Engagement to Nowhere: Bristol Palin, Levi Johnston Break Up

2009_03_johnstpali.jpg Famous Alaskan teen parents Bristol Palin and Levi Johnston have confirmed their break-up to the Associated Press. The couple's relationship and pregnancy became an unavoidable talking point since Palin's mother, Alaska Governor Sarah, was the 2008 Republican VP candidate; the couple made a very public appearance at the Republican National Convention and their baby Tripp was born on Dec. 27. Today, Johnston said that they decided to mutually break up "a while ago" but his sister Mercede told Star there were bigger problems, "Levi tries to visit Tripp every single day, but Bristol makes it nearly impossible. She tells him he can't take the baby to our house because she doesn't want him around 'white trash'!" Bristol Palin, who just last month said they were getting married, is "devastated" about the Star article and said, "Unfortunately, my family has seen many people say and do many things to 'cash in' on the Palin name. Sometimes that greed clouds good judgment and the truth."

Ashley Dupre Blogs About Post-Scandal Life, Yoga

2009_03_ashleyrus.jpg Ashley Dupre offered up her "year after the Spitzer scandal" thoughts in a blog post for Global Grind, Russell Simmons' hip-hop news site. Dupre writes about moving on, "I am now 23 years old and I’ve made more mistakes than most people make in a lifetime. But to look back and see all that I have overcome, and to stand here, and actually still be here at all, that is a huge achievement. I am proud of myself for surviving," and how she's working on her spiritual side, "The more I know my true self, the more I come to have faith that my presence on earth means more or at least has different meaning than the media or disbelievers have tried to frame it to be." She and Simmons met at yoga class, and naturally, Simmons blogged about it, "While bent over in uttanasana, I noticed a cute, little, short girl whose hands were not placed properly," and when she introduced herself later, he thought, "Oh my god, this 5 foot, 1 inch god-seeker was the $4000 'escort' of Governor Elliot Spitzer."

Baby Dolls of Color Hard to Come By

2009_03_dolls.jpg Demonstrators putting together a display of baby dolls on the steps of City Hall yesterday in recognition of National Women and Girls HIV/AIDS Awareness Day struggled in their attempts to track down a balance of racially mixed dolls. The Times says that having a mix was important because about 90 percent of women living with HIV in New York City are black and Hispanic and an even higher percentage when it comes to new HIV infections in teenage females. But that wasn't easy to convey for members of the Gay Men's Health Crisis who helped organize it. One member said, “A few people who purchased dolls found it very hard to find brown or black baby dolls. I went to three 99-cent stores and couldn’t find any. Another colleague went to four stores. What is that about?” The paper points out that American Girl and Dora dolls (not to mention Homies) have gone a long way to diversifying what used to just include "Barbies dipped in color." Word is that Dora is about to get a sexy new makeover and there are now Sasha and Malia dolls—but not to be confused with the Obamas of course.

MTA Bailout Plan Stalled At State Senate Stop

Photograph by ultraclay! on Flickr Albany's plan to help out the MTA is stuck in the State Senate, where Senate Majority Leader Malcolm Smith has questioned whether the March 25 deadline is a real deadline. The MTA has previously said it would pass a series of severe fare hikes and service cuts if it didn't get aid but Smith said yesterday, "We’re just not sure if those deadlines are one that they put for the sake of getting......

Model's Lawsuit to Unmask "Skanks in NYC" Lands in Court

03119cohen.jpg A former Australian Vogue cover model, whose modeling career ended last year after a doorman disfigured her face with a broken bottle, is finally having her day in court. Liskula Cohen's lawsuit isn't against the hotel where she was attacked, but against Google—she's trying to force the company to identify an anonymous blogger who's been trashing her on the website "Skanks in NYC." Earlier today the lawyer for the blog was in court to explain why her client's identity should remain undisclosed. "Skank and ho are ubiquitous terms," skanky ho lawyer Anne Salisbury told the judge. "If you Google it, you get millions of hits... If you turn on VH1, skank, ho, skank, ho is every other word." Ah, the VH1 defense. If only every argument could be settled by turning to MTV Networks for guidance. According to the Post, Salisbury also also cited a recent New Jersey ruling dismissing a lawsuit against the operators of "Hot Chicks with Douchebags." (That kitten class action suit against LOLcats is also an important precedent.)

The owners of the Jets and Giants were on hand for a ceremony yesterday to celebrate the final steel beam being laid down on their new stadium. The complex is four months ahead of schedule after breaking ground only eighteen months ago. Both teams are set to move into the New Meadowlands Stadium for the 2010 season and the team owners say that it may be ready by this December. Jets owner Woody Johnson told the media, "In building a stadium, the politics and the financing are the critical factors, and with those in place, you can't......

Perp Beats Cop After Catching Questionable Facebooking

2009_03_nypdfb.jpg An ex-con arrested for possession of a weapon was able to beat the rap by using the arresting officer's MySpace and Facebook statuses against him. During the trial, Officer Vaughan Etienne had to explain why his MySpace mood was set to "Devious" on the day of the arrest and why his Facebook status was “Vaughan is watching ‘Training Day’ to brush up on proper police procedure” as the trial approached. The nail in the coffin for the officer though was probably some online comments he had left on an arrest video that included, "If he wanted to tune him up some, he should have delayed cuffing him... If you were going to hit a cuffed suspect, at least get your money’s worth ’cause now he’s going to get disciplined for a faggot-ass love tap." Etienne, who had previously been suspended for steroid usage, told the Times, “What you say on the Internet is all bravado talk, like what you say in a locker room.” Recently it was revealed that the NYPD is drilling their trainees on what not to put online after catching cadets flashing gang signs in profile pics.

According to the Times, the bill, which is still being drafted, will be proposed as part of the package of budget......

Authorities Describe Trinitarios' Escalating Violence

2009_03_triniarrests.jpg After yesterday's pre-dawn raids in Washington Heights and the Bronx to arrest 34 Trinitarios gang members (seven are still at large), the federal and local authorities discussed the operation. One fed told CityRoom the gang originated in prison "to protect them from the Latin Kings and the Bloods." NYPD captain Gerry Farrell of the Bronx gang squad said, "What started out as slashings and stabbings with knives and machetes has escalated to shootings and homicides." Acting U.S. Attorney Lev Dassin said, "Thanks to the work of dedicated federal agents and police officers, the residents of Washington Heights have safer places to live today, and those who would endanger their community with drugs and violence are now called to face justice." But one Washington Heights resident was unconvinced and told the Daily News, "It doesn't make me feel safer at all. There's always going to be some left on the outside. They can't arrest everybody."

Father and 3 Teens Arrested in Prospect Park Fight Death

Hundreds of friends and family members gathered at Cobble Hill Chapels yesterday to mourn the death of 17-year-old Sharif Abdallah, as police continued to investigate whether they will bring homicide charges against three teenagers and one father arrested in conjunction with the fight that led to the boy's death. As of right now, 42-year-old Angelo Bracco, along with his sons Eric and Christian and their friend Dominic Barbera, have been charged with gang assault. A friend of both the victim and the teens accused told reporters,......

Quick Lick of Warm Air Possible Today

Weather map from the National Weather Service If we are lucky Mother Nature will give us a warm weather quickie this afternoon. A warm front has brought fog and drizzle to town this morning. A heavier shower or two may occur before early afternoon. A cold front is quickly catching up to the warm front and will sweep away any moisture once it arrives early this evening. A narrow tongue of warm air may snake its way up between the......

Paterson Folds On Proposed Soda, Digital Download Taxes

2009_03_taxhell.jpg Today, Governor David Paterson backed off of some controversial proposed taxes, explaining, "Nobody wants to add problems to the citizens of New York. We got there because we couldn't find another place to trim or cut spending." Last December, Paterson unveiled a number of ideas to raise revenue like taxes on non-diet sodas, "digitally delivered entertainment services" (like an iTunes download), and clothing under $110. Apparently the state can avoid resorting to these kind of taxes because of expected federal stimulus fund money. Paterson, Assembly Speaker Sheldon Silver and State Senate Majority Leader Malcolm Smith all appeared at a press conference this morning; Smith said, "This decision lets the public know that they have input in the process and that we are listening."

Plane Engine Parts Fall On Queens Neighborhood?

2009_03_planeeng.jpg Yikes: WABC 7 reports, "A plane that experienced an engine failure above Queens may have dropped plane parts on a College Point neighborhood." An American Airlines flight (#309) left Laguardia this morning, bound for Chicago's O'Hare airport, and experienced some trouble and engine number two failed. The FAA said metal parts fell from the engine onto a home on 123rd Street. The plane, an MD-80, was diverted to JFK; according to WCBS 2, no injuries were reported from the plane or on the ground.

Japanese Artist Busted For Subway Station Graffiti

Nara's exhibit at the Marianne Boesky Gallery An inebriated 49-year-old artist was recently busted for drawing a smiley face at an L train stop. Well that certainly isn't the way you want to go down the night before your big gallery opening! Landmarks Commission Approves St. Vincent's New Design

031109stvincentsh.jpg The Landmarks Preservation Commission voted 8 to 3 yesterday to approve St. Vincent's designs for an $800 million hospital tower on the site currently occupied by the landmark O'Toole building in Greenwich Village. The vote came just a day after preservationists announced their lawsuit against St. Vincent's; some community groups have been trying, unsuccessfully so far, to stop the hospital from razing the 44-year-old building. The commission had previously rejected plans for a 329-foot hospital tower, but ultimately approved it at a height of 278 feet. But hospital officials still need the commission to approve their proposal for a 350-unit condo across the street; St. Vincent's plans to use money they raise from the apartments to build the hospital. Looking ahead to a surely prosperous future, developer William Rudin optimistically tells NY1, "Hopefully the economic situation we are in will have alleviated itself. And the economic stimulus would have kicked in and we'll see positive things happening in the economy and we think four to five years from now."

Stewart Takes On Cramer After Cramer Takes On Stewart

After Jon Stewart skewered CNBC's Jim Cramer on Monday night's Daily Show, Cramer had to defend himself—and levy some barbs at Stewart—on the Today Show as well as MSNBC's Morning Joe yesterday. Naturally, that gave Stewart and the Daily Show writing and video research staff yet another opportunity to go after Cramer as well as various NBC sister networks last night: Before this becomes a never-ending spiral, it appears that Cramer will appear on The Daily Show on Thursday night. We hope......

Strip Club "Pole Tax" Would Benefit Human Trafficking Victims

031109show.jpg State Assemblyman Felix Ortiz, a Brooklyn Democrat, is still pushing hard for a special tax on strip clubs, which he says would raise money to help victims of human trafficking. When Ortiz first proposed the tax last year, he also floated the idea of requiring strippers to purchase licenses before they could legally dance erotically. There's no mention of licensing in today's AP article, which reports only that Ortiz would like to levy a statewide, $10 tax on patrons of nude and seminude dance clubs and strip bars. Ortiz argues that the tax would generate plenty of desperately-needed dollar bills for sex trafficking victims at a time when there's no money in the budget to assist them. The bill doesn't have a Senate sponsor yet, but if it passes, strip club owners will probably just dodge the tax by moving their operations to bicycles.

Mexican Criminal Kingpin Hid In... Staten Island

2009_03_crimeking.jpg Federal authorities tell the Staten Island Advance that they apprehended the leader of a notorious Mexican gang "responsible for about 20 murders and numerous kidnappings in three Mexican states." Apparently Liberio Andrew Gonzalez, whose Liborio gang would dress as police officers, kidnap the young and old, and demand 4-6 million peso ransoms, had fled to the U.S. in 2005 and was living on Staten Island under another name and cleaning boats. Rosebank resident Calixto Reyes said Gonzalez rented an attic room for $400/month for the past few months, "He just lived upstairs with us. We really did not know." A man whose parents live across the street from Reyes said, "You don't think you know your neighbor, but you don't expect that. That's weird. What are you going to do? Maybe it's better off not knowing your neighbors."

North Brooklyn Trash Takes The Train Out Of Town

Yesterday morning, Mayor Bloomberg and other officials announcing the start of a new garbage era in Brooklyn: The city will export thousands of tons of trash from North Brooklyn by rail instead of by road. Mayor Bloomberg pointed out removing trash by rail will eliminated 40 long haul tractor trailer trips each day (or 13,000 each year), “That’s not only going to help reduce congestion on the borough’s streets and highways, it also will reduce the City’s greenhouse gas emissions and improve the air we breathe - especially......

Carrion Admits He Didn't Pay Architect

2009_03_carrionb.jpg Yesterday, Daily News noted that former Bronx Borough President Adolfo Carrion Jr.—now the White House's director of urban policy—approved a big city project designed by an architect who had just finished a renovation project on Carrion's own home back in 2007. After initially not telling the News how much he paid for the project or responding to the paper's request for cancelled checks, now the News gets a response: "Carrion admitted he hadn't paid architect Hugo Subotovsky to design a porch and balcony for his City Island home." Carrion adds that the final bill will end up being $3,627.50 for Subotovsky's 51.5 hours of work (just $71/hour) and claimed no bill was paid because he's waiting for the "final survey" to be "filed and approved...as is [the architect's] practice for projects of this kind." Hmm, that's interesting—one would think an architect would get on that immediately to, you know, get paid.

20-Month-Old Boy Crashes Car Into Building

2009_03_babydrive.jpg Newsday reports that a 20-month-old toddler managed to crash his parents 1993 Buick into a building on Long Island yesterday. Apparently the child's mother left the car running—with the boy's father in the front passenger seat—while she went inside a check cashing business last night. The toddler climbed from the backseat into the front and "put the car in gear, rolling it into the building." According to WABC 7, "The vehicle took out a brick column and a window before coming to a stop inside a store." Thankfully no one inside the car or in the store was injured.

34 Year Sentence For Man Who Went On 2006 Stabbing Spree

2009_01_stabbing.jpg Kenny Alexis, who was convicted attempted murder after stabbing four people in a 13-hour period in 2006, was sentenced to 34 years in prison yesterday. Prosecutors had asked for 75 years, but his defense asked the judge to consider Alexis's medical history—Alexis is schizophrenic and had spent time in a mental facility. Alexis first stabbed a tourist from Texas on a downtown C train; then he stabbed a man at the Rockefeller Plaza subway platform. His final two victims were Canadian tourists sitting on a traffic island in Times Square. The judge said it was amazing no one died and that these random attacks "are the scariest types of crimes that we see."

Last Night's Action: Larry+Nate=Great

Madoff Expected To Plead Guilty To 11 Criminal Charges

Photograph of Bernard Madoff (with bullet proof vest on, of course) escorted into court by Louis Lanzano/AP Billion-dollar Ponzi scheme operator Bernard Madoff headed downtown for a hearing about his lawyer this afternoon. In a nutshell, as the NY Times outlines them, the issues surrounding lawyer Ira Sorkin are: 1) He has represented accountants who were accused of investing with Madoff in the 1990s; 2) he and his family have invested with Madoff's "fund," and Sorkin's sons would be among......

$10 Billion Rail Plan Between NYC And Upstate

2009_03_buftrain.jpg Yesterday Governor Paterson announced a $10.7 billion plan that would improve freight and passenger rail service between NYC and various points upstate. The state hopes to vie for federal funds that would help double the number of intercity rail passengers along New York’s three major corridors (New York City to Albany, Albany to Niagara Falls and Albany to Montreal), increase freight service, and improve train performance—and this would, hopefully, reduce reliance on air and auto travel. Senator Schumer said, “From Albany to Rochester and from Poughkeepsie to Plattsburgh, we must update and reinvent our rail network to unclog the transportation arteries cutting off potential economic growth Upstate." However, hopes for a "high speed train" don't quite mean a bullet train: The Post explains, "At full development, Paterson envisions a train system that peaks out at 150 mph" ("Currently, the top speed on most tracks is 70 mph").

Queens Woman Found Guilty of Killing Estranged Husband

Mazoltuv Borukhova (left) and her husband Daniel Malakov A Queens jury found a doctor guilty for the 2007 death of her estranged husband. Both Mazultov Borukhova and her relative Mikhail Mallayev, who prosecutors say fired the fatal shots, were found guilty of first degree murder and conspiracy. Borukhova and her estranged husband Daniel Malakov were embroiled in a bitter custody battle over their 4-year-old daughter. A judge had granted Malakov custody, which greatly upset Borukhova. Malakov was killed when handing off......

Stock Markets Rally, Much To Investors' Relief

The stock indices all rose significantly today: The Dow Jones Industrial Average closed up 5.8%, gaining 379 points to close at 6,926. The S&P; 500 also rose 6.4% (ending above 719) and the Nasdaq jumped 7.1%. Bloomberg News reported, "Stocks around the world staged the biggest rally of the year after Citigroup Inc. said it was having its best quarter since 2007, spurring speculation the worst of the banking crisis is over." The NY Times adds the enthusiasm was also spurred by "calls for regulatory......

Murdoch's News Corp. Buys The Brooklyn Paper

2009_03_murdkertz.jpg The Observer reports that local independent Brooklyn newspaper The Brooklyn Paper has been purchased by News Corporation. The paper's editor Gersh Kuntzman said he hadn't met or spoken with News Corp. chairman Rupert Murdoch yet, but assured the Observer, "They don’t want the product to change. And they love the product. And the product is fantastic." Kuntzman, a former NY Post writer, had dismissed concerns that the Brooklyn Paper was in financial trouble last year, "Brooklyn needs us too much right now, what with local papers being snapped up by billionaire moguls who have no interest in local news except maximizing classified ad sales," a statement that he now amends to, "Brooklyn still needs The Brooklyn Paper, which is why one of the only people in the world who still believes in newspapers — Rupert Murdoch — is putting his money and genius behind us." Recently, a NY Times article looked at how Murdoch's fondness for printing was hurting News Corp.'s bottom line.

New Look for Purim in Obama Era: Black Face and Dreads

Aw, here's a cute, bright-eyed kid in Borough Park who probably has no idea that his Purim black face costume might be considered just a tad offensive. Of course, in a post-Drunken Negro Face Cookie world, this kind of tone-deaf Obama homage is no longer so surprising. The reader who emailed us the photo explained that the boy is donning black face to raise money for an unspecified charity, as part of Purim custom. Hence the "DOLLAR'S [sic] not CHANGE!!" sign. (The reader added that he......

9/11 Plotters: 'Blame Yourselves,' 'Your Failed Intelligence Apparatus'

2009_03_sheikh.jpg The five men, including Khalid Sheikh Mohammed, suspected of carrying out the 9/11 attacks issued a written statement calling the conspiracy charge "laughable." The Wall Street Journal reports, "The six-page statement, dated March 1, was filed with a military judge at Guantanamo Bay, Cuba, in response to nine charges filed by military prosecutors last year." Here's a PDF; some highlights: "Were you expecting us to inform you about our secret attack plans? Blame yourselves and your failed intelligence apparatus and hold them accountable, not us... Also, as the prophet has stated: 'War is to deceive.'" They also bring up the toll of civilian deaths the U.S. caused in World War II, "Did you forget about your nuclear bombs in Hiroshima and Nagasaki?"

A-Rod Surgery Successful/Clemens' Needles Test Positive

Last night Alex Rodriguez was released from the hospital and actually began his rehabilitation, riding on a stationary bike. Dr. Marc Phillipon, A-Rod's surgeon, said "there were no surprises," and that because everything went so well, that there was "no doubt in my mind......

Man Spends 28 Hours in Jail For Using Emergency Subway Exit

031009emergencygate.jpg An everyday occurrence turned into a 28 hour ordeal for a Queens man last month when he was arrested for using the emergency subway exit at DeKalb Avenue on the L line in Brooklyn. 32-year-old Todd Zielinski says he used the exit to bypass a crowd of commuters pushing through the turnstiles, but plainclothes cops stopped him, checked his ID, and sent him through what's commonly called "the system." In most cases, the NYPD issues summonses for minor offenses like this, but suspects without IDs or with outstanding warrants are sent on a long trip down to The Tombs before seeing a judge. But Zielinski, a Verizon technician, insists his record is clean and tells the Daily News, "They took 28 hours of my life away from me. People can't believe it. This is what our city's come to? I've taken the subway and buses all my life... If I counted how much money I've given to the MTA to be treated like this." (In 2006, the MTA reported that unnecessary use of the emergency gates was causing the automatic alarms to malfunction.) An NYPD spokesman confirmed the arrest, but it's unclear why Zielinski was detained for so long. Perhaps the inevitable lawsuit will shed more light on the incident.

41 Gang Members Busted in Washington Heights, the Bronx

2009_03_machete2.jpg This morning, federal agents and members of the NYPD busted dozens of members of the Trinitarios gang in Washington Heights and the Bronx early this morning. MyFoxNY reports, "The Trinitarios are accused of being a Dominican gang that operated and controlled drug trafficking on at least four city blocks in the area of West 171st Street through West 174th Streets in the Washington Heights neighborhood." Also: 200 law enforcement officers were involved with the raid. The Trinitarios are believed to be the city's fastest growing gang—and they are not afraid to use violence (their weapon of choice is the machete).

Daily Show vs. CNBC, Round 2

Forget Fox Business as CNBC's bête noire—CNBC is now up against an offensive from The Daily Show. Last night, Jon Stewart addressed the interest in last week's Daily Show takedown of CNBC and CNBC personality Rick Santelli. It was suspected that Stewart's rant (and accompanying video) was because Santelli had bailed on appearing on the show, but Stewart explained it was planned for Santelli to cause him "le discomfort." And Stewart got to have some fun with that other shouty CNBC guy, Jim Cramer. ......

"Real Housewife" Charged with Assaulting Boyfriend

0309realhouse.jpg Incase you had already forgotten about the Real Housewives of New York City, the newest one, Kelly Bensimon, is fighting her way to headlines! The NY Post reports that the "6-foot-tall, 40-year-old former model, horse fancier and one-time marathon runner got into a fight last week with her boyfriend, 30-year-old Nick Stefanov, and clocked him, giving him a black eye and opening a blood-gushing gash on his left cheek." Stefanov fled and reported the beating to the 5th Precinct, landing Bensimon with a misdemeanor third-degree assault and a March 31st court date (she's currently denying the charges). The two recently engaged lovebirds now have a restraining order that prevents them from contacting each other, but Stefanov seems to want to get back together with the "housewife" even though she's been physically abusive in the past—he did say, "My injuries are worse than Rihanna's - and Chris Brown was charged with two felonies."

Victims' Families Ask Manhattan DA, "Where's the Justice?"

Photograph of the rally outside the Manhattan DA's office by Graham T. Beck Yesterday, the families of two young children who were crushed to death by an unattended, idling van in Chinatown gathered with other New Yorkers to demand the Manhattan DA's office to prosecute the incident. The NYPD called the January 22 incident an "accident" and did not issue the driver for a neighborhood restaurant a ticket or take his license. The children had been walking on......

Citi Profit Memo Boosts Stocks

2009_01_citiplane.jpg After a memo from Citigroup CEO Vikram Pandit saying that the company was profitable in 2009 (thus far), the bank's stock is up 27% to...$1.34! But that news is enough to help other bank stocks rally and the Dow is up by about 250 points. Pandit said of Citigroup, which did receive $45 billion in TARP bailout money, "We are profitable through the first two months of 2009 and are having our best quarter-to-date performance since the third quarter of 2007." But he did add he was disappointed in the company's low stock price. Additionally, the Wall Street Journal reports, "U.S. officials are examining what fresh steps they might need to take to stabilize the [Citigroup] if its problems mount."

NYC Economic Forecast Goes From Dismal to Dire

Courtesy Gothamgirl's Flickr. The city's budget outlook is worse than previously estimated, will likely worsen over the next several years, and any future economic recovery will take place at a slower rate than the rest of the nation, according to a sobering analysis of Mayor Bloomberg's preliminary budget by the city's Independent Budget Office. In testimony yesterday [pdf] before the City Council’s finance committee, I.B.O. director Ronnie Lowenstein bandied about fun words like "meltdown," and "founder," and......

Carrion Approved Big City Project For His Personal Architect

2009_03_carrionb.jpg The Daily News has been investigating former Bronx Borough President and new director of White House urban policy Adolfo Carrion Jr.'s dealings with developers lately. Today, the News wonders whether there's a connection between the renovation work architect Hugo Subotovsky did on Carrion's City Island home and Carrion's approval of a huge taxpayer-subsidized development—designed by Subotovsky— in the Bronx. At the time of his home renovation (basically installing a balcony onto the second floor), the News reports, "Carrión had at least $15,000 in credit card debt, was paying off two mortgages worth more than $500,000 and had $5,000 in revolving credit from Chase bank." Carrion hasn't revealed how much the renovation cost and declined to show the News copies of the checks used to pay for the work, leading the News to remind us, if it was an unreported gift, it "could be seen as Carrión using his position to benefit himself financially, a violation of the law. It could also be unreported income."

Ex-Cop, Arrested For Killing Girlfriend, Tells Post, "I'm Crazy"

NYPD photo of Bowens (left photo); Bowens's girlfriend Catherine Donofrio and Melissa Simmons The former police officer who was arrested for fatally shooting his girlfriend and injuring her friend spoke to a NY Post reporter early Monday morning, apparently before he was arrested. Bowens, who had been embroiled in drug scandal with......

NYPD Crack Down on Drivers Using Cell Phones

031009mobilephone.jpg Take heed, Chatty Kathys, the police are about to start a crackdown on drivers using hand-held cell phones. Of course, the NYPD can't keep their mouths shut either, which is why a police source blabbed all about it to the Post, presumably via cell phone while driving at top speed up Sixth Avenue. The source was even kind enough to reveal the exact moment when the crackdown is set to commence: Starting at 12:01 a.m. Thursday there will be stepped-up enforcement, with more cops assigned to catch people chatting while driving. So you've got less than 48 hours to recklessly multitask; violators face a fine of $120 if caught. In 2008 the NYPD issued 195,579 summonses to drivers using hand-held cellphones, and last August the City Council and State Legislature talked about banning text messaging while driving, too. And once that passes, you know they're coming for your BrickBreaker!

A year ago today, the NY Times published a story on its website saying that Governor Eliot Spitzer, the crusading former NY State Attorney General who was elected with 69% of the vote in 2006, was "caught on a federal wiretap arranging to meet with a high-priced prostitute at a Washington hotel last month, according to a law enforcement official and a person briefed on the investigation." And that sent off a chain of events amongst a motley group of famous (in political circles) and suddenly infamous characters. Click through for trip down Memory Lane. ...

McCain Doesn't Want Obama To Fail But...

2009_03_mccainob.jpg In an interview with Politico, Senator John McCain said, "These are terrible, perilous times, so I will seek ways to work with the president of the United States. I don’t want him to fail in his mission of restoring our economy.” However, he has problems with how President Obama and his administration have been handling budget issues so far, as well as the measures enacted by President Bush, “We’re pouring billions and billions of dollars into (banks) with not only no improvement, but their stocks continue to plummet. I think we have been pursuing the wrong strategy.” McCain added that the Obama administration "would have to present a blueprint that not only convinces me but frankly that convinces the Warren Buffetts and the Jack Welches ... people we would look up to who are experts who would say this plan will work. We don’t hear that.” Well, Warren Buffett did say yesterday that the GOP should support Obama.

Lorne's Stalker Case Dismissed

0309lorne.jpg Last summer Lorne Michaels's "stalker," 31-year-old Evans Pidhajecky, went to court for allegedly "mailing, calling or visiting Michaels at least six times" in 2007. Well how else was he going to accuse the SNL producer of stealing ideas from his brain telepathically? Oh right, telepathically! Today reports are coming in that the case has now "been adjourned for six months. The judge says it will be dismissed and sealed if he stays out of trouble." Criminal Court Judge Robert Mandelbaum also "ordered Pidhajecky to undergo therapy twice a week for six months," and of course leave Lorne alone. This also means that Lorne is still to blame for his own bad ideas.

Mugger Scoffs at Non-iPhone Options

0309cellphonetheft.jpg The NY Post's police blotter brings us back to the days of Mugger Money. They report a suspect confronted two 20-something females on East 59th Street near Park Avenue at 4:10 a.m. on Saturday wielding a large knife. After taking their cash, "the thief then asked to see their cellphones, but, when the women produced them, he uttered, 'I don't want that,' and ran off." Aside from sounding like something that would happen to Liz Lemon, perhaps this can serve as a warning that it could be time to start carrying around your old rotary telephone as a decoy! Or install Google Latitude for tracking purposes. [via NY Mag]

Blood for Beer Trade Nixed By New York Blood Center

Brooklyn-based Kelso brewery is pushing ahead with a promotional intended to encourage blood donations, despite cold feet from the New York Blood Center, which asked not to be associated with the blood drive. Kelso's "Pint for Pint" drive promises a free pint of beer to anyone presenting a recent receipt from donating blood. But Kelso brewmaster Kelly Taylor tells Brooklyn Paper the New York Blood Center has asked that its name be removed from the promotional: "They said we degraded the process of......

Spitzer Call Girl Coughs Up Details on Rough Role-Playing

As the one year anniversary of the Eliot Spitzer scandal pulls near, the Daily News ties up one of its loose ends and gets some kinky details from an escort who claims that she was sent to the former governor. "Annie" opens up to Rush & Molloy about Spitzer's desire to play rough with her. She tells them: He wanted a scenario where I was supposed to say I had just been to a self-defense class. He was supposed to respond, 'Let's see if you learned......

NYPD Cop Accused of Bias Attack on Long Island

2009_03_nunez.jpg On the same day a former cop was charged with killing his girlfriend, another NYPD officer is one of four men who have been arrested for beating up a man on Long Island yesterday—charges that may be upped to a hate crime attack. 32-year-old Juan Nunez has been suspended by the NYPD after he and three other Hispanic men allegedly attacked 52-year-old Daryl Jackson outside of a deli at 8:15 a.m. Sunday morning. Jackson was initially called a racial epithet by one of Nunez's group while he was waiting to use a pay phone. When Jackson said that he didn't appreciate the slur, he claims one of the men said, "Go back to Africa." Jackson ended up in the hospital with head and neck wounds after the attack which allegedly involved a baseball bat. Nunez is a 7-year vet at the 101st precinct in Far Rockaway.

MTA Waits For A Bailout From Albany

Photograph by dchadwick on Flickr Forget that talk of an imminent MTA bailout—the Post conducted a survey of State Senators and found, "Unless five Democratic state senators can be convinced to change their minds, the plan to bail out the MTA by imposing tolls on East and Harlem river bridges is dead in the water." The MTA claims it will need to undertake severe fare hikes and service cuts if it doesn't get help from Albany, but......

New TriBeCa Development Already Popular with Mannequins

Take the dispiriting new Truffles TriBeCa over by the West Side Highway; this 291-unit eyesore has been trying to lure tenants with an increasingly "offbeat" marketing push, replete with half-naked models lying ass up on a sofa in what could be your totally boss apartment, brah.......

Preservationists Sue to Save St. Vincent's O'Toole Building

030909otoole.jpg A coalition of community groups and preservationists have filed a lawsuit against the Landmarks Preservation Commission [LPC] and St. Vincent’s Hospital to try and block the demolition of the distinctive O’Toole building in Greenwich Village. You'll recall that after a bitter public battle, St. Vincent's hospital was granted a “hardship-status” exemption last October to raze the landmark building to make way for a 299-foot-tall medical tower. The lawsuit, spearheaded by a group called Protect the Village Historic District, argues that the LPC "did not make an adequate investigation of alternatives, including the potential reuse of St. Vincent's existing buildings." Officials at St. Vincent's have threatened that the hospital would have to close if it could not build an $830 million medical tower on the site of the O’Toole, which NY Times architecture critic Nicolai Ouroussoff hails as a representation of "a moment when some architects rebelled against Modernism’s glass-box aesthetic in favor of ornamental facades." Others simply call it the "overbite building."

Mayor May Be Leaving Budget Gap with Rising NYPD/FDNY OT

2009_03_thompson.jpg Overtime costs for cops and firefighters are on the rise and City Controller William Thompson doesn't think that the mayor's budget is sufficiently accounting for it. Today Thompson is presenting his report on the budget to City Council and beforehand told reporters, "The city routinely and severely underestimates how much annual overtime will accumulate, and inevitably this widens the budget gap that will need to be closed." Thompson said that the mayor's office is undershooting the OT spending by more than $140 million in a year that saw the city pay out more in overtime than recent ones that saw the blackout, the RNC Convention and sending troops to assist Hurricane Katrina damage respectively. A spokesman for the mayor said that no matter the estimates, the city's budget will be balanced just like any other. Over the weekend, Thompson also compared Mayor Bloomberg's recent comments about the futility of taxing the rich to former President Bush's "trickle-down philosophy."

Sidewalks in Bad Shape, Costing City Millions in Lawsuits

030909sidewalk.jpg The city's Sidewalk Management Unit has not been doing a very good job, according to Comptroller William Thompson, Jr., who is releasing his annual report on the state of the sidewalks. Over the last several years, the city has paid an average of $63.5 million annually to settle claims relating to defective sidewalks. Thompson says millions could have been saved if the DOT hadn't failed to inspect one out of every five sidewalk defect complaints; he's also dismayed that violations remained unfixed for an average of four years. According to the Daily News, the DOT issues summonses to homeowners, and if they fail to fix the violation, the city is supposed to do the repairs and bill them. But when the repairs aren't done, the city is liable in court. (In 2003, a law was passed to make commercial businesses responsible for their sidewalks, which reduced the number of lawsuits against the city.) Another part of the problem is that parks officials don’t have the $34 million necessary to fix the 22,229 reported sidewalks that have been buckled by the city’s mischievous street trees.

Yesterday, over a thousand people flocked to the Javits Center in hopes of landing a deal at the city's first home foreclosure auction. The NY Times, which said 1,400 were in attendance, described the atmosphere:On the floor, four men called the bids, screaming, blowing whistles, thrusting their arms into the air and using their fingers to signal how much more was being offered over the last bid... There were experienced bidders, many of them investors who have made careers of buying, fixing up and selling foreclosed homes for below-market prices — and quick profits. There were the novices, who......

Another Kid's Dad May Have Been in Brawl Where Teen Died

2009_03_sharif.jpg The Cobble Hill teenager who collapsed and died over the weekend while fleeing a fight at a party in Prospect Park had allegedly been struck by a middle-aged man, the father of another teen involved in the melee. A friend of the late Sharif Abdallah told the Times, “They ambushed two of our friends. They came out of nowhere. They were beating on them. The father was doing most of the fighting.” Yesterday police brought in the man who says "they have it all wrong." No charges have been filed yet. The fight broke out at a going way party for a high school friend, when Abdallah was part of a group who stood up for a friend's girlfriend who another group of teens said looked like "Ugly Betty." Sharif's friends had initially claimed that he had a heart condition that may have led to his sudden death, but his family has denied that. An autopsy will be performed today.

Buffett Tells CNBC Economy Has "Fallen Off a Cliff"

Billionaire investor Warren Buffet discussed the economy on CNBC's Squawk Box this morning, pointing out the obvious—how its has "fallen off a cliff"—while also trying to remain upbeat, saying the economy will be better in five years, though he'd "like to get there a lot faster than five years." Of course, Buffett's "off a cliff" remarks apparently offset a rally this morning! Buffett also thinks that the GOP should back President Obama's efforts to help the economy and tried to put it......

Today: Rally for Children Killed in Chinatown Van Crash

2009_01_chkicr.jpg Just before noon, a rally is being held outside the Manhattan DA's office, demanding for an investigation into the deaths of four-year-old Hayley Ng and three-year-old Diego Martinez. The two pre-schoolers were killed when an unoccupied van, left idling on East Broadway in Chinatown, jumped a curb and crash into them as their class was coming back from a field trip. The incident was deemed an accident, but the children's families are upset that the driver wasn't even issued a ticket and still has his license. Hayley's aunt told Streetsblog "We're hoping for the DA to set a precedent and prosecute this person or convene a grand jury." (WCBS 2 interviewed Hayley's mother who said, "No, I'm not all right! I'll never be all right! She's gone!") The rally is at One Hogan Place.

Coney Island Deadlock Could Be Broken With Eminent Domain

Courtesy Digiart2001. Mayor Bloomberg's controversial plans to rezone and develop the Coney Island amusement district have been long stymied due to a breakdown in negotiations between the city and developer Joe Sitt, who has bought up much of the beachfront property in the area targeted for development. The city wants to purchase Sitt's 10.5 acres of property, which includes the now-desolate Astroland, for approximately $110 million, according to the Post. Sitt, whose grandiose plan to build a......

Sex, Peeing, Drunken Antics at Hoboken St. Patty's Parade

2009_03_stpats.jpg Hoboken Public Safety Director Bill Bergin is so fed up with the city's St. Patrick's Day Parade that he wants to cancel next year's parade. He described the chaos on Saturday to Hoboken Now, "On Washingtion Street, bottles were thrown onto the people below. A girl and a guy were performing sex in a window when the parade was going by. One person spit in the face of a fireman. There were young, young girls that were blind drunk standing in the middle of the streets, so drunk that they didn't know where they were." And don't forget people were also urinating from rooftops—apparently most of disturbances were not bars but from "house parties." Hoboken mayor David Roberts and other officials will be discussing the parade and its future. Bergin said, "People talk about how much money the city makes from the parade. But if four or five people go falling off one of these roofs, there's no way to make up for this with fines."

NY Times Building Deal Brings in $225 Million

NAMBLA Reportedly Wants to Kill Andrew Cuomo

2009_03_cartnam.jpg According to the Post, Attorney General Andrew Cuomo is the target of a death threat from an "imprisoned pervert with strong NAMBLA ties." Apparently a member of the North American Man/Boy Love Association posted a message on an Internet bulletin board offering "$10,000 to shoot Andrew Cuomo in the face!" Someone noticed the posting and contacted Verizon, who then let the authorities know. The Post suggests the entire NAMBLA organization may support the effort as a source says, "It is our understanding that people in the, and I hate to call it this, 'pedophile community' are angry at Cuomo's office because he's been making the [Internet service providers] take responsibility for policing child pornography - and he's been very aggressive in seeking to keep NAMBLA types behind bars through civil commitment." Cuomo's security has been increased and the investigation is continuing.

Two Anti-Light Pollution Crusaders Try to Bring Back the Stars

But two different stargazing projects are trying to change that, at least temporarily. The Daily News reports that when Simmons "buzzed Bowens inside, an argument broke out, followed by......

Drunk Driver Kills Motorcyclist in Greenpoint

2009_03_motogp.jpg A 21-year-old man riding his motorcycle was killed by a driver in Brooklyn around 1:30 a.m. on Sunday. Brian Sitarevich, who was riding with other friends, was on Humboldt Street when he was hit by Daniel Levens's SUV; Levens had tried to make a left turn onto Greenpoint Avenue. Levens, of Massapequa, was charged with drunk driving and the Brooklyn DA's office is investigating whether to press more charges. Sitarevich's father wouldn't blame Levens yet, "I can't point the finger at someone that might be innocent," but added, "There is a hole in your heart and I hope one day it will close. I keep looking at the door and hoping he is going to walk through the door for dinner or something."

FBI to Continue Dig at Alleged Mob Burial Site

2009_03_digfbi.jpg The FBI will resume a search for bodies allegedly buried at an industrial park in East Farmingdale, Long Island. Last fall, FBI went there in October after an informant said that at least three bodies were there, but only the body of mob hit man William Cutolo, aka Wild Bill, was found (he was previously thought to be dumped in the ocean). The remains the FBI are reportedly looking for belong to Richard Greaves, a Columbo family associate suspect of becoming an informant, and Pace student Carmine Gargano Jr., who may have been targeted because a relative worked for a rival mob family.

Pub Crawlers Finding it Harder to Drink without Distraction

2009_03_bartvs.jpg Fewer and fewer bars in the five boroughs establish themselves as a neighborhood hangout without the assistance of a television to draw patrons in. Even Greenwich Village pub staples The White Horse Tavern and McSorley's Ale House have sets, though the latter claims theirs is rarely on. Today's Times goes out in search of bars that forge ahead without the distraction of a TV, a group that Brooklyn Brewery owner Stephen Hindy calls a vanishing species. Not surprisingly, the ones they find wear their lack of television as a badge of honor at bars like Scratcher and Beer Table in Park Slope, where they seem to have no problem turning away customers looking to watch a game with their pint. An owner of the Swift Hiberian Lounge NoHo tells the Times, "We’ve never had a television because we wanted to inspire something that is close to the conviviality of pubs in Ireland.” One of the patrons there added, "The only good thing about a TV is that if you want to dump a girl, you can pretend to be watching it."

Making The Call: A-Rod's Injury Exposes A Weak Bench

Photo Courtesy Mary Altaffer/AP The Yankees and Alex Rodriguez made a very smart decision earlier today; they decided that Alex would undergo surgery on his injured hip Monday. The operation, which is being described as a “hybrid” solution, should sideline A-Rod for 6-9 weeks. He will need an additional operation after the season to fully repair his injury. Alex Rodriguez is going to be a Yankee for the next nine seasons. They have to protect their investment. Dr. Friedrich Boettner,......

Bloomberg On Board With MTA Reorganization Plan

2009_03_blsubway.jpg With news that the State Legislature is working on a MTA bailout plan that involves combining the duties of the chairman and CEO, the Daily News reports that Mayor Bloomberg appears to support it. The mayor said, "If Dick Ravitch thinks that the management should be streamlined, it's probably a good idea," referring to Ravitch's suggestions for MTA revenue creation. Currently the MTA has an unpaid, part-time chairman—currently Dale Hemmerdinger— and a full-time CEO/executive director—now Elliot Sander; if the jobs were combined, it's unclear which would be the last man standing—or if someone totally new would be appointed. Bloomberg didn't voice his support one way or the other, but did say, "Lee Sander has done a great job. He's worked very hard, but first let's see what the law is. If it's changed I would certainly be happy to give my opinion to the governor... In terms of who should run it, if he were to pick Lee or not, I just don't know."

Brooklyn Teen Dies After Late Night Scuffle in Prospect Park

2009_03_prospect15th.jpg A teenager in Prospect Park dropped dead while fleeing the scene of a fight where a gang of teens had upped the ante of a scuffle by showing up with a man twice their age who then got involved. The Daily News reports that 18-year Sharif Abdallah confronted a group of teenagers after they called a female friend of his fat and ugly. A minor confrontation escalated when the gang of mocking teens returned to the park with a man in his 30s or 40s, who put one of Abdallah's friend in a headlock and engaged in what police called "fisticuffs, but nothing serious." As Abdallah ran away from the altercation, he collapsed at the 15th Street exit of the park from what friends believed to be a heart murmur. He was rushed by paramedics to Methodist Hospital, but pronounced dead soon after. Police are still investigating the incident that led to the death of the senior at Xaverian High School. A friend told the News, "He was the funniest kid in the world. He was an artist; he could draw anything in his mind."

Some Better-Biking-in-NYC Suggestions

Photograph by luluinnyc on Flickr The NY Times' City section has a sprawling feature about biking in the city by writer Robert Sullivan. Sullivan (who wrote the wonderful Rats about the rodent's history in NYC) noticed how his bike rides these days are much more pleasant—compared to 1987 when it included "navigating honks and taunts, the mayhem that was then on Cathedral Parkway"—thanks to more recent bicycle-friendly measures and, overall, more bicyclists on the road. But......

Stimulus Check to NYS is in the Mail

021709schumer.jpg Senator Charles Schumer said yesterday that the large chunk of stimulus money that will go to New York should be arriving by the end of this month. Local schools will be able to factor the stimulus money into next year's budgets when they're put together in late March. Schumer said, “These are difficult times for our school boards and this aid is critical to avoid layoffs and higher taxes." Schools will have to obligate 85 percent of their stimulus money by the end of 2010, with the remainder needing to be allocated by the end of September 2011. Albany will also get a good chunk of its stimulus money in the weeks ahead, with Governor Paterson and legislators expected to tangle on how to divvy it up to address various budget needs. Schumer is credited for bringing the state a good piece of the stimulus pie with one Democrat recently saying after the final bill went though, "Whatever Chuck wants, Chuck gets."

Albany Power Vaccuum Lets Speaker Get on a Shelly Roll

2008_09_silvervamp.jpg We're barely a couple of months into the long-awaited Democratic rule of both the Assembly and Senate in Albany, but sources say that Assembly Speaker Sheldon Silver is running circles around his new counterpart, Senate Leader Malcolm Smith. One Democrat tells the News, "Malcolm is a newcomer. He needs a year to figure it all out. Shelly has been here forever, so it's really not a fair fight." After initially having his leadership challenged by senators from within his party, maintaining such a slim majority over the GOP and gaining little leverage from a struggling Democratic governor, Smith has been able to get very little passed. Meanwhile Silver, the old veteran, continues chugging along, securing enough votes to pass bills strengthening rent-control laws and easing the Rockefeller drug laws. Another Dem says, "Shelly has played this perfectly. If things get done, he's a hero. If they don't, it's all Smith's fault."

A-Rod Officially Out 6-9 Weeks After Surgery Tomorrow

After several days of deliberation and speculation, the Yankees announced today that Alex Rodriguez will undergo arthroscopic surgery tomorrow to repair the torn labrum in his hip. That should only keep A-Rod sidelined somewhere from six to nine weeks, an improvement on the original diagnosis that a cyst would keep him out for a full ten weeks. Rodriguez's torn labrum will require more attention over time however. After playing out the season, he will have to go another surgery next off-season to fully mend. GM......

Foreclosure Auction at Javits Center Today

2009_03_foreclo.jpg Where else can you get a $500,000+ home for five figures? The Real Estate Disposition Corp. is holding a foreclosure auction for 375 homes in NY, NJ, and Pennsylvania at the Javits Center today. The Post explains that while the auction is free, "but buyers need a $5,000 cashier's check and valid ID. Only cash will be accepted for some homes." A spokesman told Crain's, "In the past, there weren’t enough foreclosed New York homes to hold an auction. This year I suspect that there will be a second and third auction in the city." While some of the homes may be great deals—this graphic shows a $740,000 house in Port Chester with a starting bid of $149,000—many of the homes are not in very good shape. And there is criticism of foreclosure auctions: A group will be protesting while Rep. Carolyn Maloney noted that the House passed a measure to make mortgage payments affordable, "In these tough economic times, we need to preserve the American dream, not auction it off."

Wall St. Friday's Was Ultimate Hot & Spicy Spot for Cocaine

Photo by Billy Parker Cops raided a TGI Friday's in the financial district on the day of its namesake and shut it down after discovering that the family eatery was striped with cocaine. Apparently the business plan at this franchise location included looking the other way as dealers at the bar lured in high rollers from nearby Wall Street institutions. The Post says that the bankers and traders would "spend their nights getting high after the market spent the day......

Police Search for UES Serial Mugger

2009_03_uesmug.jpg The NYPD released a sketch of a man believed to be responsible for three separate muggings. In all three incidents, the victims were hit on the back of their heads. The first, on 2/22, around 9:11 p.m., involved a woman walking her dog on on 91st Street and East Drive. Then, this past Monday, a woman was robbed at First Avenue and 90th Street and then minutes later, another woman was robbed at 90th and York Avenue. It's also believed that the same mugger is the one chased away from a woman at 89th Street and York on Tuesdayaccording to the Post, a doorman saw a man "rush up behind a 31-year-old woman, knock her into a pile of garbage bags and jump on her back at about 12:30 a.m. Tuesday." The doorman, who tried to chase the attacker, said, "She couldn't yell because her face was pushed into the garbage." Contact Crimestoppers with any information.

Circuit City Closes Today

2008_11_circuity.jpg Nearly two months after announcing its plan to liquidate—and four months filing for Chapter 11—electronics retailer Circuit City is closing its doors today. The AP reports, "Circuit City was slated stay open until the end of the month, but the final day came early because most of the remaining merchandise has been sold. One of the liquidators (four were handling the sale of CC's merchandise) told Bloomberg News, "Overall, we are pleased with the way things went." Some consumers, on the other hand, might not have been happy with the liquidation sales, such as a Minnesota family that claims they were prevented from opening a TV box to see if it was damaged...only to go home and see it was shattered. The chain leaves behind a number of locations (some rather large) in NYC; it's unclear what stores will fill them in this real estate market.

Bobcats 114, Knicks 105: After Knicks losses, a good place to start evaluating what went wrong is the opponent's shooting percentages. Charlotte shot 55.4 percent from the floor, 50 percent on 3-pointers and 87.5 percent. Those are a good sign that the Knicks did not play good defense. Charlotte isn't very good, but it has won six straight -- the longest streak in franchise history. Al Harrington had 24 points, but he only scored four after halftime. Nate Robinson had 20 points, nine from the free-throw line....

How Low Will The Real Estate Market Go?

2009_03_realesta.jpg As the economy slips and takes the (overheated) real estate market with it, the NY Times wonders how much NY real estate prices will decrease: "Some industry observers foresee market drops of 40 percent, while others think that is too extreme and suggest that price reductions of 25 percent will more be likely the new norm." Which makes sense, since those Wall Street bankers throwing their bonus money or foreign investors around are rare breeds these days. Still, falling prices isn't necessarily a bad thing to Corcoran Group president Pamela Liebman, who said, "Why should an average one-bedroom with nothing special to offer cost well over a million? The market got ahead of itself, and this correction is good for New York because it brings the affordability back in line.” Well, those real estate brokers making commission off the average not-so-special $1 million apartment weren't complaining!

Madoff May Face Victims at Upcoming Hearing

2009_02_madoffhl2.jpg With Ponzi scheme "investor" Bernard Madoff reportedly set to plead guilty to cheating his client out of billions, a former federal prosecutor tells the Post, "This guy is going to die in jail...He's got nothing to negotiate with. There is absolutely no deal that can be cut unless he can give up Hillary Clinton or someone like that." (The Post envisions that Bernie's cellmate will be named Bubba.) Newsday reports that "Manhattan federal judge Denny Chin said he is allowing the government to notify by Internet Web site postings the thousands of Madoff investors burned in the scandal that they have the right to appear in court on March 12." Madoff investors who wish to speak must email the U.S. Attorney's office (at [email protected] ) by Wednesday 10 a.m. We hope if victims are allowed to speak that Elie Wiesel is one of them. Last week the Holocaust survivor and Nobel Prize winner Wiesel, whose charity lost eveything, said, "It's the inhumanity in this man who simply believed he can go around depriving people of their livelihoods. What he has done to certain people, it breaks my heart."

Don't Forget to Spring Ahead Tonight!

2009_03_spring-ahead.jpg If you're looking to make a late night out of the unseasonably warm winter evening, you might want to get a head start since last call might come an hour earlier than expected tonight. Daylight-savings time officially leaps forward by an hour at 2 a.m. Sunday morning. WPIX was at the Tourneay TimeMachine in Midtown set 8,000 clocks and watches at the new time this afternoon. And while most of us just grumble over the loss of an hour of sleep, the consequences of the change can actually be much more serious. MSNBC reports that number of heart attacks ride 5% in the two weeks following the spring ahead (and decrease 5% when we fall behind). At the very least, you can take a step to keeping yourself safer by taking the FDNY's advice and changing the batteries on your smoke alarms and carbon monoxide detectors.

The driver of a van in Harlem today lost control, causing the vehicle to jump the curb and injure six people while simultaneously toppling a scaffolding. The scaffolding had just been cited last month by the Department of Buildings for not meeting safety code standards. An owner of a nearby deli at 136th Street and Lenox Avenue told the News, "It sounded like the whole building fell down." The accident has left one construction worker in critical condition at the nearby Harlem Hospital. A construction worker who raced across the street after hearing the accident said, "We pulled the......

Beating Assures That Cell Griper Can In Fact Hear Her Now

2009_03_cellphoneguy.jpg If you think that someone nearby has no concern for you because they are talking loudly on their cell phone, you might want to consider just how deeply that lack of interest in your well-being might run. Thursday in Borough Park, a woman tried to take a stand against an overly vocal mobile user and ended up on the receiving end of a beating. After being told to pipe down while talking loudly on her phone by the woman while inside a bodega, 21-year-old Berta Rakhamimov chased the chastiser down, shoved her in the chest, threw hot coffee in her face and began biting her on the finger and kicking her thigh with her high heels. Rakhamimov then fled, but police were able to catch up with and charge the woman with assault, menacing and criminal possession for the attack that left the victim bruised and burned.

MTA Bailout May Come With Organization Shuffling

2009_03_elliotsander.jpg Word is that a bailout plan for the MTA could begin making its way through state legislatures in the week ahead. This past week was one that only seemed to present stalling for any potential alternatives to the looming threat of a $100 monthly Metrocard. Despite a push from Assembly Speaker Sheldon Silver, any serious talk of bringing tolls to the East River crossings has hit a snag with the Democratic bloc in the State Senate known as the Three Amigos demanding the MTA "go back to the drawing board" and calling for an audit for the agency. The new bailout plan would come with some potential reorganization for the MTA, a new position would combine the roles of the full time executive director (picture, current executive director Elliot Sander) and the part-time, unpaid chairman (currently Dale Hemmerdinger). The legislature could also see a revenue driven proposal from Governor Paterson that would substantially raise DMV registration fees.

Bloomberg Warns Against Taxing the Rich

Mayor Bloomberg repeated a familiar refrain during his radio show on WOR yesterday: Why taxing the rich isn't a great idea. He said, "We can tax the rich, except that, if you haven't looked at the stock market lately, they aren't making any money." The mayor, whose considerable wealth makes him the 8th richest American (according to Forbes), also explained, "They [the wealthy] are the ones that buy in the stores so that people that work in the stores have jobs in the stores, generate......

Mafia Cops Will Still Collect Pensions

2009_03_mobcopshl.jpg While the two former cops convicted of carrying out murders for the mafia were sentenced to life in prison yesterday, the two men will continue to receive thousands of dollars each month in pensions. Since Stephen Caracappa and Louis Eppolito were charged with their crimes after retiring in the early '90s, their families will continue to receive the pensions, which cannot even be seized and used towards the millions in fines they have to pay as part of their sentence. Yael Perlman, the daughter of a gem dealer killed by the pair, said yesterday, "That's sick." Attempts to overturn the statutes that are paying out pensions to 450 corrupt officials have gone nowhere. Last year City Councilman David Yassky said, "It's a world that rewards people who lie, cheat, steal, take bribes, betray the public trust and embezzle public funds."

Yanks Claim Witch Hunt as Pols Try to Mandate Cheap Tix

Photo by Skyliner72 on flickr The Yankees have done all right for themselves with politicians when they've needed officials to sign off on financial assistance for their new stadium. But when team brass has had to come in and answer to some representatives who have been more than skeptical of the deals the team has received, their treatment hasn't been quite so cushy. Yesterday saw another contentious round between Yankees President Randy Levine and the man who's become......

WTC Construction Means Lots of Jobs

2009_03_wtc.jpg Earlier this week, Port Authority said that the construction of buildings, a 9/11 memorial and transit at the World Trade Center site will result in more than 26,000 jobs. And the indirect job—like the ones that "supply services, materials and machinery to the rebuilding effort"—creation may add over 35,000 jobs to that number. That's notable because 30,000 construction jobs are expected to be lost over the next few years. Port Authority Chairman Anthony R. Coscia said, "The World Trade Center rebuilding effort is an economic shot in the arm for our region at a difficult time. This investment in our region's future is also helping us in the present - by creating tens of thousands of jobs and generating billions for our local economy." The WTC project will extend until 2016. Also, the Port Authority agreed to let the NYC Department of Building shut down job sites with unsafe cranes; previously, the PA did not have to surrender to city regulations because it's a NY-NJ state agency. The WTC site has 24 cranes—the most in the city.

11 Injured When Wall Collapses into Harlem Building

Photograph of the rubble from the collapse inside Pizzeria 123 from Harlem Hybrid Yesterday afternoon, a concrete wall collapsed into a pizza parlor at 2280 Frederick Douglass Boulevard at West 123rd Street yesterday afternoon, injuring 11 people. Construction was taking place at the lot next to the pizza parlor's five-story building, and the eatery was filled with bricks. The Daily News says the chunk of wall that collapsed was about 16' by 10' and that the injured......

Fatal Shooting Inside a Van in Greenpoint

2009_03_grnptshooting.jpg Police are investigating a shooting that allegedly took place at Morgan Avenue and Meeker Avenue in Greenpoint last night. Two men were driving the victim in search of a hospital when they flagged down a Triborough Bridge and Tunnel Authority officer as they headed towards the entrance of the Midtown Tunnel not far from the Greenpoint border in Queens around 11 p.m. The two men told police that the victim was in the front seat of the gold Honda Odyssey parked alongside the BQE when another man shot him in the head and then fled the scene. The victim was pronounced dead once EMTs arrived. No arrests have been made and police have not released any description of the alleged shooter.

Cabbie Says Alleged Sexual Assault Victim Attacked Him

Photo Courtesy AP/Bonny Ghosh The "not my baby back" cabbie who made headlines last year for his questionable Good Samartian act has now officially been charged with first-degree attempted rape. Klever Saliema is accused of forcing himself on a female passenger who had passed out during her cab ride home from Astoria to Woodside in Queens. Saliema turned himself into police yesterday after some suspected that the 46-year-old livery cab driver had fled back to his native Ecuador. His......

Cuomo Accuses Bank of America of Interfering With Probe

2009_03_cuomole.jpg NY State Attorney General Andrew Cuomo, in his quest to get to the bottom of Merrill Lynch's extravagant bonuses right before announcing a $13.8 billion 4th quarter loss, told a judge, "We respectfully request that the court reject Bank of America’s continued efforts to stymie the attorney general’s investigation." Bank of America, which bought Merrill, has allegedly threatened to sue an employee for cooperating with Cuomo's investigation. The bank says it "has continually offered to provide the information the attorney general is seeking if he would agree to an appropriate confidentiality agreement. He has continually declined," (Cuomo wants to air all the dirty laundry). Additionally, the AG's office says it has found signs of "trading irregularity"; per Bloomberg News, a London-based Merrill trader who "recorded a trading profit of $120 million for the fourth quarter may instead have lost a large amount." Bank of America and Merrill Lynch have received a combined $45 billion in bailout funds.

Reminder: Bone Marrow Donor Drive for Jasmina Today

2009_03_jasminar.jpg Between 10 a.m. and 2 p.m. today, P.S. 41 (116 W. 11th Street, Manhattan) is holding a bone marrow donor drive, in hopes of finding someone who may be a match for kindergarten student Jasmina Anema, who is suffering from a rare and deadly form of leukemia. Jasmina, who just turned six, is adopted, so her doctors are unable to turn to blood relatives for bone marrow transplants and her family and friends have been trying to draw attention to the drive (see the very touching video at her website). Her mother told the Daily News earlier this week, "I need thousands of people to come," and called Jasmina, who was three days old when she was adopted, "the love of my life." The drive is also to raise awareness about registering as a potential bone marrow donor; here's more information about eligibility requirements.

Gandhi Memorabilia Auctioned Amidst Confusion

030609gandhistuff.jpg A number of items that once belonged to Mahatma Gandhi sold for $1.8 million at auction yesterday despite an outcry from the Indian government and a last-minute change of heart from the items' owner. The Times describes a somewhat chaotic scene that unfolded minutes before the lot was to be auctioned off, when a lawyer for James Otis, who amassed the items piece-by-piece in the '90s, tried to halt the proceedings. Julien Schaerer, an official of the auction house, said that Otis had entered a "legally binding agreement" to sell the items, and ordered the lawyer escorted from the building. The lot, which included his sandals, pocket watch, and spectacles, was ultimately purchased by Vijay Mallya, who owns the company that makes Kingfisher beer. Otis had earlier rebuffed an offer from the Indian government to buy the lot, calling it too low, but said he would be willing to hand it over if the government agreed to increase spending on the poor. It's unclear what prompted Otis's second thoughts, but he said he would not challenge the auction if Mallya returned the items to India.

Mafia Cops Sentenced to Life in Prison

Louis Eppolito (left) and Stephen Caracappa Nearly three years after being convicted, former cops Louis Eppolito and Stephen Caracappa were sentenced to life in prison for carrying out eight murders for the mafia. Caracappa, 67, was sentenced to life plus 80 years, while Eppolito, 60, was given life plus 100 years. The Daily News reports, "The crooked pair earned as much as $65,000 for one of their hits on behalf of brutal mob boss Anthony (Gaspipe) Casso. The......

Props for Today to File Bankruptcy

2009_03_props.jpg With productions fleeing the city after the state's tax credit program ran out of money, a popular prop house is now expected to file for Chapter 11 bankruptcy protection next week. Props for Today, which has been around for 28 years, hooks up shows like Saturday Night Live and 30 Rock with furnishings, and Crain's reports that owner Dyann Klein will attempt to "reorganize" after a rough year. Klein said, “The decrease of film making and television in New York, which began with the writers' strike and has continued and been escalated by the loss of the tax incentives, has impacted everybody in this industry. I believe I will be able to implement necessary changes in reorganization in Chapter 11 and emerge as a much stronger, healthy company that will continue to be the leader in prop rentals in the industry for years to come.” Allegedly the company owes just under $1 million in rent on its West 34th Street space. In the meantime, maybe local Michel Gondry can help some productions in need of props with his cardboard boxes.

Harlem Building Facade Collapse on West 123rd St

2009_03_harlcollapse.jpg An exterior wall at 270 West 123rd Street in Harlem collapsed around 3:15 p.m. WCBS 2 reports the building was "partially under construction" and "appears to be a five-story walk-up with a pizza shop, Pizzaria 123, on the bottom floor." WABC 7 says that some pizzeria customers were temporarily trapped: "Workers were pouring concrete at a construction site when the wall collapsed into the pizzeria next door." Four people were injured; the extent of their injuries is not known.

NYC is Not So Manly

php2PhBBHPM.jpg Put down that silly book and stop ironing that tight-fit v-neck for a moment, lads, and know this: you're now a part of the least manliest city in the nation, according to some list. The #1 spot on the "America's Manliest Cities" index went to Nashville (home to an unhealthy number of NASCAR enthusiasts), with NYC falling right at the very bottom. They report, "Despite high ratings in the bowling category, New York City ranks 50th out of 50 in the study due to low scores in manly indicators such as fishing, home improvement and drag racing." Cities that got higher rankings did so through high purchases of salty snacks, number of hardware stores, monster truck rallies and, of course, sports bars. Fun trick: if you flip the list upside down you'll get the America's Most Educated Cities list, and hey, we're #1! [via Village Voice]

Council Groups Don't Meet New Standards, Don't Get Funds

2009_03_cityhall.jpg The Post reports, "Mayor Bloomberg has lowered the budget ax on funding for several community organizations after determining the groups did not meet new standards." City Council members distribute $46 million to various non-profit community groups, but last year it was discovered that money was being left for phantom groups—with the money used by the Council Speaker's office for "future gaps"—so a new review process was put in place. A Bronx community center was disqualified due to "poor performance on past contracts" while four others, including a graffiti removal company, were were deemed to be for-profit. The Post adds, "Hundreds of recipients are still under review and have yet to receive funding."

NY State's Depressing Unemployment Numbers

Graph depicting the rate of job losses in New York State during recent recessions from the NY State Department of Labor. Yesterday, the NY State Department of Labor revealed the state unemployment rate climbed to 7% in January, up from 6.6% in December. More troubling, 25% of the 400,000 jobs added between July 2003 (the state's last decline) and August 2008 were lost in the final months of 2008. Division of Research and Statistics. director Peter Neenan said the data "continue......

Brooklyn Pay Toilets Stalled By Landmarks Commission

030609toilet2.jpg Brooklyn will have to cross its legs and wait for the arrival of the first automated pay toilet; following up on an initial report on Brownstoner, the Daily News has confirmed that the Landmarks Preservation Commission has postponed a vote on the matter. There was considerable excitement last month when plans for a toilet in Grand Army Plaza were revealed, particularly because there are few bathrooms in the immediate vicinity, and the public is often reduced to using the less than sanitary porta-potties in Prospect park. The local community board approved the proposal, but it seems the commission is concerned the toilet's aesthetics will clash with the surrounding landmarked structures, such as the Soldiers’ and Sailors’ Arch. They've requested renderings showing how the toilet will look in the wider context of Grand Army Plaza, and won't vote until they're satisfied with what they see. Two of the self-cleaning pay toilets are already doing brisk business in Manhattan (with occasionally embarrassing results); they cost 25 cents for 15 minutes on the throne.

Madoff Waives Indictment; Guilty Plea Up Next?

Fraudulent investor Bernard Madoff appears to be ready to enter a guilty plea, as he has just waived his indictment (meaning he's waiving the right to have a grand jury to review the charges). The Law Blog reports, "The waiver could presage a plea deal for Madoff. Often, prior to a plea, a defendant will waive his or her right to a grand-jury indictment. In such a case, the prosecutors’ 'charging document' — the document which lays out the case against the defendant — is......

Report: Foreclosed Homes Attract Crime

2009_03_foreclo.jpg As one report says the biggest jump in delinquent mortgages occurred in NY State (up 35% last year), another report is linking a rise in crime to the rise in foreclosed homes. Based on ACORN's studies, the Daily News reports, "The only Queens areas where crime rose between 2006 and 2008 - Jackson Heights, Kew Gardens/Woodhaven, Jamaica/Hollis and Rockaway/Broad Channel - had high foreclosure rates." (Lawmakers have said those areas were targeted with subprime mortgage offers.) Looking at NYPD and FBI data, ACORN found that high-foreclosure neighborhoods had much more crime than low-foreclosure neighborhoods over that period, "The increasing displacement of homeowners leaves neighborhoods without the deterrent presence of concerned neighbors' watchful eyes." The News offers one example: "Two serial rapists who terrorized southeastern Queens last summer viciously attacked women more than a dozen times in a vacant church and other abandoned buildings."

Now Paterson Pisses Off Environmentalists!

2009_03_springpower.jpg Today's "who has Governor Paterson upset now" story is in the NY Times, which details how the governor "agreed to reconsider a key rule New York adopted as part of a 10-state pact aimed at reducing the threat of global warming by cutting power plant emissions...at the urging of the energy industry." (Okay, so he hasn't pissed off the energy concerns.) The pact is the Regional Greenhouse Gas Initiative, which calls itself the "first mandatory, market-based effort in the United States to reduce greenhouse gas emissions," with participating states promising to "cap and then reduce CO2 emissions from the power sector 10% by 2018." According to the Times, Paterson's "reconsideration" would allow power plants to have more leeway in releasing emissions without cost. While his staff says the governor was thinking about the energy industry being, potentially, "unfairly" burdened, what also bothers environmental groups is that they only found out about Paterson's about-face this week when he apparently told the energy industry about this last fall.

Wow, Warm Weekend Weather

The temperature has already surpassed anything seen in the past week and the......

Weiner + Foreign Models + Illegal Donations = Post Gold

030609weiner.jpg The Post is all excited and "EXCLUSIVE" in a "report" on campaign donations made by foreign models to Representative Anthony Weiner's mayoral campaign. Back in June, not long after Weiner made headlines by pushing for visa changes to make it easier for foreign models to work here, a fundraiser was held for his campaign at Merkato 55. According to the Post, the gala was co-hosted by an immigration lawyer whose firm represents some of the top modeling agencies, and several foreign models in attendance made donations ranging from $300 to $500. That's illegal—not because Weiner is rallying to their cause—but because they're not citizens. Weiner's spokesman says it was a simple mistake; they never even deposited the checks, which were returned months ago, and one the models doesn't actually recall attending the party (no surprise there). So why is the Post even talking about this? Because who can resist a headline like, "Weiner's Naughty Hottie$" Certainly not us!

Police Search for Livery Cabbie Accused of Raping Passenger

A livery cab driver who was thrust into the spotlight last year in a faked abandoned baby story is now wanted for allegedly raping a passenger in Astoria. The police are looking for Klever Sailema (pictured, center), who may be in hiding or may have even left the country. According to police, a 23-year-old waitress passed out drunk in his cab and Sailema allegedly assaulted her. A source told the Daily News, "She kinda wakes up and finds him on top of her. She......

Chicken-Loving Flight Fight Guy Guilty as Charged

030609flight.JPG After a nearly three year battle, a man who punched an American Airlines flight attendent on a plane traveling from Zurich to New York has been unable to clear his name. Pierre Delis of Maryland was convicted of assault back in 2006 after an argument with a flight attendant got physical; the incident was sparked when the attendant pushing the dinner cart informed him there was no chicken left, only roast beef. She says Delis shouted obscenities at her and then punched her in the chest, leaving a bruise. He says he hit her inadvertently while trying to swat her hand out of his face. At any rate, Delis was arrested upon landing and ultimately sentenced to time served—the few hours he'd spent in jail—and had to pay $10 in court costs. But he's been trying to overturn the conviction ever since, taking it all the way to the U.S. Court of Appeals for the Second Circuit in Manhattan, which yesterday upheld the conviction. So, now you know: Pierre Delis of Maryland is GUILTY of hitting a woman in chest because he couldn't get his precious airplane chicken.

Court: Tishman Speyer Wrongly Hiked Stuy Town Rents

Yesterday, the state appeals court ruled that developer Tishman Speyer "had wrongfully raised rents and deregulated thousands of apartments after receiving special tax breaks," the NY Times reports. Tishman Speyer paid $5.4 billion for the development, Stuyvesant Town and Peter Cooper Village, which includes both rent-stabilized and market-rate apartments. Building owners can raise stabilized units' rents if tenants are making more than $175,000 for two years in a row—which Tishman Speyer did and had always eyed doing to make the purchase profitable —but the court......

Arrest Made in Queens Home Invasion, Granny Slashing

2009_01_hiqns.jpg In January, an 86-year-old woman was attacked when a man who broke into her Springfield Gardens home put a pillow over Vivian Squires' head as he slashed her. The perp also stole her jewelry, cash and car. Yesterday, the police announced they made an arrest—the Daily News reports that the suspect is "career hoodlum Andre Mathis." Squires, a retired corrections officer who required 35 staples in her back and 18 stitches for her injuries, told the News, "I am glad they finally caught him - he needs help." She also added she wants to prevent others from falling into a life of crime, "We are going to organize the Gritty Granny Gang. I am going to be a gang leader. My gang is here to help. Not hurt."

Massive Protest Against State Budget Draws 50,000 to City Hall

Thousands of teachers, health care workers, labor unions, and community groups held rallies across New York State yesterday to protest Governor Paterson's budget proposal, which would slash approximately $2.5 billion in education funding, $3.2 billion in health care, and cut billions from programs for senior services, disability services, housing assistance and crisis intervention programs. In downtown Manhattan, rally organizers say some 50,000 people assembled around City Hall, and the crowds forced the NYPD to reduce Broadway to one lane and close side streets. Jumbo-trons were......

Sudden Staten Island Geyser

2009_03_sigey.jpg This morning, a water main broke close to the intersection of Arthur Kill and Veterans roads. The Staten Island Advance reported, "Water is apparently reaching utility wires, prompting the FDNY to call in Con Edison to assess the situation." Not only that, water was shooting up 30-40 feet in the air and, as MyFoxNY shows in some video, "Cars were actually driving through the water." The DEP is also responding to the situation.

Unemployment Rate Jumps to 8.1%

The U.S. Department of Labor released the latest unemployment numbers: The unemployment rate was 8.1% in February, with 651,000 jobs slashed during the month. Reuters reports the 8.1% figure "was above market forecasts for a rise to 7.9 from January's 7.6 percent." This continues a trend of massive layoffs across the country since last year: 533,000 jobs were lost in November, 681,000 in December, and 655,000 in January.

Commish Tells TD Bank It Has Too Many Robberies

2008_11_kellyr.jpg Police Commissioner Ray Kelly really wants TD Bank to increase its security: The Daily News reports that he sent the bank a letter criticizing the bank's "friendly" atmosphere (like robber-friendly) lack of bandit barriers, "It is simply unacceptable to put business decisions before public safety." The News adds, "As if to prove Kelly's point, a prolific thief successfully robbed $1,000 from a TD branch on Ninth Ave. Monday - after being rebuffed at three Chase branches" (the Chase branches do have barriers between the customer and tellers). Apparently 17% of this year's bank robberies occurred at TD Bank branches, but TD Bank says, "We don't believe saying that we have a disproportionate amount of robberies is a fair portrayal of us." The NYPD wants to see bandit barriers plus eye-level cameras and "countertops designed to leave clear fingerprints" at bank branches to help deter more bank robberies (which were up 57% last year).

FDNY Invites You to Spring Ahead with Free Batteries

This weekend, we turn the clocks ahead one hour for Daylight Savings Time, which the FDNY always encourages you to use as the marker to take a few minutes and replace the batteries in your smoke alarms and carbon monoxide detectors. City Says New Yorkers Getting Healthier

030509healthnut.jpg Yesterday Mayor Bloomberg and NYC Health Commissioner Thomas Frieden announced that New Yorkers are making progress in meeting seven out of 10 public health goals set in 2004 as part of the mayor's "Take Care New York" comma-phobic health policy. By 2007, the most recent year on record, New Yorkers had surpassed 2008 targets within four of the program's priority areas: colon cancer screening, regular access to primary health care, tobacco smoking, and intimate partner homicide. High-five? According to surveys, 300,000 fewer adult New Yorkers smoke than in 2002, there were 598 fewer deaths from HIV, and 319 fewer children developed lead poisoning. Because of the improvements, the city's life expectancy has also grown by a year and three months since 2001. New Yorkers born in 2006 can now expect to live an average of 79 years, but not long enough to see the Knicks make the playoffs.

Paterson Gives Up 10% of Salary to Save His '10 Hopes

2009_01_patersonstat.jpg Let's hope Governor Paterson isn't as whimsical with our state budget as he is with his own. Less than twenty-four hours after being presented with the idea to take a pay cut while at a town hall meeting in Niagara Falls, the governor announced that he will in fact give up ten percent of his salary. While in Buffalo today, he said, “I will symbolically make the gesture for the state. I will take that sacrifice.” But while the governor might be desperate to get in the good graces of state voters, don't expect to him to do it at the expense of his staff members, who recently drew attention to him for the raises he gave them amidst the budget crisis. As for them, Paterson said, “I don’t want anyone else to do anything but do their jobs and make sure that we get rid of this budget deficit."

Doctor Insists She Didn't Kill Estranged Husband

Dr. Mazoltuv Borukhova during her arrest last year The Queens woman accused of plotting to kill her estranged husband testified yesterday and today. Dr. Mazoltuv Borukhova and her husband Daniel Malakov were embroiled in a bitter custody battle over their young daughter Michelle. Malakov was fatally shot while dropping off Michelle to Borukhova in a Queens playground in October 2007. A homemade silencer found at the scene had the fingerprints of Borukhova's uncle by marriage, Mikhail Mallayev. Borukhova was arrested......

Scott Stringer the Latest Dem to Challenge KGill

2009_03_stringer.jpg While no Democrats have jumped on the declining poll numbers of Governor Paterson to suggest their own potential run for governor, they seem to be chomping at the bit to exploit the potential vulnerability of new Senator Kirsten Gillibrand. Yesterday Manhattan Borough President Scott Stringer said he's considering a run, telling the Times, “Voters have an expectation for a Senate seat held by Kennedy, Moynihan, that there will be a discussion of issues through the electoral process.” Stringer added that he would not run in the primaries if another potential candidate does—Long Island Congresswoman Carolyn Maloney. Despite Gillibrand's softening of many of her pro-gun stances while in the House, Maloney continues to sound unimpressed by her. Maloney said, “She’s turned her opinion on just about everything, but people are seeing through that. Who is she? What does she stand for? That’s going to be her biggest problem, that she flips on everything.”

It's Raining...Icicles

Following the snow storm, there's no doubt that the sidewalks in the city weren't all ice-free this week. Earlier this year the DoT told us, "The City is generally in charge of snow removal on streets and sidewalks, though property owners share in that responsibility on adjacent sidewalks." But what about all of that melting snow dripping on your head? NY1 reports today that "The Department of Buildings says property owners should safely remove any ice or snow from buildings." (Having an icicle fall on you is just as possible as you falling on the ice, after all.) They also say that "melting snow can damage the building's structural integrity and that cold temperatures could create a safety hazard in the form of icicles." Mother Nature is quickly loosening up those frozen daggers, so be careful out there!...

A-Rod Out for 10 Weeks Due to Hip Surgery

2009_03_arodtongue.jpg It's barely March, but it's fair to say that Alex Rodriguez is not having the best year ever. After reports surfaced yesterday that an MRI showed that tightness he was experiencing in his hip stemmed from a cyst, now word is that the cyst will require surgery that will keep A-Rod out for ten weeks. ESPN learned of this from his brother who told them that surgery to remove the cyst is scheduled for Monday in Colorado. Joe Rodriguez said, "It's a big blow for the whole family. Alex is destroyed. But the most important thing is to have a successful surgery so that Alex may continue his career." The procedure obviously means that A-Rod is out for the World Baseball Classic as well as more than a month of the Yankees inaugural year in their new ballpark. And to add insult to injury, just today the Daily News ran a feature of A-Rod's 10 biggest foot in his mouth quotes—our favorite being his allusion to nightly slumber parties with Derek Jeter.

Reports: Grand Jury May Hear Cop Rape Allegation Case

Sources tell Newsday and the NY Times that a grand jury will likely hear the case surrounding allegations that a police officer raped an East Village woman. The Times reports, "A spokeswoman for the Manhattan district attorney’s office confirmed there was an investigation but declined to comment further," while Newsday says, "Nearly three months after the incident, much about what happened the night of Dec. 7 is murky, with inconsistencies in the story provided by the woman and the two officers involved - Franklin Mata,......

Billboard Protector de Blasio Gets Bucks from Billboard Owners

030509blasio.jpg Remember the other day how Councilman Bill de Blasio was all, 'Leave billboards ALONE!' because, he says, the Department of Buildings has been slapping billboard owners with huge fines over supposedly minor infractions? And some of you cynics in the audience were quick to insinuate that the honorable gentleman from Park Slope was only making a stink because he's in bed with the outdoor signage industry? Well, maybe you were right. Just days after calling attention to the vast hardships endured by billboard owners, de Blasio, who is running for public advocate, has accepted $8,000 in campaign donations from billboard companies, the Post reports. Not too shabby! Maybe this will motivate de Blasio to finally do something to protect the poor tobacco industry and persecuted fast food restaurants and the defenseless auto industry?

Chimp Mauling Victim's Recovery Potential is Unclear

2009_02_cnash.jpg Charla Nash, the Connecticut woman who was severely mauled by a friend's pet chimpanzee, remains under sedation, according to her doctors at the Cleveland Clinic in Ohio. The Stamford Advocate reports that they revealed the extent of her injuries as well: Nash, 55, "lost her nose, lips, eyelids, hands and bone structure in her mid-face and suffered significant brain, eye and tissue injuries in the attack." The hospital said that while her injuries have stabilized, "critical issues still remain related to a significant traumatic brain injury and injuries to her eyes that threaten her vision." The Stamford, CT police say the toxicology results for 200-pound chimp Travis, who was shot dead after the attack, will be available in the next few days. The decision whether the police will charge Travis's owner, Sondra Herold, (the police's criminal investigation is continuing) will take weeks. Nash's brother Stephen told the AP, "She's tougn. I'm optimistic. I think she can do it."

Rev. Billy Will Rollback Wal-Mart to a "Lake of Hellfire"

There's good news and there's bad news. Good news: Wal-Mart won't be moving to Union Square. Bad news: They're still eyeing Manhattan. (If you're a big box supporter, adjust accordingly.) The NY Post that "The company's real-estate scouts have also been roaming the area around 620 Sixth Ave" (which Curbed points out is part of "the Ladies' Mile building with T.J. Maxx and Bed, Bath & Beyond"). We asked Reverend Billy, who recently announced he's running for Mayor under the Green Party, what he......

Bob Guskind, Gowanus Lounge Blogger, Dies

2009_03_guskind.jpg Bob Guskind, whose passion for his Brooklyn neighborhood turned into the popular Gowanus Lounge blog, passed away yesterday. Only the Blog Knows Brooklyn reports that the site was non-operational yesterday—"Readers and fellow bloggers were concerned that their phone calls, and texts were not being returned"—and his death was confirmed by an official from the ME's office (his body was apparently found in his Prospect Heights apartment). Guskind, who was also, until recently, the Brooklyn editor of Curbed, will be missed by many who followed his interest in Brooklyn development issues. Miss Heather has a lovely video of Guskind from this past weekend. Our condolences to his family and friends—and we will miss him, too. Update: The Brooklyn Paper has an account, which is, at turns, sensational and harsh, speculating about Guskind's death. Photo by Louise Crawford

NJ Office Workers Hit the $216 Mega Millions Jackpot

Photographs of the winning ticket and nine of the ten employees who pooled their money for the ticket by Mike Derer/AP When the winning numbers of the $216 million Mega Millions lottery were announced, it turned out the winning ticket was purchased at a Toms River, NJ gas station. And the purchaser of the winning ticket? Bob Space, a Chubb Insurance employee, who bought $50 of tickets on behalf of the office pool—and who was filling in for the......

Albany Hurries to Spend Stimulus Cash; Bloomberg Wants Fair Share

With New York getting a hefty chunk of the federal stimulus package (or, as the Obama administration would like to call it, the American Recovery & Reinvestment Plan), it turns out that state officials are trying to figure out how to spend it quickly enough! According to the NY Times, "Nearly every day, officials from 20 agencies meet there to sift through hundreds of proposals, from waste-treatment plants to courthouses to emergency wireless systems." They are racing against the clock because a lot of the money......

Woman Sues Landlord for $10 Million Over Nosy Super

030509roper.jpg A young woman who moved to the Upper East Side after graduation is suing the landlord of her old building because the elderly married superintendents would sometimes enter her apartment without her knowledge. According to court papers, 22-year-old Navah Meller has been left "traumatized" and "unable to sleep" because super Ilona Biro, age 79, allegedly rearranged her belongings, rolling up a tube of toothpaste, opening care packages from her mom, and folding her panties without permission. Meller tells the Daily News, "It's all very creepy. My unmentionables are such a private product... New York is the greatest city in the world—who doesn't want to live here? But this experience has ruined that a bit for me. I was so taken advantage of." Her lawyer is seeking $10 million, and says, "I can't say I know for sure what these folks were doing with Miss Meller's undergarments." But Biro's 84-year-old husband George insists Meller gave them keys and said they could come in to fix leaks. He swears, "I don't know anything about her underwear."

Big Turnout Expected for Job Fair in Midtown

2009_03_jobfair.jpg Today, Monster.com is kicking off its "Keep America Working" tour with a job fair at the Marriott Marquis in Times Square (it's at 1535 Broadway, at 46th Street, on the 5th floor), which starts at 9 a.m. and ends at 3 p.m. WCBS 2 reports that over 90 employers will be at the job fair and thousands of job seekers are expected. In a small bit of less-depressing- than-the-usual news, jobless claims fell 31,000 from the original estimate of 670,000 claims for the week ending February 28. Of course, 639,000 jobless claims is no fun and the number of people continuing to stay on unemployment is 5.11 million (for the week ending February 21). Reuters says, "That number remains near record highs, indicating that the harsh economic environment is making it tough to find new jobs."

Lafayette Ave. Fire Investigated

2009_03_lafafire.jpg The early Wednesday morning fire on Lafayette Avenue in Brooklyn's Bed-Stuy neighborhood is being investigated by the fire department. According to NY1, "Fire marshals are focusing on the possibility that there were three separate fires sparked by electrical problems." (Yesterday, it was suspected that a manhole fire was the cause.) Apparently Con Ed was in the area, to check out a reportedly smoking service box, "But the utility says the service box is not connected to the buildings were the fire broke out." One resident said, "There was a Con Edison truck across the street and then you just heard this big boom and then the lights dimmed in the house, the TV went off, and then, when I went to the kitchen window to look out, you just saw this bright light." The Red Cross is sheltering the eight families whose homes were evacuated; some of the residents were alerted by a neighbor's barking pit bull.

Knicks 109 Atlanta 105: The defense didn’t show up and Nate Robinson couldn’t play, but it didn’t matter. Larry Hughes had 23 points while Al Harrington added 20 points and 10 rebounds. David Lee had another double-double with 13 points and 14 rebounds. Boston 115 Nets 111: They almost pulled off a huge upset, but the Nets fell just short. Vince Carter hit a huge three-pointer to put the Nets up by three, but it was the last points the Nets would score all night.......

SI Man Puts Rappers to Shame with Gun Arsenal

2009_03_siguns.jpg A tip to the Organized Crime Control Bureau led police to the home of a Staten Island landlord where they found a slew of unlicensed weapons that included 77 handguns, three rifles, two stun guns, several knives and boxes of shells. 54-year-old Gary Granato was arrested on weapons charges for the arsenal he had been unable to secure a permit for, despite two attempts to do so. A police source said, "That's 80 guns off the streets that could have fell in the wrong hands." Most of the guns were apparently antique (but still usable) collectibles purchased at auctionarms.com. One neighbor told the News, "There was a lot of FedEx and UPS deliveries every day. When one would leave, the next one would come."

PETA Goes Further Down the Pole for New Anti-Fur Models

Phot Courtesy AP/Evan Agostini Today PETA released its newest ads in the long campaign where famous figures such as Pamela Anderson and Dennis Rodman profess that they'd rather "Go Naked" than wear fur. Who's joining those illustrious ranks? It's the strippers from Rick's Cabaret! PETA says, "Nowadays, savvy investors are looking for safe bets." Those bets probably wouldn't include investing in the establishment that the animal rights organization highlights as "the only strip joint on NASDAQ." Shares of......

Would Strawberry Have Juiced? 'Aw Hell Yeah!'

2009_03_straw.JPG The Mets brought retired superstar Darryl Strawberry down to camp as a hitting instructor, but it didn't take long before he started giving an unofficial lesson in media relations. When asked if he would have taken steroids had they been commonplace in the '80s, he responded, "Hell, yeah, I would have used them. Are you kidding me?...And I wouldn't have denied it, because you guys know I don't deny anything." He also didn't fault the newest public enemy in the steroid scandal, Alex Rodriguez, for lacking any of the notorious candor of the former Mets All-Star with a tell-all book on its way. The Straw Man told reporters, "He's taking the bullet for everybody. He admitted he was wrong and everything. I think that should be enough for everybody." As for A-Rod's much-criticized defense of being "young and stupid" when he took banned substances, Strawberry said, "Sometimes people question that, but over the years of my life, I've realized, you are stupid when you're 24 or 25 years old."

Gandhi Auction to Proceed in NYC Despite Indian Court Order

Items which once belonged to Mahatma Gandhi—including his sandals, pocket watch, spectacles, an eating bowl, plate, and results of a blood test—will be auctioned off tomorrow in Manhattan through Antiquorum, a leading watch auctioneer. The memorabilia is owned by James Otis, an LA-based documentary filmmaker who has gradually amassed the possessions, many of which were given away to various individuals by Gandhi himself during the course of his life. But according to Market Watch, Gandhi's descendants have been pressuring the Indian government to stop the......

Rangers And Islanders Deal At The Deadline

2009_03_rangerstrade.jpg Normally, seventh-place teams don’t make trades like this, but the Rangers are not a normal team. Constricted by the salary cap and in many ways built to win now, New York sent Petr Prucha, Nigel Dawes and Dmitri Kalinin to Phoenix in exchange for Derek Morris and draft picks to Toronto in exchange for Nik Antropov. Morris improves the defense and Antropov really improves the offense. Giving up on Dawes and Prucha is tough, but with their cap situation the Rangers probably would not have been able to resign them next year anyway. The Islanders traded their captain, Bill Guerin, to Pittsburgh in exchange for a conditional draft pick. It is initially a fifth-rounder, but could go as high as a third-rounder if the Penguins win a playoff round.

Young Men Turn West Village Mugging into Wig Steal

2009_03_wigs2.jpg A gang of transvestite teenagers has been arrested and charged with mugging women in the West Village. Brooklyn's Jubril "Dominic" Faggins and Jhirad "Shanese" Powell are accused of robbing women in The Archive, a prestigious apartment building on Greenwich Street. After robbing a woman there in January, they then charged $3,639 to the woman's credit cards on wigs and women's cl othes and jewelry at stores at the Fulton Mall in Brooklyn. Powell told police, "It was Destiny [another transvestite] that told me to rob the white bitch. I grabbed the bag off her and punched her while Shanese was holding her down." The Post notes that the building the group would return to for another robbery is "the onetime home to Monica Lewinsky, designer Michael Kors and actress Jennifer Connelly. "

State Assembly Set to Repeal Rockefeller Drug Laws

030409rockdrop.jpg The State Assembly is expected to vote today to repeal the mandatory sentencing laws known as the Rockefeller Drug Laws; passed in 1973, the laws require judges to sentence even minor drug offenders to extremely long prison terms. According to the Times, the Assembly’s proposal would restore judges’ discretion in sentencing lower-level drug possession crimes, enabling them to send some offenders to treatment programs instead of prison. The measure would also permit about 2,000 prisoners to apply to have their sentences reconsidered. A growing coalition has long called for the laws' repeal, but only now, with the Senate in Democratic hands for the first time since 1965, is repeal within reach. Senate Democrats are expected to debate the issue tonight, and Assembly Speaker Sheldon Silver tells the Times, "I think the stars are aligned." In a statement, the NYCLU praised the bill as an "essential first step," but criticized it for still permitting (though not requiring) "unreasonably harsh maximum sentences for low-level, non-violent drug offenses."

Manhattan DA Succession Drama

From left, Morgenthau, Castleman, Vance After Manhattan District Attorney Robert Morgenthau announced his impending retirement last week, speculation began over who he might support to be his successor—either family friend and former ADA Cyrus Vance Jr. or current deputy DA and "righthand man" Dan Castleman. Well, now the cat is nearly out of the bag: Castleman offered his resignation yesterday, apparently because Morgenthau has chosen Vance. Castleman has worked in the Manhattan DA's office for almost 30 years; Morgenthau has......

Hate Crime Murder Suspects' Friend Turns on Them

2009_02_hatecrimeperps.jpg Today's Post reveals for the first time that there was a third man in the SUV with the Keith Phoenix and Hakim Scott the night of the attack on the late Jose Sucuzhanay and his brother Romel last December in Bushwick. The paper says that the unnamed man did not participate in the attack and is now under police protection since he will testify against his friends. Brooklyn District Attorney Charles Hynes has unsealed the indictments against the two men charged with second-degree murder, manslaughter and assault—all as hate crimes. Hynes said, "The acts which we charge this morning are no less despicable because the victims Jose and Romel Sucuzhañay were not gay.” The DA says that Romel was putting a jacket around his brother on the cold December night when they were spotted by the pair of Bronx men who then allegedly beat Jose with a bottle and a bat. Both Scott and Phoenix are expected to plead not guilty to the crimes that could land them 78 years to life in prison—the maximum sentence.

Water Taxi Beach Coming to South Street Seaport, Too

030409seaport.jpg How many glorified sandboxes can one city sustain? The folks who made Water Taxi Beach in Long Island City a fratastic destination for the volleyball and burger crowd is betting on three. In addition to a second location previously announced for Governors Island, Down By the Hipster hears word that the faux-beach trilogy will be complete at the South Street Seaport this summer. Whatever your feelings about the Seaport tourist trap—to say nothing of visiting a beach where there's no swimming—it's a safe bet that recession-minded New Yorkers and visitors alike will be fine with a conveniently-located solution to their sand and beer needs. According to Eater, next week the Water Taxi Beach company will seek Community Board 1's blessing in its quest for a liquor license and general approval for a beach, restaurant and bar. Paterson Will Run When He Runs For Re-Election

2009_03_paterrun.jpg Runner's World has an interview with Governor David Paterson this month, discussing how running have given his confidence, which he probably needs these days. (The Post is in a tizzy over the photo of running-shorted Paterson in his office.) Paterson, who is on the Achilles Track Club's board and ran the '99 NYC Marathon, said, "Running gave me the chance to be athletic, and to be good at something, which I think everybody wants to have. As a teenager it was particularly frustrating; all my friends would play these sports that I couldn't play." Paterson prefers to run with a guide and for distance (he has an 11-minute mile). On how his success in running has helped his political career: "Whenever they mention in my introduction that I ran the marathon, the audience just starts cheering, and I think that it did help me to believe in myself. I never thought I'd be Lieutenant Governor, and I never thought I'd be Governor. But I will run for reelection, and I'll be running while I'm running." Related: Former Governor Spitzer, also a runner, recorded a podcast to accompany a 3-mile run at a 9-minute pace back in 2006.

Fertility Doc Won't Do Eye and Hair Gene Designing... Yet!

030409genedoc.jpg Yesterday's story about a fertility doctor's plan to help parents choose the eye and hair color of their babies triggered "a flood of calls" from would-be procreators eager for designer infants. But doctor Jeff Steinberg is still at least six months away from offering the service, and in a follow-up he tells the Daily News that for now, "We're going to limit it to people with genetic diseases because we just cannot keep up with what's going on." His institute also pulled an announcement about the controversial service from the website; the ad trumpeted: "PREDICTIVE GENOMICS TO BE AVAILABLE: Eye color, hair color, cancer tendency and more." These babies are insaaaaane! Besides offering genetic customization for parents with family histories of albinism and other disorders, Steinberg will still help parents predetermine their child's gender, a service that's already available at other clinics. But really this was all just an excuse to publish this photo of Steinberg, which might provide some clue as to the source of the good doctor's passion for genetic engineering.

A-Rod Leaves WBC for Cyst

2009_03_arodwbc.jpg Alex Rodriguez is headed to Colorado. Don’t get too excited Yankees’ fans; it’s not for a trade, but rather to get a cyst in his right hip checked out by a specialist. After playing yesterday as a member of the Dominican Republic's World Baseball Classic team, A-Rod complained of soreness in his hip and a MRI revealed the cyst. Could the Yankees, never big fans of the WBC, be using this as a way to stop A-Rod from playing in the tournament? The cyst was only part of Alex’s day as he also opened his mouth, always a mistake, and insulted Johnny Damon and Derek Jeter by stating he would like Jose Reyes to leadoff for the Yankees, "I wish (Reyes) was leading off on our team or playing on our team. That’s fun to watch." A-Rod later issued a correction to that statement (maybe he needs to trot out the family again).

Judges: No Dead Son's Sperm to Create Grandchild

2009_03_sperm.jpg A couple's desire to use their deceased son's sperm to produce a grandchild was shot down by a NY state appeals court. The New York Law Journal reports, "When Mark Speranza deposited sperm samples at Repro Lab in 1997, he gave no reason for his donation, but signed an agreement directing the tissue bank to destroy the semen in the event of his death. Six months later, he died of cancer." His parents "learned about the sperm deposit while sorting through their son's personal belongings" and paid $400/year for the storage of the sperm and lined up a surrogate mother. But when Repro refused to turn over the sperm, the parents sued. The judges ruled that giving the sperm to Speranza's parents would violate a law requiring sperm donors to be screened, "even though we recognize the joy that ignoring the regulations could bring to plaintiffs." The Speranza's lawyer is considering their options, pointing out, "There has been no case like this ever." Tenants Say Homeless Housing Program is Forcing Them Out

Courtesy Paolo Mastrangelo's Flickr. The city will spend an estimated $59 million this year to house homeless families in buildings occupied by rent-paying tenants, many of whom say their landlords are pressuring them to move out because housing the homeless is more lucrative. In a process known as "cluster-site" housing, the city pays nonprofit agencies to place homeless families in apartments and provide employment help and other social services. The homeless residents are required to sign in and out, and......

Great Kills Park Ballfields Are Radioactive

2009_02_radioact.jpg The National Parks Service has closed ballfields at Great Kills Park on Staten Island because radium was found in the soil. The Advance reports, "The startling find means that the park's five ballfields, located between Bay Terrace and Fieldway Avenue, will not be available all spring for league play." Though the "risk of significant exposure" is believed to be "very low," the NPS wants to do a secondary survey. Previously detected radioactive spots at the park have "equaled a fraction of the radiation used in a chest X-ray"; past radium was found in paints used in dental equipment, perhaps left there when Great Kills was a dump. Now, sports leagues must relocated: Some of the activities will be at Gateway's Miller Fields "while others will be played at fields provided by the city Parks Department."

NY Post: Cop Admits Partner Raped East Village Woman

The NY Post reports that a police officer has "admitted to investigators that his partner raped a drunken woman - and that he himself stood by after they escorted the defenseless victim into her East Village apartment." According to the Post's sources, Officer Franklin L. Mata, who has been with the NYPD for three years, has agreed to testify against his partner, 17-year veteran Officer Kenneth Moreno. The two cops, who were stripped of their guns and badges and placed on modified duty, had been under investigation......

Mixed Reception for Obama's Stock Tips

2009_03_cashmat.jpg Yesterday, as the stock markets faltered further, President Obama told the American public that now might just be the time to go in, "Buying stocks is a potentially good deal if you've got a long-term perspective on it," as he said his policies wouldn't be determined by "day-to-day gyrations of the stock market." The Daily News spoke to some New Yorkers to ask them what they thought of the President's suggestion: One woman said, "I'm not buying any stocks now. [My investments] are sitting in cash. I don't think we hit bottom yet," while another man was also wary, "I lost a lot of my retirement in the stock market." However, one person was bullish, "There are good stocks out there. There are fundamentally sound companies," but then he admitted, "I'm a financial adviser, so it means more business for me."

More World War I-Era Munitions Found at Jersey Shore

2009_03_munitbeach.jpg It may not feel like the time to think about the beach, but the U.S. Army Corps of Engineers has cleanup crews combing the sand of Surf City, NJ—so far, it's found over 450 "potentially explosive fuses and ordnance" (from the World War I period) since late January. The AP reports, "The corps unwittingly sucked the munitions from the sea bed and pumped them ashore as part of a beach replenishment project begun in late 2006. Beachgoers began finding them in 2007." D'oh! While some people are upset they had no idea there was a sandbag bunker nearby, one woman told NBC 10, "I don’t think they’ll explode -- they’re old and they’re rusted." Over a thousand have been found in the past two years and it's hoped the cleanup will be completed by May for this year's beach season.

Barking Pit Bull Warns Family, Neighbors of Fire

2009_03_dogb.jpg Aw: WCBS 2 reports that a family pit bull-shepherd mix named Ace saved them and their neighbors when his barking alerted them to a manhole fire. His owner Khaliq Sharif said, "I was asleep. He wouldn't stop barking. I usually know it's nothing serious when he barks, but this time he wouldn't stop." In the end, eight families—23 adults and four children—went outside to safety as the fire department responded to the fire on Lafayette Avenue in Brooklyn. And the salt, from the snow, triggered the fire; Battalion Chief Gene Marmann explained, "What happens is the snow starts to melt and that along with the salts that are put down by the Department of Sanitation attacks the wires and sets them on fire." Hooray for Ace!

Governor Paterson Hits Bottom in Marist Poll

2009_03_gopater.jpg A new Marist poll has some bad news for Governor Paterson: His approval rating has dropped 20 points in since Marist's late January poll. Marist also notes: "In fact, Governor Paterson’s approval rating is the lowest approval rating a New York State governor has received in the Marist Poll’s nearly thirty year history of statewide surveys." And even among registered Democrats, only 30% think he's doing an above average job (65% disagree—heck, even elected Democrats who think he's a nice human being are upset). Still, " 77% of New Yorkers believe he is working hard as governor, and 62% say Paterson understands the problems of New Yorkers." Marist's pollster Lee Miringoff told CityRoom, "You’re dealing with a bad economy, low scores on his handling of the budget, a messy Senate pick, a lot of TV ads about cutbacks, and a drop in his leadership numbers such that there’s a lot of erosion at the core, not just at the edges." As for hypothetical 2010 matchups, Rudy Giuliani would beat him, while Andrew Cuomo would beat Giuliani.

Developer to Let Laid-Off Renters Walk Away From Leases

2009_03_archstone.jpg The latest amenity rental developments are offering? The option to walk away from your contract without penalty if you get canned! Bloomberg News reports that Archstone, which has 13 buildings in the NYC-area, has a new initiative—the Archstone Lease Assurance Program— "open to those who sign or renew leases before March 21." Ah, there's the catch! Tenants would be given 45 days after the firing to cancel their lease. Archstone, whose East 39th St. studios are around $2,600 and one-bedrooms are around $3,300 in Chelsea, explained, "New York is one of the hardest hit markets and many people have a very real concern about the stability of their jobs. We want to give them some peace of mind in making the important decision of where to call home." Related: CitiMortgage will reduce mortgage payments for laid-off homeowners for three months.

S.I. Education Council Member Resigns Over Racist E-mail

2009_02_siedu.jpg An appointee to Staten Island's Community Education Council District 31 has stepped down after an uproar over an e-mail he forwarded. The Staten Island Advance reported that the "mock photo strip, sent Jan. 4 by Salvatore Ballarino, features cartoon-like speech balloons drawn out of McCain's mouth referencing lynching African Americans and equating African American babies with excrement... The widely forwarded email also questions black fathers' ability to support their families and states Stevie Wonder and Ray Charles are always smiling, because they did not know they were black." S.I. Borough President James Molinaro, who appointed Ballarino to the panel in 2004, apparently asked him to resign. Ballarino told the Advance yesterday, "Did anybody ever accuse of me of doing anything racist before? No. I have black people who are my friends; I work with black people; I have black people sit at my dinner table with me." And in today's Advance, he said he's still forwarding e-mails, "If I get an e-mail and I think it's funny, I'm going to send it out."

Man Takes Homeless Vacation to Help Homeless

030309homelessweek.jpg 32-year-old Yusef Ramelize has taken a week's vacation from his job as a production coordinator to dabble in homelessness, as part of an effort to raise awareness and money for homeless shelters and food banks. The experiment started on Sunday night, with Ramelize spending the night in the Union Square subway station, followed by a chair at a McDonald's, before being kicked out for sleeping. According to the Village Voice, he's been staying in touch with the non-homeless (homefull?) community through his iPhone, and friends have been bringing him food at night, though he insists none of the meals are worth more than five dollars. So far he's raised $2,785, but, naturally, one commenter on the Voice website is quick to find fault: "You've got to realize that him taking up a graciously allowed chair at a 24 hour McDonald's denies that chair to someone in need. Sure, maybe the greater good could be served in the long term, but he could be hurting folks in the present. Did he give his apartment over to a homeless person while it was unoccupied for the week?"

Cop Claims Partner Had "Consensual Sex" With Rape Accuser

The NY Post reports that the partner of the police officer accused of raping an East Village woman claims the pair had consensual sex: "Officer Franklin L. Mata is insisting that the woman willingly agreed to [have] sex with married Officer Kenneth Moreno, 41, last Dec. 7 as the young partner stood by, sources told The Post. But investigators don't buy that story, which Mata has conveyed through his lawyer, sources said." A cab driver had called 911 for help on December 7, because his fare......

Obama Urges Americans to Buy Stock, Not to Worry

030309bam.jpg The Dow slouched to its lowest point since 1997 yesterday, but President Obama says that's a good thing if you've got some money to play around with on the stock market. While answering reporters' questions today during a photo opportunity with British Prime Minister Gordon Brown, Obama took the opportunity to hand out some investment tips based on the old 'buy low, sell high' maxim: "What you're now seeing is... profit and earning ratios are starting to get to the point where buying stocks is a potentially good deal if you've got a long-term perspective on it." The President also admitted he doesn't get too upset over the "day-to-day gyrations of the stock market," because he's focused on "the long-term ability for the United States and the entire world economy to regain its footing." Comparing the market to political tracking polls, Obama told reporters, "You know, it bobs up and down day to day. And if you spend all your time worrying about that, then you're probably going to get the long-term strategy wrong." So buy stock everybody, but don't blame the vicissitudes on Obama; he has his eyes fixed on some distant spot on the horizon—inscrutable to the untrained eye—when the economy will take its finger out of the light socket and report back to work.

The $26 Commute

0309commuter.jpg If you ever see this woman on the train, offer her your seat. In their ongoing Extreme Commuter series, amNewYork follows Tameeka Henry's 2 to 5 day/week travels from Brooklyn to Dix Hills, Long Island. The 21-year-old student attends Five Towns College there, and while it's only about 30-something miles from her Brooklyn home, it takes about four hours each way. Four hours. Maybe that 3.9 GPA can be partially attributed to all of that forced study time. She "takes a dollar van, a city bus, the subway, two Long Island Rail Road trains and a Suffolk County bus to get to and from school. Sometimes she catches a ride to classes, but either way, she still has to leave her house at 6:45 a.m. to get to school on time." What's all that cost? $26. Luckily, she graduates in May. Murder suspect Dr. Mazoltuv Borukhova (top); her ex-husband, murder victim Daniel Malakov, with their daughter Michelle (bottom) Nearly a year and a half after a dentist was gunned down in a Queens playground while handing off his young daughter to his estranged wife, the prosecution has rested their case. Daniel Malakov had been embroiled in a bitter custody dispute with his wife Mazoltuv Borukhova, and eventually the Queens DA's office charged her with murder and conspiracy, saying she hired a......

Councilman: Billboard Crackdown Too Hard on Ad Industry

030309hm.jpg Councilman Bill de Blasio says that because the billboard industry is "synonymous with New York," the Buildings Department should ease up on issuing hefty fines for what he calls minor infractions. De Blasio tells the Daily News, "The fines given to one single billboard can go over $100,000, but the fines issued in the East Side crane collapses were a fraction of that. It's like the world turned upside down." The Buildings Department began cracking down on illegally installed billboards several years ago after community groups pressured the City Council to take action. A spokesman for OTR Media Group, one of the city's major billboard companies, says, "This is the same Buildings Department that should be cracking down on unsafe buildings." But department spokesman Tony Sclafani explains that "illegal signs can pose a danger to the public if not safely installed." The city is currently engaged in a legal battle with billboard companies over the City Council rules, which ad men say are too restrictive and lead to outrageous fines.

Did Alex Rodriguez pick this up from master media manipulator Madonna? With a phalanx of reporters and photographers covering his every move at World Baseball Championship training camp in Jupiter, Florida yesterday, the Yankees sluggers showed off his daddy side as his ex-wife Cynthia Rodriguez bought their two young daughters—Natasha, 4, and Ella, 10 months— for a visit. And it was unusual:"Rodriguez was the only player who visited so visibly with his children, the only player who had at least one crisis manager trolling the back fields of Roger Dean Stadium, and the only player who had to answer questions......

Sound Fix Lounge Not Really Closing

0309soundfixpiano.jpg
Sound Fix Lounge's piano
What's this? Last week locals were joking that an Urban Outfitters would soon be moving into the closing Sound Fix Lounge, but now The Brooklyn Paper reports that the Lounge isn't closing after all. After a series of "last shows" were announced, Sound Fix owner James Bradley delcares “It is my fervent hope and desire to continue the tradition of live music in Williamsburg. Our business here is fine. We have no intention of going anywhere.” Of course, there's the problem of no longer holding a liquor license (which also doesn't allow them to be a BYOB establishment), but he hopes that music fans will come to the free shows even if they can't imbibe. Why not? He did add, however, that the comedy is officially out, since “You can’t listen to bad jokes without alcohol." As for the Big Terrific crew, who never have bad jokes, they're heading over to the Cameo for their weekly comedy night.

Fertility Clinic Will Soon Offer Designer Babies

030309betterbaby.jpg Don't tell Octomom: Within six months, a fertility clinic with offices in NY and LA will begin letting parents choose the eye and hair color of their babies. Dr. Jeffrey Steinberg, who helped produce the first test-tube baby, says he's already helped thousands of parents choose their child's gender, and further manipulation of infants' genes—known in the biz as preimplantation genetic diagnosis, or PGD—is inevitable. Of course, right-to-life advocates are outraged because embryos deemed undesirable will be destroyed. And Dr. Daniel Sulmasy, director of ethics at New York Medical College, tells the Daily News, "We're crossing the line into eugenics, the theory of trying to give people enhanced characteristics—genetic engineering to make sort of the superman or superwoman." But Steinberg shrugs off such hand-wringing: "Genetic health is the wave of the future. It's already happening and it's not going to go away. It's going to expand. So if they've got major problems with it, they need to sit down and really examine their own consciences because there's nothing that's going to stop it." Steinberg concluded the interview by screwing his bionic arm into his shoulder socket and thrashing the genetically-inferior News reporter to within an inch of his life.

DC-Bound Carrion Accused of Dirty Politics Back in the Bronx

2009_03_carrion.jpg As former Bronx Borough President Adolfo Carrion leaves his old borough behind and begins his new post as director of the White House Office on Urban Policy, some controversy brews at his old office. The Daily News reported that he "pocketed thousands of dollars in campaign cash from city developers whose projects he approved or funded with taxpayers' money." While other pols such as former Bronx BP Fernando Ferrer and State Senator Israel Ruiz have defended him, neither Carrion nor anyone else in the Obama administration responded to the allegations. His most vocal critic city planner Richard Lipsky told the News, "Carrion's acted in such a perverse manner to really go out of his way to thwart community and small-business concern." A Times profile summarized his administration by saying, "The results of many of his initiatives and commissions are mixed, with some achieving their goals, some still in the planning stages and others fading away."

Madoff Wants Wife to Keep Millions in Assets, Including Apt.

Fraudulent investor Bernard Madoff thinks that even though he lost his clients' money in a multi-billion dollar Ponzi scheme, his wife should keep some spoils! Well, Madoff's lawyers claim that the money, which includes bonds, cash and the couple's $7 million apartment on East 64th Street, is "unrelated to the alleged Madoff fraud" and simply belong to Ruth Madoff. Ruth Madoff, who hasn't been charged with any crime, is footing her husband's bail so he can remain in their fancy penthouse (floorplan) during house......

Facebook Bullying Lawsuit Could Net $3 Million

030309nelson.jpg A freshman at SUNY Albany is suing four former Long Island high school classmates, their parents and Facebook for $3 million for humiliating her in a password-protected page on the social-networking site. Denise Finkel, who graduated from Oceanside High School last year, filed the lawsuit in State Supreme Court in Manhattan, accusing the former classmates of holding her up to "public hatred, ridicule and disgrace" in a private Facebook forum. Though the nasty comments did not identify Finkel by name, her attorney Mark Altschul insists everyone knew exactly who the bullies were talking about when they gossiped about an unidentified teen who supposedly had AIDS and a penchant for bestiality. Altschul tells Newsday, "She had a very difficult time in high school." If Finkel wins, a class-action lawsuit by everyone who ever attended high school could cost the Internet trillions.

Sad Guys on Trading Floors Hope for Better Day

Photograph of specialist Michael Sollitto on the floor of the New York Stock Exchange yesterday by Richard Drew/AP The Dow Jones Industrial Average opened higher today, after the Dow, S&P; 500 and Nasdaq all fell 4% yesterday. The NY Times explained this morning's activity, "Wall Street opened modestly higher Tuesday, a day after a rout in global stocks helped drive indexes down to 1996 levels." One thing that's helping today: The Federal Reserve announced the launch of the......

Park Slope Reporter Starts Times Blog in Fort Greene

030309weblogs.jpg The Times has begun experimenting with a niche neighborhood blog platform, starting with a website about Fort Greene and Clinton Hill in Brooklyn. If it works, perhaps Brownsville is next? Edited by Andy Newman, a Times reporter who resides in Park Slope (but just eight blocks from Fort Greene!), the blog has burst out of the gate with posts about sledding, kids who couldn't get into a movie, and the ongoing struggle to save Broken Angel. Newman introduced the site, called The Local, with a reminder to readers that "is an infant, unformed. With your care and feeding it can grow into a self-sustaining adult." So surely commenters welcomed this fragile newcomer with the tenderness it deserves? Ah, welcome to our world, Newman: "Oh, thank you so much for helping to continue the gentrification of my neighborhood by promoting it as the new cool local place for (white) people who read the NYT to be! Make sure to post lots of pictures of people eating in cafes and drinking coffee and riding their bikes to and from the farmer's market! I can’t wait to read what the hipsters love and hate about this neighborhood!" One day old and The Local already has their own "Ides of March." (See also: Jersey.)

East River Toll Plan Outcry Prompts MTA Finance Audit

Photograph of the Manhattan Bridge through the Brooklyn Bridge by wallyg on Flickr So much for the State Legislature moving forward on a plan to introduce $2 tolls on currently free East River and Harlem River bridges—opposition from State Senators (from even within his own Democratic party as well as other Democratic state and city officials) has forced State Senate Majority Leader Malcolm Smith's hand into delaying any sort of decision by demanding an audit of the MTA's finances.......

For Big Apt. Complexes, Foreclosure a Silver Lining?

2009_03_riverton.jpg There may be a small bit of comfort for residents who live in big apartment complexes on the brink of possible foreclosure in the NY Times. Some experts think the tenants Riverton Houses, Stuyvesant Town-Peter Cooper Village, and Savoy Park—where owners bet wrong about buying massive developments to make big returns—will be okay. For instance, regarding Riverton where foreclosure proceedings against the owner have begun, the Times reports, "If the lender sells the complex, or reaches a new agreement with the current landlord, the tenants at Riverton Houses would still enjoy the benefit of newly refurbished lobbies and elevators, as well as extensive landscaping." The downside? Riverton's ownership contests foreclosure and the buildings—and surrounding area—"languish" during a long court battle.

After yesterday's snow storm, be very careful whether you're walking or driving—the roads are slick and icy. As for the snow fall, WCBS 2 reports that Central Park saw 8" (Long Island—14.5"— and the Jersey shore—13.5"— saw higher amounts of accumulation). Weather-wise, bundle up! According to 1010 WINS, "The AccuWeather forecast calls for a high temperature of 24 degrees today, but it will drop again tonight to a low of 13 degrees. Tomorrow expect a high of only 32 degrees with a slight warm-up in the afternoon." And the windchill will make it feel much closer to......

NYPD Sued For Not Allowing Cop to Protect and Serve (Jesus)

2009_03_nypdjesus.jpg A 22-year vet is suing the NYPD claiming the Department was guilty of religious persecution when they took his gun and badge away from him. And what cultish fringe deity are the police being intolerant of now? You guessed it—Christianity. Lieutenant Dominic Maglione, a practicing evangelist, says that his intense religious beliefs are what got him kicked off the force. NYPD pension papers say the 44-year-old Maglione lost 40 pounds in six months by fasting and was prescribed an anti-psychotic drug. He also, reportedly, urinated on himself and "saw a demon at 1 Police Plaza." According to a 2004 Daily News article, Maglione is a member of the group Police Officers for Christ, who regularly recruit young officers with tales of the Good News. On the relationship between his faith and his duties, he said, "You have more patience with people. I think it makes you more effective." Another member of the group told the News back then, "We feel God has ordained us to be police officers. God and policing is nothing new. They [cops] all serve God - whether they know it or not."

Bloomberg Praises Sanitation Dept's "Amazing" Snow Response

2009_03_mayorbsno.jpg Mayor Bloomberg reassured the city would have clearer roads—100,000 tons of salt! 1,400 plows!—after today's winter storm, pointing out, "New York City has nearly 6,000 miles of streets. So to plow all our streets, just think about this, it's like plowing form here to Los Angeles, and back. It is really quite an amazing job that the sanitations workers have to do and that they do do." (If your street hasn't been plowed, call 311.) Schools Chancellor Joel Klein explained the rare snow day, "A lot of those streets weren't passable. We have kids, young kids, walking to schools. We transport 150,000 or so students on yellow buses. With the wind and the snow blowing and the traffic issues that we were hearing about, we thought this was the right decision. As I said, it's never the preferred decision, but the right decision." And the Mayor had a message for the school kids: "For those kids who were hoping for two consecutive snow days in a row, things can always change, but my suggestion is to do your homework."

Stock Markets Sink

Photograph of specialist Peter Mazza at the NYSE by Richard Drew/AP The three U.S. stock indices fell 4% or more today: Nasdaq was down 3.99%, the S&P; 500 dropped 4.66% (closing at 700.82) and the Dow Jones lost 299 points, closing at 6,763 points, its lowest level since 1997. A strategist told the NY Times "It’s pretty despondent everywhere. O.K., there are signs that some of the leading indicators have stabilized to some extent, but it’s at a very, very......

Robotrain Putting Fear in L Train Conducters

030209t4.jpg It's not just paranoid Luddites who fear the sinister agenda of the new robotic L trains; train conductors, whom the MTA tried unsuccessfully to replace with robots, are still worried their jobs are in jeopardy. One "wild-eyed, grey-haired" conductor recently told Infrastructurist what he thinks of his new robot co-worker: "The last thing the public wants is to be stuck underground, getting mugged, with a robot conductor. People need people. I can call the cops, I can intervene. Last month I had to break up a knife fight. Well, I didn’t so much break it up but I called it in. A robot can’t do that." Another conductor struck a more fearful tone, "They could easily replace humans but don’t put my name next to it because I’ll be the first to lose my job to the robots. I’m definitely scared that could happen." Better hope the robots weren't reading your lips when you said that, foolish human! Sounds like someone better invest in some robot insurance.

Schumer, Wall Street's Go-To Senator, is Now Pro-Regulation

2009_03_schum.jpg Well, well, well, look how the times have changed. Senator Charles Schumer, who famously championed Wall Street business to the point of protecting the industry, as the NY Times put it last winter, "from government oversight and tougher rules" (saving Wall Street billions), now thinks the financial services industry, um, needs regulating. This morning at a Crain's Business event, Schumer explained that, per Crain's, "more aggressive regulation is needed in order to ensure New York maintains its standing as the world’s capital of finance... because jittery investors around the world are looking for places where they can trust that tough regulators will protect their interests." He also said that a regulatory reform bill will be sent to President Obama by April.

Customs Agents Will Seize That Drug-Filled Dead Cat

Heroin disguised as chocolate bars The TSA tends to get a bad rap and often ends up the recipient of frequent gripes, especially in the city whose airports lead to three-quarters of takeoff delays nationwide. HSBC To Cut Over 6,000 Jobs, Reports Major Profit Tumble

030209hsbc.jpg HSBC's net profits in 2008 were down a breathtaking 70% from 2007, dropping from $19.13 to $5.73 billion, the London-based bank announced today. During a conference call with reporters, CEO Niall Booker said the bank will scale back its U.S. consumer-lending operations, closing its HSBC Finance Corp. and Beneficial brands, causing a loss of 6,100 jobs. (According to Crain's, there are two locations of each in NYC.) The retail-bank-branch and credit card business in the U.S. will remain intact, but HSBC's 2003 expansion in the consumer loan market is being written off as an epic fail. In a statement, HSBC said, "Management believes it will take years before property values return to the levels seen prior to the decline and, as such, has concluded that recovery in the sub-prime mortgage lending business is uncertain and the industry is unlikely to stabilize for a number of years." Executives also confirmed today that HSBC, which is Europe's biggest bank, lost about $1 billion to Bernard Madoff's fraud!

Tapes Show Cops, Accused of Raping East Village Woman, Returning to Her Building Twice

A neighborhood bar's surveillance camera captured footage of two cops, accused of raping an East Village resident, returning to the woman's apartment two times after their first visit. Yesterday, the Daily News and Post reported that police officers, who were called by a cab driver to help the woman—who apparently vomited in the cab—get home on December 7, were stripped of their guns and badges and were put on modified duty. While the two cops have not been identified, the Post reports, "Several sources identified......

MLB Questions A-Rod as He Leaves Yanks for a Few Weeks

2009_01_arodfr.jpg After postponing his meeting with MLB officials yesterday so that he could play in one last spring training game before joining the Dominican team in the World Baseball Classic, Alex Rodriguez did eventually get together with league brass and was described as "cooperative" by the commissioner's office. As expected, the two hour meeting centered around two men with close ties to A-Rod, cousin Yuri Sucurt and trainer Angel Presinal, as well as inquiries as to just where Rodriguez obtained steroids from. Both the Yankees and the slugger seem to think that the change of scenery for the WBC for a few weeks will be beneficial to all parties. Rodriguez joked that his leaving means that "we're going to give (media relations director) Jason Zillo a three-week vacation. He's the happiest guy here. I expect him to be fresh when I get back." As for the scandalized slugger, manager Joe Girardi said, "I see him more relaxed every day...The first couple days, you know, you could tell it was weighing heavily on his mind...I think he's done really well."

Cops, FDNY Park Wherever They Want in Downtown Brooklyn

030209copbikeblock.jpg Police and firefighters park their vehicles at expired meters and in the middle of bike lanes all over town, but in Brooklyn the violations are particularly rampant, prompting outrage on blogs like Brownstoner. Now the Daily News has chimed in, confirming a "slew of trouble spots" where unmarked vehicles belonging to cops, firefighters and other government workers park illegally with impunity. On Jay Street reporters found 18 cars parked at expired meters; most "appeared" to be owned by cops or firefighters. Over on Adams Street, more than 20 cars were parked in a "No Standing Anytime" zone last week, displaying various permits including the NYPD and the court officers union. Also on Adams, a Chevy Blazer with a police department placard was parked in the bike lane. As anyone cyclist knows, cops love bike lane parking, and other motorists routinely block bike lanes with impunity. A spokesman for Mayor Bloomberg reminded the News that the city has slashed the number of placards issued to government workers by 54%. But Michael Burke of the Downtown Brooklyn Partnership says parking laws need to be enforced because "it adds to a sense of lawlessness in the community."

Reverend Billy to Become Mayor Billy?

Watch out Bloomberg! Yesterday Reverend Billy launched his campaign for Mayor of New York City, sending out a letter declaring "It's time for all of us to rise up and reclaim our wonderful city from Starbucks and the other awful chain stores, from real estate speculators and the predators on Wall Street. Together, we'll give New York back to the people who love it." Hallelujah! Nominated by the Green Party last week, he made his announcement in person in Union Square yesterday, donning an electric blue suit....

GOP Accused of Taking Kickbacks as Senate Majority

2009_03_malcolm.jpg The new State Senate's new Democratic majority is preparing to accuse their Republican predecessors of renting out almost $8 million in unneeded state office space from a major campaign contributor. Republicans expanded a space supposedly needed Senate's "research" staff, which has been linked to the GOP's political operations through a real estate company which had donated almost $250,000 to Republicans in the Senate over the last ten years. The accusations come from a memo by an aide to new Majority Leader Malcolm Smith which says, "(This leasing) appears to raise serious legal and ethical questions as to whether campaign contributions were explicitly made or solicited in exchange for the unnecessary expansion of lease space housing Senate employees." But a former GOP Senate secretary and close friend of Joe Bruno says, "(Expansion came when) we closed two other locations that we had...We consolidated those spaces over a period of five years, and saved the state money." But what about the Brunomobile?

Crazy Eddie Electronics Stores Making Insane Comeback

A Brooklyn entrepreneur has purchased the trademark for Crazy Eddie, a Northeast electronics retail chain famous in the '80s for its irritating, low-budget ads, which featured DJ Jerry Carroll hyperventilating about the store's "insane" sales. (Watch below.) The company went bankrupt in 1989 after the U.S. Attorney in New Jersey busted brothers Eddie Antar and his nephew Sam for fraudulent business practices. Now one Jack Gemal has bought the trademark from Trident Growth Fund LP, which tried to auction it for $800,000 on eBay back......

Dow Falls Under 7,000 for First Time Since 1997

The Dow Jones Industrial Average is currently at 6,833, after falling over 200 points, making its first sub-7,000 visit since 1997. A large part of the drop is due to the government's additional bailout funds for AIG, whose CEO wouldn't rule out another bailout. Elliot Wave International's Robert Prechter (whose company predicted the 1987 stock market crash) told Bloomberg Radio, "The bear market has only begun. I don’t see the clear weather yet," while UBS director of floor operations Art Cashin told CNBC, "You're beginning to hear people get a little more despondent as this continues to sell day after day. There's a growing sense of frustration about not quite being in control here — Not knowing where the next shoe in Imelda Marcos's shoe closet is."

NY Businesses Eye Greener Pastures in NJ, CT

2009_02_tristate.jpg NYC businesses aren't the only ones threatening to leave for NJ—it turns out businesses all over the Empire State are threatening to leave for NJ and Connecticut! The NY Times looks at how NY is "Vulnerable to Poaching in Recession". While NJ and CT governments are offering nice deals, the Times adds, "some officials and business executives say the Paterson administration, reeling from a number of recent missteps, has been too poorly managed to respond effectively." One example: Pepsi, whose headquarters are in Purchase, was hoping that the Paterson administration wouldn't expand the bottle deposit requirements for non-carbonated drinks...only for Governor Paterson to expand the program and put a tax on non-diet sodas: "Now Pepsi is weighing a searing response: moving the headquarters of the Pepsi Bottling Group and more than 1,000 jobs, from Somers, in Westchester County, to Connecticut, which has been dangling a roughly $30 million incentive package."

Battle of the Weather Legends

Snowy Cervantes by JR from Brooklyn on Flickr. It was no contest. In a battle of weather legends Staten Island Chuck's month old prediction of an early spring was thoroughly pummeled by March coming in like a lion last night. Snowfall amounts generally ranged from 5-8 inches across the city this morning. More than a foot fell on eastern Long Island. The city should see another couple of inches of snow by this afternoon......

Hate Crime Murder Suspect "Never Expected Anyone to Die"

Suspect Keith Phoenix, left; murder victim Jose Sucuzhanay, right Keith Phoenix, who was charged with killing an Ecuadorian immigrant last December, has given an interview from Rikers Island to the Daily News. He told the paper, "I'm not a killer. I never expected anyone to die." Police says that Phoenix and his friend Haikim Scott allegedly beat Jose Sucuzhanay to death with a baseball bat, after seeing Sucuzhanay, a real estate broker in Brooklyn, and his brother arm-in-arm on......

WhaTF: BMI and ASCAP Sue Cafe Wha?

php95zMzfAM.jpg
Times they are a changin'. Cafe Wha?, the Macdougal Street club that put many legends (including Dylan, Springsteen, Hendrix, even Bill Cosby) on the map by giving them a start on their stage, is being sued for playing one of the musician's songs without a license. The Post is reporting that the venue is "named in a pair of copyright-infringement suits charging unlicensed performances of Billy Roberts' 'Hey Joe' and more than a dozen other hits." BMI and ASCAP (who busted Jay Z's 40/40 Club in 2007) are behind the suits, which could yield up to $30,000 per claim (of which there are 16 total). But should they turn a blind eye to the legendary club that's managed to keep its doors open in the now high-rent Greenwich Village?

MoMA Severs Ties with HappyCorp

phpuahpvEAM.jpg You would think MoMA would love an edgy ad campaign that draws even more attention to the museum than expected. However, following Doug Jaeger of HappyCorp's alleged involvement with Poster Boy's crew to alter their installation at the Atlantic/Pacific subway stop, they've severed all ties with the company (who created the campaign). Kim Mitchell at MoMA tells us, "No one at The Museum of Modern Art had any role in or prior knowledge of the acts of vandalism committed against posters in the Museum's installation in the Atlantic Avenue subway station. On February 27 we ended all work to be done by Doug Jaeger and thehappycorpglobal on this project and all others, and have completely severed our relationship with the company. The Museum deplores any kind of vandalism and is profoundly distressed that the posters were defaced." Prudes. No word yet on if HappyCorp has severed any ties with Poster Boy. To be continued!?

New York Getting Porkilicious Share of Federal Budget

030209schumer.jpg New York State will be receiving some $750 million from Washington in earmarks for various projects throughout the state, and Senator Chuck Schumer, as usual, is getting most of the credit. According to the watchdog group Taxpayers for Common Sense, the $410 billion federal budget contains approximately $7.7 billion in disclosed earmarks for various politicians' pet projects; 230 of those earmarks have New York pols' names attached. Locally, these include $381,000 for music education programs at Jazz at Lincoln Center, $277 million for the Second Avenue subway, and $210 million to connect the Long Island Rail Road to Grand Central. Watchdog groups argue that many of these special projects—such as $950,000 for a pedestrian bridge in Poughkeepsie (a bridge in nowhere?)—win funding based on each politicians' power, not because of the projects' merits. But Schumer spokesman Brian Fallon tells the Daily News, "If left to them, Washington bureaucrats wouldn't give New York its fair share."

No Snow Day For the Dow

2009_02_wallst.jpg There may be a snow storm outside, but that doesn't mean Wall Street can avoid the bad news: Stock futures are falling on news of the additional $30 billion AIG secured from the federal government. Stocks fell in Asian and have dropped in Europe—and Warren Buffett's words that the U.S. economy is in shambles ain't helping either. A London portfolio manager told Bloomberg News, "Things are getting worse. The economy is still deteriorating and bad debts are still going to appear." The Dow is expected to drop under 7,000 points today, though it's unclear where it'll end up.

Two Fatal Car Crashes in Long Island

2009_02_snowac.jpg Long Island authorities believe that the weather may have played a role in two fatal car crashes yesterday. Newsday reports that around 9 a.m., Ryan Charles, 23, crashed his minivan into a tree (right) in Medford. He was pronounced dead at the hospital and police said "there were slippery road conditions. And an icy road caused a two-car crash: A Toyota four-door sedan was broadsided by a van in Greenlawn. The Toyota's driver, Jose Fuentes, was pronounced dead at the hospital, while the van's driver, Lois Molloy, had a foot injury and her daughter was not injured, according to Newsday.

Snow Day or Snow Job

Meteorologists warned that snow starting yesterday would dump up to a foot of snow (maybe 14 inches on Long Island!) by this morning, but will we see that much? National Weather Service meterologist John Murray said that the winter storm warning is in effect till 6 p.m. tonight, with wind gusts up to 35 mph, "It's a classic Nor'easter, that's for sure." WCBS 2 meteorologist Elise Finch (pictured) said, "By about 2 a.m., that's when we're expecting to see the heaviest snow. We could......

Missing Teacher Goes Back to Find Where She Started

Last September, friends of a 23-year-old woman became worried when she had been missing for several days. However, Hannah Upp, a teacher at the Thurgood Marshall Academy and Pace graduate student, was spotted at the Apple Store on Fifth Avenue—she spoke to a fellow Pace student—raising questions about whether she wanted to be found. She was ultimately spotted in the water—and alive— off Staten Island two and a half weeks after she was last seen. Upp has said little since re-emerging—except to explain she suffered......

Brooklyn Bridge to Go on Hiatus For First Time in 20 Years

2009_03_bridgetraffic.jpg Maintenance on the Brooklyn Bridge beginning in the summer of 2010 will close it off to Manhattan-bound traffic on weekends for six months. The bridge's arches and steel-wire will be freshly painted and repairs will be made on corroded and crumbling approaches, ramps and anchorages. The entire project will take over four years, beginning this June when one lane will be shut down during off-peak hours. The project will cost somewhere between $200 and $500 million, the first of its kind since the '80s and one that has been delayed for years due to budgetary constraints. A 2006 report deemed the bridge in poor but structurally sound condition, something that came even more into focus after the structural collapse of a Minneapolis bridge in 2007 led to 13 deaths. The DOT tells the Post that federal funding will be involved with the project.

New Subway Hero Takes Different 'PATH' to Righteousness

2009_03_kelsor.jpg Watch out, Wes Autrey. There's a new subway hero in town—and he's not afraid to go under the Hudson River. Terrence Kelsor, a PATH security guard, spotted a drunk man stumble onto the tracks of the Christopher Street station late Friday night and was able to lift him to safety moments before a train arrived. The unknown victim stumbled back into the night after being rescued. Kelsor describes him as so intoxicated that "you could smell it coming out of his pores." The News says that the man who fell was over 250 pounds, while Kelsor only checks in at 5'7" and 170 pounds. The Newark man told the paper, "Somehow, I had superhuman strength. It was by the grace of God. It could have been his life. It could have been mine. Both our lives were in jeopardy." If there was any doubt to his bravery, even an Iraq vet confirms it. A witness from the Army Corps of Engineers said, "He didn't hesitate. I hesitated, and I just got back from Iraq."

Photograph of Ed Koch, taken in 2001, by zsumoz on Flickr Former mayor Ed Koch is nothing but prepared: The NY Times and NY Post report how the outgoing octogenarian has his tombstone ready and engraved. He already has a plot at Trinity Church Cemetery in Washington Heights and the tombstone will read: "EDWARD I. KOCH Mayor of the City of New York 1978-1989," plus slain Wall Street Journal reporter Daniel Pearl's words before he died, "My father......

Foot of Snow Expected to Hit NYC Overnight

2009_03_snowmap.jpg Before you get to uncork your first "Spring Breaaaaak!" scream, the arrival of March appears to be playing one its cruel (or delightful) tricks on us as it comes in like a snow leopard with a storm that looks like it may be the heaviest accumulation we've received all winter. The National Weather Service has issued a winter storm warning in effect for twenty-four hours beginning at 6 p.m. this evening. They are calling for six to ten inches of snow to have fallen by tomorrow, coming down heavy at times throughout the night. (Some reports are calling for as much as 13 inches to hit Manhattan by morning.) Temperatures are expected to be lower than normal for the next few days, so the white blanket might just stick around for a while.

NYPD Cops Investigated in East Village Rape Accusation

The NYPD has stripped two police officers of their badges and guns and put on modified duty as they investigate an accusation that a police officer raped an East Village resident. The Daily News reports, "The officer and his partner came to the woman after a cab driver called 911 on Dec. 7, telling cops she had vomited in his car and couldn't find cab fare." The officers apparently escorted the woman home. Surveillance videos from the apartment building reportedly show "the two cops helping the......

Tea Party Protest Over Federal Stimulus Spending

2009_02_debt.jpg Some people irritated by the government's intervention in the economic crisis gathered at City Hall yesterday to throw a Taxpayer Tea Party. The NY Post reports that organizer Kellen Guida was "inspired to set up the rally after watching CNBC anchor Rick Santelli's scalding rebuke on Feb. 19 of Obama's $275 billion housing bailout last Wednesday." Guida said, "I know my basic economics, and know the stimulus package doesn't work. [Obama] is going to add more to the federal deficit in 20 months than Bush did in eight years." Hmm, maybe Guida doesn't believe in Keynesian economics! Daily Kos contributor stef went to the protest: "It was underwhelming, to say the least... They announced that the new battle would be not Democrats vs. Republicans but Capitalists vs. Socialists. They called for Revolution. They exhorted everyone to send tea bags to 'Nazi Pelosi.' Obama was variously described as a Socialist and a Marxist. They wore stickers that read JOKE with an Obama logo for the O. Most of them arrived via public transit."

Murder Suspect Claims Self-Defense, Not Gay Bashing

Suspect Keith Phoenix, left; murder victim Jose Sucuzhanay, right The second man arrested in the hate crime killing of an Ecuadorian immigrant is presenting a very different story of the fight that led to the death of Jose Sucuzhaynay. The accusations have been that the two murder suspects, Keith Phoenix and Hakim Scott, targeted the late Jose Sucuzhaynay and his brother because the pair of brothers appeared to be gay. Instead, Phoenix says that one of the Sucuzhaynays provoked the fight......

Two Queens Hospitals to Close Tomorrow

2009_02_qnshosp.jpg St. John's Queens and Mary Immaculate Hospitals stopped accepting patients last night and will close their doors tomorrow. The hospital's operator, Caritas, filed for bankruptcy; Caritas had asked for a $36 million bailout in early February, but the state health department refused, pointing out that it lent $50 million to Caritas. Over 2,500 people are losing their jobs and NY1 spoke to an ER doctor who said, "Things came so fast that I didn't have a chance to look for another job. I don't know. Maybe go home and stop by unemployment - that's the plan we have now." Another told WABC 7, "A patient called crying on the phone learning that the hospital was closing tonight. I didn't know what to tell her."

A-Rod Would Rather Play Ball with Yanks Than MLB Brass

Alex Rodriguez is hoping that he can take a rain check on his scheduled meeting today with MLB officials so that he can play in his Grapefruit League game with the Yankees. The slugger was expected to be on the team bus this morning to Sarasota to play the Reds in what will be his final spring training game with the team before he breaks to participate in the World Baseball Classic. MLB investigators were supposed to question A-Rod in Tampa to discuss his admitted......

Idling Car Fumes Kill Queens Man

2009_02_fumes.jpg According to the AP, police say that a Queens man was killed when "fumes from an unoccupied vehicle that was idling in a garage seeped into a bedroom." Apparently the NYPD went to a home on 141st Street last night around 10:40 p.m. and "found a couple unconscious and unresponsive." The man, 79, was pronounced dead at the scene while a 69-year-old woman is in serious but stable condition. The police, who are investigating, don't suspect any criminality. Last Night's Action: Hockey Good/Basketball Bad

Photo COurtesy AP/Frank Franklin II Rangers 6 Colorado 1: Can we credit the new coach for this offensive explosion or should we just write this off as what should happen when a lousy team hits the road? After all, Colorado didn’t look very good against the Devils the other night. Yes, Colorado is bad, but the Rangers showed a different side Saturday night. They kept the pressure on and converted the chances they got. They took a......
