Terms and conditions

These terms and conditions (the “Terms”) apply to all purchases of merchandise and publications made by you through the website under the domain name www.royalacademy.org.uk (the “Website”). Please read these Terms carefully before using the Website. By using the Website, you signify your agreement to be bound by these Terms.

Disclaimer

The online shop on this Website is maintained by R.A. Enterprises Ltd (“RAE”), the trading company of the Royal Academy of Arts. Orders for merchandise and publications are placed with RAE.

RAE is a company registered in England and Wales (no. 1666333). RAE’s registered address is Burlington House, Piccadilly, London, W1J 0BD United Kingdom. VAT Registration No. 100 1935 71.

Orders for Membership of The Friends of the Royal Academy of Arts and for Summer Exhibition Entry are placed with different companies within the Royal Academy ‘group’ and governed by separate terms and conditions.

Availability, prices and information

The products on the Website are offered subject to availability.

All prices are in £ sterling, including tax where applicable, and must be paid in full including the delivery charge which is an additional charge. Customers and not RAE are responsible for customs duty and taxes prevailing in their own country.

RAE takes every care to ensure its product descriptions, price, colour and availability are accurate. However, there may be some changes which are beyond RAE’s control and variations are to be expected in handmade products. Sizes are given as a guide only.

Ordering

RAE will treat each order for goods, which is confirmed when you click on the "Submit order" button on the Check Your Order screen, as an offer by you to purchase the goods and services subject to these Terms. You are responsible for ensuring the accuracy of your order and RAE shall supply you, subject to availability, with the quantity and specification of goods set out in your order. RAE shall confirm each order by e-mail and such confirmation shall be RAE’s acceptance of the contract. Products will be delivered to the address you indicate on the Check Your Order screen. The risk of damage to or loss of the products passes to you at the time of delivery.

Payment

You can pay for your order online using American Express, MasterCard, Visa and their debit card alternatives. RAE also accepts Maestro and Switch, but it is unable to accept non-UK Electron. RAE does not retain your card details after processing your payment.

Returns and Damaged Goods

The following state the provisions of the Terms relating to returns and damaged goods. They do not affect any statutory rights that you may have as a consumer.

By law, customers in the EU have the right to withdraw from the purchase of the Goods before you are notified that any of the Goods have been dispatched. In addition, you have the right to cancel your purchase within 14 days of the day after the date your Goods have been delivered (the statutory cooling off period). You must notify RAE of your wish to cancel your purchase (see Refunds and Returns page), and complete the Certificate of Authenticity. You must then return the unwanted Goods, unused and with the original packaging within 14 days of notifying RAE of your decision to cancel. RAE will then reimburse you the purchase price within 14 days of receipt of the returned Goods. Please note that unless they are defective, RAE cannot refund or exchange Goods that have been personalised or earrings suitable for pierced ears.

In the unlikely event that your Goods arrive faulty or damaged, please contact the e-commerce team ([email protected]) to arrange the return of these Goods. Please also state the nature of the defect and let us know if you would prefer a refund, a replacement, or where possible, a repair. Please note that Goods that are unique cannot be replaced. All faulty or damaged Goods shall be returned in the original packaging with all relevant documentation including the Certificate of Authenticity. Please ensure the correct return postage has been paid. This will also be refunded when you return the Goods to RAE.

RAE recommends that you use a recorded delivery service or obtain a Certificate of Posting, as the parcel remains your responsibility until it reaches RAE. RAE’s returns policy does not affect your statutory rights.

RAE respects your privacy and will use the information you provide to fulfil your order. Your placement of an order is taken as consent to this process. RAE will give you the option of receiving further information from it, and from other selected organisations, when you make your purchase. Amendments

RAE reserves the right to amend or revise these Terms at any time without notice. Any changes to the Terms apply with immediate effect from the date of publication on the Website. By continuing to use this Website after any changes are made you accept those changes and they are binding on you.

Limitation of liability

RAE’s liability to you is limited to refunding the price of the products as provided above. RAE is not responsible to you to any greater extent and in particular is not liable to you for any indirect or consequential loss (including without limitation financial loss such as loss of profit, or otherwise) that you may incur as a consequence of its failure to comply with these Terms. This clause does not operate to exclude or limit RAE’s liability in respect of death or personal injury caused by its negligence.

Law and jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising in relation to the Website shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Terms and conditions of Friends membership

These terms and conditions (“the Terms”) apply to your Membership of the Royal Academy of Arts (“your “Membership”). Please read these Terms carefully.

Orders for Membership of The Friends of the Royal Academy of Arts are placed with Friends of the Royal Academy (“Friends”). Friends is a company registered in England and Wales (no. 01291535) and a registered charity (no. 272926). Friends’ registered address is Burlington House, Piccadilly, London W1J 0BD. VAT Registration No. 242 1273 01.

Prices and information

All prices for Membership are annual payments in £ sterling, including tax where applicable. You can see the benefits provided to Friends here: Friends benefits

Children under 16 can visit the Royal Academy for free.

Young Friends Membership is for those aged 16 to 35 years, and admits the named card holder and one adult family member.

Standard Friends Membership is for one adult, and admits the named card holder and one adult family member.

Joint Friends Membership is for two adults (One Primary and one Secondary card holder) living at the same address, and admits the two named card holders and two adult family members.

Primary Cardholders: Will be the payee of the Membership donation and will be authorised to change payment, address, name and contact details, book tickets and cancel memberships.

Secondary Cardholders: Will be authorised to book tickets only and update their own name and contact details only.

What Does the Term “Family Member” Mean?

HMRC rules refer to family members, not a guest of the family. The RA can only claim Gift Aid on the whole of the Membership subscription if the right of admission is restricted to the individual Friend and members of the individual’s family. Ordering

You are responsible for ensuring the accuracy of the details you provide to us and, subject to receiving your payment, we will supply you with the Membership requested. We will confirm your Membership by email if you have given us your email address, or if not, by post.

We will send your Membership card within 14 days of receipt of your payment, except for direct debit payments, where your Membership card will be sent within 14 days from receipt of the original direct debit instruction. Your Membership card will be posted to the address you provide in the delivery instructions for your order.

If you have selected Membership as a gift for another individual we will arrange to send the Membership card to the beneficiary, or as indicated in your order, within 14 days. In the event that you elect to pay by direct debit but fail to return the direct debit authorisation, no Membership card will be issued to you. If your direct debit payment is rejected or cancelled, then we will contact you to try to arrange payment, but we reserve the right to cancel your Membership.

Membership packs are usually dispatched within 10-14 working days. Please note there may be some delays over the Christmas period.

Payment

You can pay for your Membership online by credit card using American Express, Mastercard or by Visa, or by phone by calling +44(0) 20 7300 8090. You can also pay for your recurring Membership by direct debit online, by downloading the relevant Membership form and sending it to the Royal Academy, or by phone. Alternatively, payment can be made in person at the Membership Desk in the entrance hall of Burlington House by direct debit or credit card. We are currently cashless on site at the RA.

Membership

Your Membership will last for one year, unless otherwise stated, until the end of the expiry month specified on your Membership card. After that you may renew your Membership for subsequent periods of one year and you acknowledge that the price for Membership may increase and the terms change. Friends gain entry to the Royal Academy of Arts during opening hours by showing their Membership card. Additional identification for admittance may be required on occasion.

Your Membership is non-transferable so that only you will be able to use it. In the event of card misuse, the Royal Academy reserves the right to withdraw your Membership (with payment for Membership being forfeited) and restrict you from becoming a member of the Royal Academy in the future.

You acknowledge and accept that, on occasion, the published dates of Friends previews may be changed or, where exhibitions are exceptionally busy, we may require you to make a timed booking to see an exhibition. In addition, there may be some days on which the Royal Academy is closed to the public, for example for the installation of a new exhibition. You will be notified by email if we hold your email address and in the RA Magazine if this were to occur, but please also check the RA website for up to date details of opening times and bookings required.

Attending exhibitions

For the best experience, Friends are recommended to book ahead. Friends access is always prioritised – but you may need to wait if our galleries are full. Save time on arrival and ensure entry at your preferred time by booking ahead. Friends can do this by booking online or calling the Ticketing Team on 0207 300 8090 or email, [email protected]. Visits to our shops, cafes, free collections and displays do not require a ticket.

Redeeming the cost of an exhibition against a Friends Membership

If you have bought a ticket to one of our exhibitions and then decide to buy a Friends’ Membership on the same day, you may be able to redeem the cost of your exhibition tickets from the price of Friends of the RA Membership. Only exhibition tickets purchased on the day may be redeemed and these are limited to two tickets for a single Friends Membership (Standard, RA250 and RA250 Supporter) one ticket for Young Membership, and four tickets for Joint Memberships. Please bring your exhibition tickets to the Membership Desk, in the entrance hall of Burlington House and we will redeem them against your Friends Membership purchase. Dual exhibition tickets that are valid for entry to more than one exhibition will be counted as two tickets.

Preview days

Friends must book a ticket to attend preview days. Attendance will be given on a first come first served basis at the time of booking and we cannot guarantee that all Friends will be able to attend. Friends still have priority booking on all dates of every exhibition in addition to the preview days.

Online access

While the Royal Academy endeavours to ensure that its website is available 24 hours a day, neither the Friends of the Royal Academy or the Royal Academy itself will be liable if for any reason the website is unavailable in part or whole at any time or for any period. Access to the RA website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Royal Academy’s control.

Cancellations, refunds, exchanges

Friends of the RA memberships are a donation to the Royal Academy of Arts and therefore are non-refundable. It is possible however to cancel the automatic renewal of a recurring membership paid for by Direct Debit before expiry of the current membership year. For all memberships, depending on circumstances it is possible to transfer membership to someone else for the remaining term. To request a cancellation or transfer, please call the Membership Team on 0207 300 8090 or email [email protected] to discuss.

The Royal Academy has the right to revoke Memberships without refund at any time if the member has displayed unacceptable behaviour to members of staff or other members of the public.

10% discount in RA Shop

Friends receive a 10% discount in the RA Shop. To use this discount in person, simply show your Friends Membership card to the RA Shop staff. Alternatively, if you choose to use this discount for online purchases please quote the special Friends code on the checkout page of your purchases which can be found in your regular Friends e-newsletter.

The Friends discount cannot be applied to on-sale items and also excludes RA Art Sales, limited-edition prints or custom prints, limited-edition books, limited-edition merchandise, magazine subscriptions, RA Friends Membership, gift vouchers, glassware, Print on Demand or RA Paints. It is not valid in conjunction with any other discount or promotion.

Amendments

We reserve the right to amend or revise these Terms at any time without notice. Any changes to the Terms apply to your Membership with immediate effect from the date of publication on the RA website.

Your data

You have provided us with your personal data for your Membership. Your personal data will be managed respectfully and responsibly in accordance with our privacy policy which can be found at royalacademy.org.uk/privacy.

How we will contact you

If possible, we would like to be able to contact you by email because we feel it is the most efficient and productive way to communicate with you about the wide range of programmes and offers from across the RA.

We will contact you by email if you have given us your email address and we are emailing you in connection with your Membership.

We may in addition contact you for marketing purposes by email if you have given us your consent to do so. This may include requests for your support through a variety of different fundraising initiatives such as requesting donations, inviting you to attend special events, or encouraging you to purchase tickets or products.

If you have provided us with your postal address or telephone number we may send you direct mail or telephone you about our work and our fundraising campaigns, unless you have told us that you would prefer not to receive such information. We will carry out a legitimate interest assessment to ensure that we are satisfied that you would reasonably expect such communications from us and would not consider it to be intrusive. For example, we may want to post you an invitation to an event we think you may be interested in.

Before telephoning you (unless it is in connection with the service we are delivering to you) we will check with the Telephone Preference Service.

Events outside the control of the Royal Academy

If an event occurs which is outside the reasonable control of the Royal Academy, for example strikes, failure of a utility service or transport network, act of God, war, terrorism, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors, we will not be liable to you as a result of any delay or failure to perform our obligations under these Terms.

Selecting a future start date for Friends of the RA Membership
Choosing to select a future start option for Membership may only be available at certain points in the year, the Royal Academy reserves the right to remove at any time. For members who have chosen a future start date, Membership is not active and benefits will not be available until the start date specified. Membership lasts for one year from chosen start date to the end of the month specified on your membership card.

Exhibitions

Tickets

We ask visitors and Friends to have their tickets printed or in the format of e-tickets on a smart phone or device. If you have misplaced your ticket, please bring a copy of your booking confirmation email or your booking reference number to the ticketing booth in the courtyard. Please allow extra time to collect your tickets.

If you have booked online and chosen mobile tickets, your ticket will be emailed to you shortly after the order confirmation email. Please present the mobile ticket at the entrance to the exhibition.

Under 16s go free to all RA exhibitions and must be accompanied by a fee-paying adult regardless of party size. We can accommodate up to 9 people in a group. If you require more than 9 tickets we will book them for the closest time slots possible, depending on availability. Please contact [email protected] to make a booking of more than 9 people.

Cancellations, refunds, exchanges
Where exhibition tickets can no longer be used, you may either:
• Exchange the tickets for an alternative date, an alternative exhibition, or tickets to an RA event; or
• Cancel the tickets and receive a refund to “on account” credit.

A request to exchange or cancel tickets must be made no less than 24 hours before the time and date of entry for those tickets; you will not be able to exchange tickets or request a refund after this time. Exchanges and refunds are subject to an administration fee of £1 per ticket.* Please note that “with donation” tickets are treated differently (in order to comply with HMRC rules). Please contact us if you wish to cancel a “with donation” ticket.

Requests to exchange tickets are subject to availability. If the cost of the new tickets is different to the cost of the tickets being exchanged, you will be required to pay the balance if the new tickets are more expensive; or will receive a refund of the balance to “on account” credit (subject to deduction of any administration fees) * if the new tickets are less expensive.

All ticket refunds are paid as “on account” credit which can be used towards any RA purchase (excluding RA Shop or cafe/ restaurant purchases) for up to one year from the date of issue. Credit may be used for online, telephone or in-person purchases. Any credit not used within one year will be lost and no further refund issued.

Please note, where a group booking (an order over 9 tickets) is cancelled less than 2 weeks before the visit date a 100% cancellation fee will be incurred. If a group booking requires rescheduling please contact [email protected] at least 2 weeks before the visit date, and depending on availability a suitable alternative may be found.

General terms and conditions for RA Events

The Royal Academy reserves the right to refuse admission to any event.

All RA ticketing procedures are correct at time of publication, but are subject to change without notice.

Ticket holders consent to the photographing, recording and filming of themselves as members of the audience.

Events programme

Including talks, tours, workshops, and some special events.

Tickets
Reductions are available for students, jobseekers and people with disabilities with recognised proof of status. Please bring your proof of status to show on the door of the event.

If you have chosen to receive your tickets in the post, you should receive them within two weeks of your booking. Please contact the Ticketing Team if you have not receive your tickets.

If you have chosen to collect your tickets, your tickets will be held for collection on the door of the event. Please bring your booking confirmation email or your booking reference number in order to collect your tickets.

If your booking is made less than a week before the event, your tickets will be held for your collection.

Attending the event: cameras, recording equipment, food and drink are not allowed in lectures.

Where event tickets can no longer be used, you may either:
• Exchange the tickets for an alternative date, an alternative event, or tickets to an RA exhibition; or
• Cancel the tickets and receive a refund to “on account” credit.

Please note that this policy applies to most RA events including our public event programmes, academic programmes, workshops, talks and lectures, and short courses, in each case whether online or in-person, including tickets for Saturday Sketch Club events. Fundraising events are subject to separate terms and conditions.

Courses and classes

Tickets
Places are limited and subject to availability. The RA cannot guarantee your place until your place has been confirmed by us. The RA reserves the right to refuse an application for attendance.

Concessions are not available for courses and classes. Prices are available for entire courses only – there are no reductions for attending only part of a course.

In the event of a course being full, a waiting list will be in operation on a first-come-first-served basis.

Attending the event
Participants must be aged 18 or over.

If you are late attending, you may not be admitted, or admitted only at an appropriate break-time if your admittance might disturb other participants.

Where your conduct is unacceptable (in the RA’s reasonable opinion), we reserve the right to request that you leave the course or class. No refund of fees will be made. The RA shall not be responsible for loss or damage to your personal property brought into the RA.

Cancellations, refunds and exchanges
If you are no longer able to attend a course or class which you have booked, you may cancel the booking and receive a refund provided that you give us sufficient notice.

If you cancel your course or class at least 14 whole days before the start date, you will receive a full refund. If you cancel your course or class less than 14 whole days before the start date, you will only receive a full refund if we resell your ticket. If we do not resell your ticket, no refund will be given.

Please note that “with donation” tickets are treated differently (in order to comply with HMRC rules). Please contact us if you wish to cancel a “with donation” ticket.

You may not resell or transfer your place on a course or class without the RA’s prior written consent.

The RA reserves the right to:
• Reschedule courses and classes;
• Make alterations to the published details of a course or class; and/or
• Cancel a course or class.

In the event that a course or class is rescheduled or cancelled, we will attempt to give you as much notice as possible. Where a course or class is rescheduled, you will be given the option to either book a place on the rescheduled date or receive a full refund. In the case of cancellations, you will receive a full refund. Please note that “with donation” tickets are treated differently (in order to comply with HMRC rules). Please contact us if you wish to cancel a “with donation” ticket.

For the avoidance of doubt, the RA will not be responsible for any travel, accommodation or other costs and expenses associated with your attendance, or planned attendance, at a course or class (including a course or class which is cancelled or rescheduled by the RA).

Please note that this policy applies to both in-person and online/ digital courses and classes.

Personal Data and copyright
We will hold your data in accordance with RA's privacy policy.

By booking the class or course you consent to the photographing, recording and filming of yourself and any artwork you create for the RA’s promotional purposes.

When you share your work from a course or class with us by email or on social media you:

(i) grant to the Royal Academy of Arts a perpetual, royalty-free, non-exclusive license to use, reproduce and modify your drawing, for use in any media including on the Royal Academy website and social media channels, as well as featuring it in the #RASketchClub broadcast;

(ii) warrant that the drawing is your own original work and you have the right to make it available for the use described;

(iii) agree to waive any moral rights in your drawing, including to be acknowledged as author (or where any such rights cannot be waived, not to assert such rights);

(iv) allow the Royal Academy of Arts to use your name and / or social media handle on the Royal Academy website and social media channels.

Copyright and other intellectual property rights in the materials provided to you during the course or class and in the course or class content at all times belong to the RA. All materials provided to you by the RA are for your personal use only. Any commercial use is prohibited.

Family events

Your tickets will be posted to you, unless your booking was made less than a week in advance, in which case tickets will held for your collection.

Attending the event
Please refer to your ticket with regards to the time and place to meet.

Cancellations, refunds, exchanges

We are currently offering refunds for all exhibition and events programme bookings.

Patron events

Tickets
Patrons events are only open to Patrons of the Royal Academy of Arts. These are generally very popular and sell out quickly. We recommend posting your booking form as soon as you receive your copy of the Patron Event Brochure to guarantee a place. Events are also available to book online and go live as soon as the brochure is released.

These terms and conditions (“the Terms”) apply to your House Membership or your Bar & Garden Membership of the Royal Academy of Arts, as applicable (“your “Membership”). Please read these Terms carefully.

Terms and conditions for House Membership and Bar & Garden Membership

These terms and conditions (the “Terms”) apply to your purchase of a House Membership or Bar & Garden Membership at RA (Arts) Limited (“Membership”) and to you as a member (“Member”). For House Members, this includes membership of the Academicians’ Room. Please read these Terms carefully before completing the application form and purchase of your Membership as they will form the basis of the contract between you and RA (Arts) Limited (“us” or “we”).

2. Processing your Membership

All prices for Membership are annual payments in £ sterling, including tax where applicable.

The benefits provided to House are:

• Full access to the Keeper’s House for you and up to three guests, including the Academicians’ Room and Shenkman Bar & Garden
• Unlimited, free entry to exhibitions for you and one guest
• Invitations to members’ preview days and art buying events
• Exclusive entry to Friday morning private views (booking required)
• Priority access to the Summer Exhibition
• Priority booking to RA courses and events

Once we receive your completed application form and your Direct Debit details, your Membership card will be available for collection from the RA. You’ll be able to use your benefits without your physical Membership card by logging in to your online RA web account and using a digital version of the Membership card.

In the event that you elect to pay by Direct Debit but fail to return the Direct Debit authorisation, no Membership will be issued to you. If your Direct Debit payment is rejected or cancelled, then we will contact you to try to arrange payment, but we reserve the right to cancel your Membership.

Membership shall last for one year until the end of the expiry month specified on your Membership details. After that, you may renew your Membership for subsequent periods of one year and you acknowledge that the price for Membership may increase and the Terms change. Any changes to the Terms apply with immediate effect from the date of publication.

We will contact you by email before your membership expires to invite you to renew your Membership, or we will notify you by email when your Membership is due to renew if you have a recurring Membership paid for by Direct Debit.

3. Your Membership and benefits

Members gain entry to the Royal Academy of Arts and relevant Members’ areas during opening hours by showing their Membership card. Additional identification for admittance may be required on occasion.

Membership cards are for the named card holder only. They are non-transferable. ID may be required.

Attending exhibitions

For the best experience, Members are recommended to book ahead. Members’ access is always prioritised – but you may need to wait if our galleries are full. Save time on arrival and ensure entry at your preferred time by booking ahead. Members can do this by booking online.

Preview days and Friday morning private views

Members must book a ticket to attend Friday morning private views (House Members only) and Member preview days. Attendance will be given on a first come first served basis at the time of booking and we cannot guarantee that all Members will be able to attend.

Members still have priority booking on all dates of every exhibition in addition to the preview days.

You acknowledge and accept that, on occasion, the published dates of previews may be changed or, where exhibitions are exceptionally busy, we may require you to make a timed booking to see an exhibition. In addition, there may be some days on which the Royal Academy is closed to the public, for example for the installation of a new exhibition. You will be notified by email, but please also check the RA website for up-to-date details of opening times and bookings required.

Happy Hour at the Shenkman Bar

Happy Hour at the Shenkman Bar takes place every Wednesday to Saturday from 6-7pm. Show your membership card at the bar to enjoy 2-4-1 on selected drinks from our Happy Hour menu including wine by the glass, house spirits with mixers, bottled beer/cider, soft drinks/juices and the cocktail of the month. This offer cannot be used in conjunction with any other discount or promotion.

10% discount in RA Shop

Members receive a 10% discount in the RA Shop. To use this discount in person, simply show your Membership card to the RA Shop staff. Alternatively, if you choose to use this discount for online purchases please quote the special code on the checkout page of your purchases, which can be found in your regular e-newsletter.

The discount cannot be applied to on-sale items and also excludes RA Art Sales, limited-edition prints or custom prints, limited-edition books, limited-edition merchandise, magazine subscriptions, RA Friends Membership, gift vouchers, glassware, Print on Demand or RA Paints. It is not valid in conjunction with any other discount or promotion.

4. Privacy and how we will contact you

You have provided us with your personal data for your Membership. Your personal data will be managed respectfully and responsibly in accordance with our privacy policy which can be found at royalacademy.org.uk/privacy. This policy also sets out the ways in which we may contact you.

Unless you agree otherwise, we will only process the information that you submit in the application form for the purposes of processing your Membership and to tell you about any similar goods or services you may be interested in.

We will contact you by email if you have given us your email address and we are emailing you in connection with your Membership. We send regular email newsletters to Members. You have the option to unsubscribe.

If you have provided us with your postal address or telephone number, we may also contact you by direct mail or telephone in the circumstances described in our privacy policy.

We may in addition contact you for marketing purposes by email if you have given us your consent to do so. This may include requests for your support through a variety of different fundraising initiatives such as requesting donations, inviting you to attend special events, or encouraging you to purchase tickets or products. The application form gives you the ability to opt out of receiving information from RA (Arts) Limited, the Royal Academy of Arts and its other wholly-owned subsidiaries or associated charities.

5. Keeper’s House Rules

There are Keeper’s House Rules that apply to Membership and form part of the Terms. All Members are bound by the Keeper’s House Rules, and you agree to comply with them (as such Rules may be amended from time to time).

6 Refunds, Transfers and Limitation of Liability

No refunds shall be given unless we, through our own fault, are unable to honour the Terms. In such circumstances, you will be entitled, depending on the circumstances, to a partial refund of your Membership payment. Payment in part will be our exclusive liability to you in respect of the Membership (to the extent permitted by law).

The Royal Academy has the right to revoke Memberships without refund at any time if the Member has displayed unacceptable behaviour to members of staff or other members of the public.

Membership transfers

We are happy to consider a transfer of a Membership in exceptional circumstances. Please call the Membership Team on 020 7300 8090 or email [email protected] to discuss individual circumstances.

We will not be responsible to you to any greater extent and in particular shall not be liable to you for loss of revenue, loss of profits, business or goodwill or reputation or any indirect or consequential loss arising from or in connection with your Membership. This clause does not operate to exclude or limit RA (Arts) Limited’s liability in respect of death or personal injury caused by its negligence or caused by its fraud.

Events outside the control of the Royal Academy

If an event occurs which is outside the reasonable control of RA (Arts) Limited, including but not limited to strikes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors, then we will not be liable to you as a result of any delay or failure to perform our obligations under these Terms.

7. Third Parties

No third party shall have any rights under or in relation to the Terms.

8. Amendments

We reserve the right to amend or revise these Terms at any time without notice. Any changes to the Terms apply to your Membership with immediate effect from the date of publication on the RA website.

The Keeper’s House Rules

Please have your membership card with you at all times. Members are asked to show their membership card for access to exhibitions and entry to the Keeper’s House. You may also be asked to show your membership card when purchasing food and drink within the Keeper’s House. Please note ID may be required to confirm you are the cardholder.

Membership entitles you to bring a maximum of three guests into the Keeper’s House.

Children under 16 can visit the Keeper's House when accompanied by an adult member (aged 18 years or over). Children shall remain under the control or supervision of an adult at all times.

Backpacks, suitcases and large bags can’t be stored or brought into the Keeper's House, there is a cloakroom available in Burlington House. At busy times, we may ask for buggies to be folded or left in the cloakroom

No booking is required to visit the Keeper’s House. We will do our best to accommodate members at all times, however you may need to wait if our tables are full. Table bookings are open to House Members in the Academicians’ Room only.

Pets are not permitted on the premises; however support animals are permitted. Please get in touch with [email protected].

No smoking is allowed; however smoking is permitted in the Keeper’s House Garden and on the balcony of the Academicians’ Room.

Members must accompany their guests at all times upon entry to the Keeper’s House with a valid membership card, and are responsible for their conduct.

All bills and tabs must be paid before leaving the premises. Members are responsible for their guests’ bills and tabs in addition to their own.

We hold members’ information in the strictest confidence, and we expect the same confidentiality from our members too.

Please treat other members, our employees, volunteers, building and art with respect. Abuse of any kind will not be tolerated.

The Keeper’s House may not be used as a regular place of business. However, House Members may host occasional and discreet client meetings in the Academicians’ Room at the discretion of the House Manager.

House Members are requested not to make audio or video calls at any time in the Academicians’ Room. Laptops may be used during quiet times of day at the discretion of the House Manager. During busy service times in the Academicians’ Room, House Members will be asked to work elsewhere in the Keeper’s House.

There is no access to power for charging computing devices in the Academicians’ Room. House Members should use the designated power source to charge their mobile phones.

Please leave the premises quietly at all times in consideration of our neighbours.

Any questions or disputes of the Keeper’s House Rules should be taken up with the House Manager. Violations of the rules may be escalated to security or senior management, and at their discretion, guests may be asked to leave or have their membership cancelled.

WiFi is available, please ask a member of staff.

No professional filming or photography can take place in the RA without supervision by the press team and must be conducted when we are closed to the public. Please seek written permission from the Membership Team if you are interested in filming or taking photographs in the Keeper’s House.

No photography of other members is allowed without prior permission of the management.

Please refer to our website for the latest opening hours and information about membership access. Occasionally parts of the Keeper’s House will be closed for private events. Where possible, we’ll inform members in advance of the closure.

The Keeper’s House Rules may be subject to change or amendment at the discretion of the RA. Members will be notified of changes made by email.

All members are required to review and agree to the Keeper’s House Rules and the Membership Terms and Conditions before purchasing a membership.

Fundraising events

These terms and conditions apply to the RA’s fundraising events including the Summer Exhibition Preview Party and the Schools Annual Dinner and Auction.

1. Tickets and Admission

Concessions and discounts are not available for fundraising events.

Tickets are sent out by post approximately two weeks prior to the event.

Each ticket must be assigned to a named individual and will not be issued without guest names.

If you have chosen to collect your tickets, they will be held for collection on the door of the event. Please bring ID in order to collect your tickets.

If your booking is made less than a week before the event, your tickets will be held for collection rather than being posted.

Once tickets sell out, a waiting list will be in operation on a first-come-first-served basis.

The entirety of the ticket price covers the cost of admission – no part is a donation.

Please check the event page on the website or contact the Events Team for further information about the event, including details of the activities and performances taking place, dress code, and the food and drink available.

Please refer to your ticket with regards to the entrance to use and the time of admission.

2. Cancellations, refunds, exchanges

If the event must be cancelled or rescheduled due to extenuating circumstances then the following will apply:

The RA will contact ticket holders to offer three options:

– Transfer of tickets to the rescheduled date or the equivalent event in a future year (or other applicable time period);

– Receive a refund;

– Convert the ticket purchase sum into a donation to the Royal Academy of Arts .

If the RA does not receive a response selecting an option within one month, we will send a reminder.

If we do not receive a response within one month of the reminder, then we will treat the ticket purchase sum as a donation in accordance with option 3 above.

If ticket buyers cannot attend, they may transfer their tickets to another named individual. If tickets have already been issued in one name, this ticket must be physically exchanged for the replacement.

3. General

The RA reserves the right to refuse admission to any event.

All RA ticketing procedures are correct at time of publication but are subject to change without notice.

Attendees consent to being photographed, recorded and filmed for the RA’s purposes.

Attendees are not permitted to bring their own food and drink on site.

Grayson Perry Plate

The following is only applicable to individuals, trusts, foundations, and corporate supporters.

Donations of £1,000 or more
– The first 500 donations of £1,000 or over will be acknowledged by sending you a ‘Rainbow Sickness’ plate designed by Grayson Perry just for us, as a thank-you.
– These plates have not been created as an artists’ edition and will not be numbered, but we are limited to an initial run of 500.
– If you are able to be more generous, then we would be delighted to acknowledge this with more plates. There are a limited number, but we will endeavour to offer more plates as the donation increases by each thousand pounds. For example, a donation of £5,000 will enable us to consider allocating five plates to you, as a thank you for exceptional generosity.
– Donations qualify for Gift Aid if the donor pays sufficient income tax or capital gains tax to cover all qualifying charitable donations for the tax year and has provided the RA with a valid Gift Aid declaration. If you have not already done so, and you qualify, please tick the Gift Aid declaration box which will appear on the checkout page to confirm you are eligible for Gift Aid, when you donate online. Gift Aid is a UK government scheme that enables the RA to claim tax relief on donations from UK taxpayers. We would encourage all eligible donors to take up this scheme to maximise their donation. For every £1,000 a UK taxpayer donates, £250 in reclaimed tax is added. This means that a £1,000 donation with Gift Aid is worth £1,250 to the RA. Please note that we will share relevant and necessary data with HM Revenue and Customs to enable us to reclaim the Gift Aid on your donation. This personal data may be stored by HM Revenue and Customs for the purposes of financial auditing.
– The plates are strictly not to be re-sold by the donor.
– The Royal Academy may suspend or decommission the production of the Grayson Perry plates as it may be required due to any event or occurrence which is outside the reasonable control of the Royal Academy including (but not limited to) pandemic, fire, flood, storm, strikes, riots, civil commotion, material disaster, war or acts of governmental authority. If this were to happen, your donation would not be returned to you, either wholly or partly.
– The donor will be responsible for the content or accuracy of any information provided to the Royal Academy. The Royal Academy will not be responsible, or liable to the donor or any third party, and reserves all rights in this regard.

Data Protection

– The Royal Academy will collect personal data about donors at the time of donation, and as otherwise provided in order to administer the donation.
– Donors will be receiving a plate designed by Grayson Perry CBE RA. Their personal data will be passed on, securely, to a third party for the purposes of the delivery of the plate.
– By participating and making a donation, donors are consenting to the use of their data in this way. The personal data of donors will at all times be managed by the Royal Academy in accordance with applicable data protection legislation and the RA’s Privacy Policy, which outlines how the RA manages personal data (https://www.royalacademy.org.uk/privacy). Donors may contact the Royal Academy at any time to update their details and/or preferences regarding permitted use of their personal data.

Delivery

– The plates are currently in production and will be dispatched within approximately four to six weeks. We'll get in touch if there are any delays to this process.
– There will be no additional costs for postage and packaging within the UK.

Summer Exhibition 2024 Terms and Conditions: selling your work

You are the seller of your artwork; the RA introduces you to the buyer via the Summer Exhibition and receives a commission for providing the service. All arrangements for the payment of the balance of the purchase price and collection or delivery of the artwork are made between you and the buyer.

Deposit

The buyer makes an offer to buy your artwork and pays a deposit to the RA in person, over the phone or via the RA website (if you’ve opted to sell your work online). Where the buyer is not present (i.e. is purchasing over the phone or online) the transaction is known as a Distance Sale and additional rules and regulations apply (please refer to the Terms and Conditions of Entry into the Summer Exhibition for full details). When the sale of your artwork is complete, the deposit becomes the RA’s commission.

Customer Due Diligence

The government has introduced new legislation that affects all art dealers, galleries and buyers. If a buyer purchases over £7000 worth of artwork at the Summer Exhibition over the course of 12 months, we are obliged to perform identity checks, similar to those made when an individual opens a bank account. Responding to the buyer

When the RA informs you that an offer to purchase your artwork has been made, you should contact the buyer immediately to accept and give them the following Key Information:

• Your business name and contact details
• A description of the work
• The total price of the work, including all taxes
• Details of how to pay
• Details of the buyer’s right to cancel (distance sales only)
• Delivery arrangements, including cost of delivery (if outside the UK)
• The timeframe for delivery/collection
• Your terms and conditions of sale
• Details of who pays the cost of return (distance sales only)

You should set out your agreement with the buyer in writing, by letter or email. If you are selling prints or casts from an edition that have not already been produced, or foresee that fulfilment will be delayed for any other reason (for example because your work is still exhibited in the Summer Exhibition), you must inform the buyer accordingly and obtain their agreement to the timeframe for delivery.

Invoice

You must supply an invoice to the buyer. On your invoice, you should show the total price of the work, the amount owing, the cost of postage and packaging (if the buyer lives outside the UK) and, if you are registered for VAT, your VAT number, the price net of VAT and the amount of VAT being charged.

If you are VAT registered and sending your work overseas, you should show your VAT number, but issue the buyer with a zero-rated VAT invoice. (This does not apply if the buyer is collecting the work from the RA.)

If the buyer lives outside the UK, they are the importer of record so must complete a customs declaration and pay local import duties where they live. You can elect to take on the responsibility, but will then need to register and account for VAT in the buyer’s country.

If you are based in the EU and selling a work from an edition of prints or sculptures to an EU buyer, you do not need to add UK VAT to your invoice, but must instead comply with EU VAT rules.

If you are based outside the UK and selling a work from an edition to a UK buyer, you must elect to be the importer of record and will need to complete a UK customs declaration form, pay UK duties and prepare UK VAT returns.

If you are based outside the UK and sell the work on display at the RA to a UK buyer, you must charge UK VAT and issue a VAT invoice as above. If you sell the framed work to a buyer located outside the UK, the work will be a zero-rated export from the UK. You must issue the buyer with a zero-rated VAT invoice.

Right to withdraw

Before you have contacted the buyer and agreed to the sale, the buyer has a right to withdraw from the purchase.

Right to cancel (distance sales only)

In addition, if the buyer has purchased your artwork by distance sale (by phone or online), they have a right to cancel their purchase at any time within fourteen days of receiving the artwork. Once they have informed you that they wish to cancel the purchase, the buyer has a further fourteen days to return the artwork to you. You must tell the buyer about this right to cancel: if you do not, you could extend the period in which they can cancel their purchase for up to 12 months.

You must also tell the buyer if they will be responsible for paying for the return of your artwork. If you do not, you will be liable for the cost.

Once the artwork has been returned and you are satisfied that it is in good condition, you should refund the buyer and notify the RA, so that we can contact the buyer and return the deposit.

Refunds

Please notify us straight away when you have agreed to refund a buyer.

If a buyer contacts us regarding a refund, we will check that you have released them from the sale before taking any action and refunding their deposit.

Once agreed, you should refund them within 14 days of their request.

Collection and delivery

You will receive a Removal Order for any work on display in the Summer Exhibition. If you sell a work that is on display, you should forward the signed Removal Order to the buyer once you have been paid, so that they can collect the work at the end of the Exhibition (dates are shown on the card). You may wish to make separate arrangements with the buyer, or they may send someone to collect the work on their behalf, but we will only release the work in exchange for the signed Removal Order.

Shipping, Postage and Packaging

For UK sales of unframed prints, you should have included postage and packaging in the retail price of the prints. For UK sales of any other work or, if the work is to be sent outside the UK, the delivery costs will be variable and you should reach an agreement with the buyer.

If you live outside the UK and will be fulfilling your orders from your place of residence, you should factor the cost of international postage and packaging into the retail price of your unframed prints or casts, as the likelihood is that the buyer will be based in the UK.

You are responsible for the work until it is received by the buyer and, unless otherwise agreed, should deliver it within 30 days of accepting the offer to purchase your artwork. If you do not, or delivery is later than any agreed period, the buyer is entitled to cancel their order and ask for a refund.

It is recommended that you use a service that will track the delivery of your artwork.

Wrapping for prints

We advise you to wrap your print with acid-free tissue paper, placing one sheet below and one on top of the work, before folding in the edges. Secure the tissue paper with masking tape so that the print does not slip or crumple. Use robust packaging and if the work is large, attach place holders to the packaging at the mid-way point of the edges. Secure the print to the inside of the packaging, ensuring that it does not move.

Certificate of Authenticity and Further Information

It is a good idea to include a certificate of authenticity with your work when you send it to the buyer. We suggest including the following:

Summer Exhibition 2024 Terms and Conditions: offer to purchase

All Work(s)

This Offer to Purchase is registered with the Artist who should, on receipt of the notification containing the Offer to Purchase, inform you that the Offer is accepted. In the unlikely event that the Artist does not accept the Offer, the RA will refund the Deposit. If you decide not to proceed with your purchase, you must inform the Artist or their representative and your Deposit may not be refunded. All arrangements for payment of the balance, collection, or delivery of the Work(s) are made between the Artist and you. If you reside outside the UK, you must bear the transportation and importation costs and complete a customs declaration. A VAT registered Artist is required to provide you with a VAT invoice. The RA will provide the Artist with your name, telephone number, email address and postal address. This is for the purposes of completing and fulfilling the purchase. By making an Offer to Purchase, you consent to the RA sharing your personal data in this way. The Artist is required to handle your personal information securely, confidentially and for the purpose of this transaction only, unless you agree to the information being used in another way. The RA will not have any liability to any person in respect of any incorrect information provided to it by you or the Artist.

Exhibited Work(s)

If your Offer to Purchase is accepted, it will be only on the condition that the Work(s) remains at the RA until after the Exhibition closes. The Work(s) will be available for collection on weekdays only from Wednesday 28 August to Wednesday 18 September (8am to 4pm) and for one Saturday only on 7 September (9am to 4pm) and will only be given out by the RA on presentation of the official Removal Order duly signed by the Artist or the Artist’s representative.

Money Laundering Regulations

In 2020, the government introduced new legislation that affects all art dealers, galleries, and buyers. Before the Royal Academy passes high-value orders onto Artists, we are obliged to make identification and screening checks on you as a purchaser, like those carried out by banks when you open an account. Any Offer to Purchase is subject to satisfactory completion of these checks.
