Partner David Knight is quoted by Law360 regarding a recent ruling from Germany's top court holding that inventions discovered with the help of artificial intelligence can be patented. The Bundesgerichtshof ruled that an invention developed using AI systems may be patented and can include an acknowledgment of AI assistance, but a "natural person" must be named as the inventor. "There's not a lot in here which is new," Knight said. "Arguably the German court has done a little bit more than the U.K. Supreme Court, which has not definitively said, yes, if it is generated by artificial intelligence you can patent it, but the question they answered was whether a nonhuman can be named an inventor." In January, the Ninth Circuit reversed its prior decision to dismiss the online greeting card company's trademark infringement lawsuit against Punchbowl News after the U.S. Supreme Court ruled in Jack Daniel's Properties Inc. v. VIP Products LLC that trademark defendants cannot escape a court's likelihood-of-confusion analysis with the Rogers test when the accused infringer is using someone else's mark to identify its own products. The case was remanded to district court for further analysis.
