In an interview with Law360, Vincent Shier and Ryan C. Smith, Ph.D., who recently joined our D.C. office as partners in the firm’s life sciences and technology group, discussed how they decided to join forces instead of competing against each other at two different law firms. Shier said he had tried to recruit Smith to join him at his previous firm, and lauded him as a "very dynamic individual" who had a great personality and interests similar to his. "We realized there was something special about the connection and mutual interest in the types of work we were doing," Shier explained. For Smith, partnering with Shier was an opportunity for him to work with an attorney he trusts and admires. "Even though he was a competitor, I could trust and admire the way he handled his business, what he thought about the practice of law, how to serve the clients in the best way possible, and so I think that is really what it is," Smith said. In 1979, Jerry Buss bought the Lakers with a plan: transfer the team to his ex-wife, default on his loan, and threaten bankruptcy to escape repayment; a clear case of fraudulent transfer. “Acknowledging the utility of a fraudulent transfer to a debtor, and the harm to borrowers, we confront a policy question: why does Buss not fear worse consequences for this act?” he wrote. “If Buss had done all this in 16th century England, he could've gone to prison.
