the creation of discussion’s
spaces. In conclusion, these reformulations and advances inside
deliberative and agonistic theories indicate that the role of consensus and dissensus in contemporary societies cannot be reduced to the dispute of the prevalence of one over the other. Beyond this dichotomy, it is necessary to put these two essentials elements in both traditions in order to promote the dialogue between institutions to overcome the dispute among powers, under which they were constructed, and exert their democratic function.
Habermas can reasonably explain how consensus and public debate are fundamental to choose principles of justice in equal circumstances. On the other hand, in unequal societies, there are previous issues related to the establishment of public spaces that turn consensus, in some cases,
