USCIS Fee Payment Update. USCIS is rolling out a new process for fee payments, making it more convenient for you. Starting now, most benefit request forms can be paid for by mail or remotely, eliminating the need for in-person visits to field offices. To utilize this new process, applicants can mail a check or use Form G-1450, Authorization for Credit Card Transactions, along with their benefit request. You must read the filing instructions carefully to ensure your form is eligible for remote submission and that you're filing at the correct location. Any incorrect filings will be returned, so double-check and submit them to the correct office. This streamlined approach saves time and money by removing the necessity for office appointments. Attorneys and accredited representatives can now process payments for EOIR-29 through a link in the email or text from the USCIS Contact Center. After processing, you can mail the necessary documents. Emergency advance parole (EAP) requests for Form I-131 still require an appointment with the USCIS Contact Center. Applicants must apply in person with their completed package and pay the application fee at the field office using Form G-1450 or a check. In January, USCIS announced its new organizational accounts that would enable petitioners and attorneys to file certain I-129 petitions and I-907 premium processing requests online.  This is huge news and has many benefits for company’s applying.  Among the benefits are:  Forms can now be e-signed rather than requiring handwritten signatures  Same-day receipt of petitions can now be submitted Companies and attorneys can easily “collaborate” on form preparation and submission Company groups can be created, and may consist of more than one administrator and multiple members. Forms can be initiated and edited by members of the company groups or legal teams Organizational accounts will save enough information to autofill G-28 forms with company and legal representative information. Supporting documents and unsolicited evidence can be uploaded electronically  We suspect this will make filing and collaborating on forms so much easier for businesses. Reminder to use the new Form I-129 and pay the new fees! Any Form I-129 based petitions that are filed on or after April 1, 2024, including H-1B cap cases, must utilize the new I-129 form. * If a petition is filed with the wrong edition of the I-129 form, it will be rejected by USCIS.  * If a petition is filed with the wrong filing fee, it will be rejected by USCIS. * There is no grace period for implementation of the new I-129 form or filing fees. Keep in mind, the new I-129 form comes with some key changes: * If a company is seeking eligibility for the lower filing fees as a “small employer” or “non-profit employer”, the company must provide documentary evidence of eligibility, including but not limited to a copy of Form 941, Employer’s Quarterly Federal Tax Return or letter from the IRS or copy of IRS certificate showing tax exemption. * Petitions are limited to 25 named employees per petition for essential support personnel seeking P-1, P-2, P-3, and O-2 classification. This limitation also applies to H-2A, H-2B and H-3 classification. * Employers will need to affirmatively identify the organization as a “nonprofit organized as tax exempt or a governmental research organization”. It is important to note that there are significant redundancies in the new form. Petitioners will need to answer the same questions in several different places (i.e., the number of beneficiaries included in the petition, number of employees (total number plus whether the employer qualifies as a “small employer”), and the beneficiary’s passport number). As of April 1st, the filing fees for I-129 petitions (without premium processing, but including ACWIA and Fraud Detection/Prevention Fee as applicable) will be: H-1B: $3,380 (employers with 26+ FTE) | $2,010 (employers with 25 or fewer FTE) | $960 (nonprofit) L-1: $2,485 (employers with 26+ FTE) | $1,495 (employers with 25 or fewer FTE) | $1,195 (nonprofit) O-1: $1,655 (employers with 26+ FTE) | $830 (employers with 25 or fewer FTE) | $530 (nonprofit) - Lin Walker #businessimmigration #h1b #l1visa #o1visa #h1blottery #h1bcap https://lnkd.in/e-T6z-6e

Right to rent update Legislative amendments to the Immigration Act 2014 taking effect from 22nd January 2024 have led to significantly increased penalties for landlords granting occupation without a valid right to rent in England. The government’s latest version of the ‘Landlord’s guide to right to rent checks’ released in October 2023 contains the essential procedures for verifying a tenants' right to rent. Liability for a penalty maybe imposed unless a landlord can provide a 'statutory excuse.' USCIS changed its fees on April 1 and the sticker shock has yet to wear off. Some fees are slightly higher, but the costs of a typical green card process have more than doubled. This increase is especially burdensome when multiple family members apply for permanent residence at the same time.   Here are two ways a lawyer can help.   First, by working with you to create a strategy tailored to your circumstances. USCIS requires certain forms, but other forms are optional. An attorney can help you decide what makes the most sense for you and your family.   Second, by preparing applications that are more likely to be approved. Immigration processes can be complicated. A typical set of green card applications can include 70 pages of forms, 105 of pages of instructions, and another 100 pages of supporting documents. It’s easy to make mistakes and expensive to fix them. USCIS does not refund filing fees when they deny an application.
