Looking for a practical discussion of the issues we’re seeing as companies tackle the new consumer health data #privacy laws in Washington, Nevada, and Connecticut? The bulk of Washington’s My Health My Data Act and Nevada’s (better-drafted) version of it take effect in 19 days, on March 31. Connecticut’s law is already with us. Many companies are still evaluating whether they have consumer health data and what to do about it if they do (or might). Others may not even realize they are processing consumer health data or don’t understand the potential regulatory and litigation risk if they are. Recall that WA’s law includes a private right of action with interesting nuances as it is tied to the state’s Consumer Protection Act.
