Local Citizenship

L’attenzione per il controllo delle procedure di iscrizione anagrafica manifestata da numerosi sindaci negli ultimi anni è strettamente collegata all’enfasi crescente posta sul tema della sicurezza urbana. I provvedimenti volti a restringere i requisiti per il riconoscimento della residenza, infatti, sono stati spesso motivati, più o meno esplicitamente, con la necessità di tutelare l’incolumità dei cittadini e il pubblico decoro.
Il legame così istituito tra controllo locale della residenza e sicurezza pone però alcune domande rilevanti riguardo alle iniziative dei sindaci. Quale tipo di sicurezza si vuole veramente garantire? Quali categorie di cittadini si intende effettivamente proteggere? Inoltre, chi decide a livello locale ha davvero autorità in materia di residenza? Le procedure seguite sono visibili e pubbliche?
Il presente contributo cercherà di fornire una risposta a queste domande articolandosi in cinque paragrafi. Il primo affronterà il rapporto tra sicurezza e gestione delle migrazioni. Il secondo avrà come oggetto la nozione di sicurezza urbana e la sua diffusione nell’ambito delle politiche italiane. Nel terzo sarà approfondito il ruolo dei sindaci nella gestione della sicurezza, con particolare attenzione ai nuovi poteri di ordinanza. Il quarto sarà incentrato sui provvedimenti e sulle prassi in materia di iscrizione anagrafica tramite cui gli amministratori locali costruiscono confini che separano la popolazione locale in due gruppi: i residenti “legittimi” e i residenti “illegittimi” (seppur presenti). Nel quinto paragrafo saranno evidenziate le ambiguità delle iniziative volte a garantire la sicurezza mediante il controllo della residenza.

Shadow policing. Discretionary and opaque powers within the management of security in contemporary Italy.

During the last years, security has increasingly become an issue within the Italian context: actions and policies aimed at protecting the population from the “supposed” threat represented by migrato-ry flows have increased, also at the local level; meanwhile, the grow-ing social conflict due to the even more sharp economic crisis has been considered by the political authorities mostly as a problem of public order. More in details, the management of security has taken place within an emergency frame: urgency has been claimed as a pretext to use administrative means and practices strongly pivoted on the idea of exception more than on the rule of law. This way, na-tional and local authorities as well as police forces have triggered mechanisms and gave rise to processes barely visible and under-standable even if not, in some cases, secret.
This essay aims at analysing these mechanisms and processes, so as to cast light on some critical and structural aspects of the man-agement of security. To this end, the essay focuses the attention, on one hand, on public security, and more specifically on the ways with which police forces maintain public order, and on the other hand on urban security, namely on the strategies through which some Munici-palities try to manage independently the procedures of enrolment into the registry office, with the purpose of selecting people who de-serve to live within their territory.
The two spheres of security here described are without doubt quite different one from each other: policing protest is a specific task of the police force and is characterized by a low level of legal formalisation, whereas the procedures of enrollement into the regis-try office are committed to local governments, involving only indi-rectly the police, and are ruled by clear and precise laws. Yet, despite their differences, both these two spheres show the same trait: secu-rity is often used as a pretext for exercising a discretionary and opaque power. This way, they unveil a deep ambiguity of the Italian demo-cratic institutions.

Wholesale clearance and eviction that typify China’s urban development have often resulted in discontents among urban residents, giving rise to what critics refer to as property rights activism. This paper is an attempt to critically revisit the existing debates on the property rights activism in China. The paper refers to the perspective of the “right to the city” to examine whose rights count in China’s urban development contexts and proposes a cross class alliance that engages both migrants and local citizens. The alliance itself will have substantial political implications, overcoming the limited level of rights awareness that mainly rests on distributional justice in China. The discussions are supported by an analysis of empirical data from the author’s field research in Guangzhou, which examines how local and non-local (migrant) residents view nail-households resisting demolition and forced eviction.

During the last years, some mayors have issued orders aimed at narrowing the access to legal domicile. These orders introduce further obligations than those provided by national laws in order to achieve the registration into the Municipal Registry Office: an income upper than a certain threshold; an accommodation in keeping with specific standard of healthiness; the possibility to demonstrate not to be «socially dangerous». The status of legally domiciled is highly important inasmuch it is connected to the access to some rights. For this reason, denying the possibility of register a legal domicile is the same as putting a barrier to these rights. Although the orders are illegitimate - legal domicile, indeed, is a matter of national competence, despite the fact that registration practices are attributed to the local authorities - the strategy of exclusion based on the denial of the registration may however be effective. More specifically, the mayor's orders work as mechanisms of migration control, since they try to «filter» the people who live within the territory of a town separating the «good» local citizens - the formal legally domiciled - from the «bad» local citizens - those to whom the legal domicile is denied - and try to exclude these latter from the access to social rights. Therefore, as we will show in the article, the local strategies of exclusion based on the denial of legal domicile contribute to strengthen a system of civic stratification.

Negli ultimi anni, numerose amministrazioni locali hanno fatto ricorso allo strumento dell’ordinanza comunale nel tentativo di regolare in maniera autonoma l’iscrizione anagrafica. Le ordinanze emanate in materia di residenza contengono requisiti particolarmente restrittivi per l’inserimento nei registri dell’anagrafe, e rispondono a una logica ben precisa: separare, all’interno della popolazione effettivamente presente nel territorio comunale, i soggetti desiderati da quelli indesiderati mediante l’attribuzione – o, viceversa, la mancata attribuzione – dello status di residente in senso legale.
La selezione tentata dagli amministratori locali impedisce l’espletamento di un dovere – dichiarare alle autorità locali la propria presenza stabile nel territorio comunale – e comporta la negazione di un diritto, riconosciuto dalle leggi statali a tutti coloro che dimorano abitualmente in un dato comune, siano essi cittadini italiani, cittadini comunitari in possesso di alcuni requisiti o stranieri extracomunitari regolarmente presenti nel territorio statale. Le iniziative dei sindaci, più in dettaglio, ostacolano l’accesso a numerosi diritti fondamentali, dal momento che la residenza è l’unico canale tramite cui questi diritti sono concretamente esigibili, sia da parte degli italiani sia da parte dei non italiani.
La residenza, dunque, pur caratterizzandosi, almeno potenzialmente, come uno status in grado di appianare le differenze tra individui appartenenti a comunità statali diverse, può facilmente trasformarsi in uno strumento che, al contrario, produce un allargamento del divario tra cittadini e non cittadini. Ciò accade, ad esempio, quando le ordinanze introducono requisiti più restrittivi di quelli contenuti nella normativa statale allo scopo di impedire l’iscrizione a stranieri extracomunitari e a cittadini comunitari: sebbene questi requisiti siano formalmente illegittimi – in materia di anagrafe, infatti, il sindaco agisce come ufficiale del governo, ed è tenuto quindi ad applicare la legge senza apportarvi modifiche –, essi possono rivelarsi strumenti di esclusione piuttosto efficaci.
I provvedimenti che hanno come oggetto le procedure di iscrizione anagrafica, pertanto, sono in grado di interrompere l’azione equalizzante esercitata dalla residenza, ristabilendo le differenze tra cittadini e non cittadini e, in alcuni casi, istituendo differenze anche tra gli stessi cittadini. Le ordinanze, dunque, agiscono come dispositivi in grado di favorire la costruzione dell’alterità, assumendo, direttamente o indirettamente, un carattere performativo. Le modalità con cui i diversi gruppi di individui sono definiti linguisticamente e giuridicamente e le articolazioni discorsive mediante cui queste definizioni sono effettuate favoriscono infatti la costruzione di categorie differenti.

This article aims at analysing the role of small and middle municipalities within immigrant’s policies. To this end, it resorts on the findings of a research project focused on the mechanisms of exclusion from municipal registration but also concerned with other exclusionary strategies and tools. The article studies the visions of local community contained in the discourses, policies and administrative practices of a set of local governments mostly located in the North of Italy. Several research strategies and methods are used here: analysis of political discourses, document analysis, interviews and qualitative telephone conversations, quantitative data collected from municipalities.

In contemporary Italy, security (sicurezza) has become a relevant issue with regard to the fields of immigration and urban governance. Progressively, the idea that keeping the population safe means increasing surveillance on a wide set of social features and behaviours has gained increasing credibility. While the central government has enacted laws and decrees that have broadened mayors’ powers concerning urban security (sicurezza urbana), several local authorities have issued orders and other kinds of administrative provisions through which they have tried to regulate many aspects of social life. Often, these municipal authorities have overstepped their powers, de facto exercising responsibilities that are the de jure prerogative of the central government.
Acting in such a way, many local governments have also made it evident that there are two types of identification, which are incompatible with each other. On the one hand, identifying means knowing exactly whom the people are who live within a given part of Italian territory and what their characteristics are. On the other hand, it means individuating those categories of people that have to be considered dangerous or otherwise undesired.
So, the presence of these two incompatible types of identification that
emerge from the actions of the Italian local authorities confirms the
ambivalence of this notion: the act of registering is a device for monitoring
and, at the same time, registration is a tool for the actual enjoyment of
rights. But this presence also adds some new elements to the scientific
debate, given that in the Italian contexts registration is often used as a
means for excluding people from having access to rights, even at the cost
of impeding the monitoring activities.
From this perspective, the Italian case shows how the two types of identification correspond to two diverse kinds of social control: the first targets people as individuals, looking for information about each and every person, while the second focuses on groups and aims at selecting categories of undesired individuals, while having no interest in identifying the single persons who belong to such groups. Hence, if the first type of identification aims at verifying a person’s individual identity, the second type aims at denying the administrative existence of the individuals and groups who do not satisfy certain requirements.

This article explores residency, a form of municipal membership that plays a strategic role in Italy. Residency is a formal status and a means to have access to rights. Therefore, it is a sort of local citizenship that, at least in part, equalises citizens and non-citizens. Due to its strategic role, many local authorities have paid serious attention to it recently. Municipalities have illegally tightened the requirements provided for by national laws for obtaining the status of resident or introduced new requirements. Stressing the di꜑í¼‚erent mechanisms of exclusion from residency, this article explains that they often work as administrative borders. These are bureaucratic barriers that, by denying residency, aspire to regulate, symbolically and sometimes materially, the composition of the people living within municipal territories and to redistribute rights between 'deserving' and 'undeserving' individuals. As such, administrative borders fragment individual statuses and provoke an increase in civic strati䲷cation.

Negli ultimi decenni, numerose amministrazioni comunali hanno attuato un vasto insieme di strategie, piuttosto diversificate sul piano degli strumenti giuridici e delle prassi amministrative, finalizzate a restringere i requisiti per l’iscrizione anagrafica Queste strategie, a volte, si sono scontrate con la resistenza di alcune organizzazioni e/o di alcune istituzioni: lo scontro, in questi casi, ha avuto come oggetto specifici provvedimenti e decisioni municipali ma anche, più in generale, lo stesso significato giuridico e socio-politico della residenza.
Attorno a questo istituto, dunque, si è andato rapidamente strutturando quello che, mutuando un concetto di Bourdieu, può essere considerato un vero e proprio campo di tensione e conflitto. Gli attori che si “contendono” la residenza, infatti, cercano, ognuno dalla sua prospettiva e perseguendo i propri obiettivi, di esplicitare principi pratici di visione e divisione del mondo e di imporre tali principi come categorie legittime di costruzione della realtà sociale.
Gli attori che compongono il campo della residenza sono piuttosto eterogenei: tra loro troviamo sindaci, operatori e dirigenti comunali, il Ministero dell’interno, l’Istat, l’Unar, l’Anusca, la polizia locale, prefetti, politici – a volte di livello statale, più spesso di livello regionale e locale –, organizzazioni che tutelano i diritti dei migranti e delle persone vulnerabili, sindacati, giornalisti, magistrati – ordinari e amministrativi –, avvocati e giuristi.
Il conflitto tra gli attori qui indicati, sostanzialmente, può assumere tre forme differenti – nettamente distinguibili in via analitica ma spesso tra loro concretamente intrecciate –, configurandosi come: una disputa giuridica sul significato della residenza; una controversia giudiziaria su casi specifici di rifiuto dell’iscrizione; uno scontro politico sul controllo della popolazione locale. Più in dettaglio, il primo tipo di conflitto verte su confini giuridico-teorici, e gli attori che lo animano provano a imporre una specifica visione della residenza e delle procedure che portano al suo riconoscimento, tracciando una linea che, sul piano della teoria, sia in grado di escludere dal campo le altre visioni. Il secondo tipo di conflitto, invece, è incentrato su confini giuridico-pratici: la linea oggetto di contesa, qui, non è tracciata sul piano teorico ma al livello delle procedure concrete; la controversia, di conseguenza, è successiva a queste procedure, e l’arena in cui prende forma è costituita dai tribunali, amministrativi e civili. Il terzo tipo di conflitto, infine, è imperniato su confini politico-sociali: in questo caso, la demarcazione che alcuni attori provano a imporre, e che altri attori si impegnano a contestare, è quella tra cittadini locali legittimi e “illegittimi”, e la disputa può avere luogo parallelamente alla contesa giuridica o indipendentemente da questa.
L’esistenza di un campo così “denso” e di un conflitto così articolato è un fatto di assoluto rilievo per lo studio dell’iscrizione anagrafica: in primo luogo in quanto mostra la varietà delle “interpretazioni” della residenza fornite dagli attori formalmente incaricati di gestire le procedure per il suo riconoscimento e, al contempo, evidenzia il profondo scollamento tra tali interpretazioni e il dettato normativo; in secondo luogo perché rivela, seppur indirettamente, come i dati comunali relativi al numero di iscrizioni, alla quota di “rifiuti” e alle ragioni riportate per giustificarli possano essere affetti da profonde distorsioni.
Come emerso dalla ricerca che fa da sfondo a questa proposta di intervento, le forme illegittime di negazione della residenza possono tradursi, alternativamente, in dinieghi formali palesemente contra legem, in dinieghi informali o in rifiuti formali apparentemente legittimi ma in realtà pretestuosi. Nel primo caso, l’avvenuto diniego è registrato adducendo come motivazione il mancato soddisfacimento di requisiti assolutamente non previsti dalla legge, spesso (sebbene non necessariamente) introdotti da ordinanze o circolari. Nel secondo caso, il diniego avviene a voce, in modo da non lasciare tracce amministrative: gli operatori degli uffici anagrafici invitano coloro che richiedono l’iscrizione a non consegnare la propria dichiarazione di residenza perché “incompleta” o perché (sulla base di ragioni quasi sempre poco chiare) non sussisterebbe il diritto all’iscrizione. Nel terzo caso, infine, il rifiuto della residenza è motivato con la mancanza del requisito dell’abitualità della dimora – e perciò appare legittimo –, ma è formalizzato a seguito di accertamenti il cui esito è quantomeno discutibile, dato che risultano negativi nonostante la persona viva effettivamente nel luogo dichiarato, facendo perno, in maniera arbitraria, sulle condizioni dell’alloggio.
Ora, soltanto nel primo caso l’illegittimità dell’azione dell’amministrazione comunale è evidente, mentre negli altri casi è del tutto invisibile o, quantomeno, è celata. L’assenza di tracce amministrative, infatti, rende impossibile capire, stando alla semplice analisi dei dati comunali, se si sono verificati, episodicamente o sistematicamente, casi di rifiuto illegittimo; al contempo, la presenza, all’interno di tali dati, di un numero elevato di dinieghi motivati con la ragione – di per sé legittima – dell’insussistenza del requisito dell’abitualità della dimora può essere un indizio, ma certamente non costituisce una conferma, dell’azione illegittima da parte di un comune.
Di conseguenza, i ricercatori che si trovano oggi – e quelli che si troveranno domani – a decifrare le informazioni provenienti dalle amministrazioni comunali necessitano di un quadro di conoscenze di sfondo estremamente articolato in relazione alle dinamiche e ai meccanismi di esclusione che prendono forma in numerosi contesti locali: queste dinamiche e questi meccanismi, infatti, incidono, direttamente o indirettamente, sulle procedure di iscrizione anagrafica e, di conseguenza, sulle modalità con cui tali procedure possono essere studiate. Da questa prospettiva, i conflitti sull’iscrizione anagrafica costituiscono un punto di osservazione estremamente utile, in grado di fornire un aiuto prezioso nella ricostruzione dei meccanismi di esclusione dalla residenza e, dunque, nello studio delle fonti anagrafiche, così da tracciare un quadro più articolato e realistico delle migrazioni interne nel territorio italiano.

"Il saggio di Enrico Gargiulo ci parla proprio di quanto recentemente avvenuto nel Nord Italia a livello amministrativo, per quel che riguarda la concessione della residenza. Attraverso un’originale ricerca condotta con gli strumenti della so-ciologia giuridica, Gargiulo riflette sui tentativi, avanzati da alcuni responsabili degli enti locali settentrionali – come il sindaco di Cittadella in provincia di Padova – di limitare l’accesso all’iscrizione anagrafica a persone non in possesso di una serie di requisiti relativi a lavoro, reddito o abitazione. Poiché la residenza riveste nel nostro ordinamento un’importanza cruciale per il godimento di molti diritti, le scelte di questi amministratori hanno colpito profondamente una porzione di cittadini più deboli, principalmente stranieri, con l’intenzione di influenzare indirettamente anche i loro comportamenti migratori, spingendoli a prendere la residenza in un comune diverso. Cosa tutto ciò implichi in termini di una definizione più articolata della cittadinanza è al cuore dell’analisi di Gargiulo, che riesce a calarci in un orizzonte estremamente attuale di «geometrie variabili» di status civitatis."

The 2018 Revision of World Urbanization Prospects produced by the Population Division of the UN Department of Economic and Social Affairs (UN DESA) indicated that 55% of the world’s population live in urban areas and there are prospects that by 2050 the urban population is estimated to be as high as 68%. They estimate that 90% of the increase is to take place in Africa and Asia.  Of course there are many factors to be attributed to this gradual change, such as mobility in search for employment, education opportunities, access to medical facilities, rapid industrialization and globalization. Such a transformation affects these urban areas with three major consequences, namely scarcity of public goods, environmental pressure as a result of high social and economic activities and the right to property rights which undermines the principle of co-governance in making public policies. The process is very vital for modern democracies, for it suggests that having a collaborative and cooperative governance where each citizen is duly consulted and given the right to participate in decision making (the bottom-up approach), would lead to a stable development and inclusive cities.  Some writers have underlined the idea that city centers should continue to be managed by city civil authorities or through direct intervention from central governments in as far as making policies is concerned. In fact, Christian Iaione is of the view that such approaches have failed many cities, claiming that local commons should be considered as stakeholders and not just beneficiaries in designing and implementing policies. 
However, from a Ugandan or African perspective, it is evident that direct civil management of cities or towns has been disastrous with ineffective public services coupled with poor environmental management, high levels of poverty, congestion, bad water and sewage management and land evictions. This does not lead us to conclude that either the central government or city councils have failed to carry out their duty and we should relax their duties towards the citizens, in fact, local commons should demand strict accountability because they pay high taxes on each and everything done in the city. Furthermore, in such a homogenous society, with people with no real property rights, lack of collective decisions makes it more difficult for co-governance modules.
Therefore, this paper explains why in the Ugandan setting, real property rights is the social fabric that influences collective rights in the urban areas and with a million city inhabitants in the city slums with no social and economic guarantees, co-governance would still be difficult to realize. Thus, contesting that polycentric or shared governance of the commons would be considered as “the desired after governance”, which comes after property rights are guaranteed. The paper also gives the legal prospects that right now, the majority of city commons need legal empowerment in order to have legal rights on property which could be guaranteed by the rule of law. Therefore, having such legal protection on property rights, especially for the poor, would be a threshold that administers the principle of co-governance, hence improving citizenry participation in civil, economic and social decisions.

In researching citizenship as an active and ongoing process, it is important to examine the experience of migrants in particular cities, with regard to local understandings of citizenship and belonging.  Avoiding the trap of ‘methodological nationalism’ (Wimmer & Glick Schiller 2002: 301), it must be recognised that hegemonic understandings of citizenship do not operate uniformly throughout the nation-state.  In fact, individual cities may embrace notions of citizenship and belonging that differ from or even challenge, the policies and discourses that underpin understandings of citizenship at the national scale, influencing the experiences of citizenship and belonging of its inhabitants.  These local notions of citizenship and belonging may provide resources for contesting and (re) negotiating national definitions of belonging; moral, cultural and identity-based resources can be crucial to social movements (cf Williams 1995; Hunt & Benford, 2004).  Additionally, the systems of oppression that position migrants differently in discourses of citizenship interact not only with each other, but with specific local social and economic contexts (Mohanty 1986).  Finally, a significant part of everyday lived experience occurs at the local scale, experience central to forming the relationships of conviviality and solidarity crucial in contesting and (re)negotiating hegemonic definitions of citizenship and belonging.   

This paper will address how local concepts of citizenship and belonging are mobilised by migrant women in Manchester and Sheffield in their struggles for political rights and recognition from both local and national governments.    While both cities embrace a more inclusive understanding of belonging than the national government, the cities have different histories and identities, and are located very differently in national and global economic contexts, dissimilarities reflected in local policy and discourse.  These cities should provide a useful contrast in examining how a specific locale influences the claims around citizenship made by migrant women in each city, and the activities through which these claims are supported.
