Dear Esteemed Member Exporters, It gives me immense pleasure to present you this 49th Annual Report of the Council for the year 2011-12.

Overview of Global Chemical Industry:

The world chemical industry is estimated to have reached Euro2353 billion (~ US$ 3127 billion) in 2010. The Asian region has emerged as the largest contributor to the global chemical industry, accounting for nearly half the global sales (Euro 1147 billion) followed by Europe (Euro 578 billion). Individually, China was the largest market for chemicals with sales aggregating to Euro 575 billion, followed by USA (Euro 395 billion), Japan (Euro 153 billion), Germany (Euro 142 billion) and France (Euro 76 billion). India, with sales of Euro 56 billion was ranked the eighth largest market in 2010. International trade in chemical products has witnessed a continuous rise with global exports of chemicals recording an average annual increase of 6.2% during 2006-2010 to amount to US$545 billion in 2010 as compared to US$451billion in 2006. USA was the largest exporter of chemicals with exports aggregating US$ 63.9 billion, followed by China (US$ 49.3 billion), Germany (US$ 48.2 billion), Belgium (US$ 36.6 billion)_ and Japan (US$ 31.6 billion). However, in terms of dynamism in exports, it was led by the emerging market of Asia Pacific, Middle East and Africa. While the average annual increase in exports from Asia-Pacific region was 11.9% during the 2006-2010 period, it was as high as 21.9% each in the case of Middle East and Africa. Consequently, the shares of these regions in world exports of chemicals registered a consistent increase.

The World has witnessed that Asia is the fastest growing Region in the World. However, Africa has superseded all the region of the World in terms of Average GDP growth rate. The fastest growing country in the world is Angola and not China. The importance of the Economies of Brazil Russia India China & South Africa (BRICS) is growing in the global economy, on a continuous basis.

The Indian Chemical Industry:

The Indian Chemical Industry has witnessed a robust growth in the past decade and has been ranked 5th largest in Asia as per the Exim Bank studies. The industry is forecasted to reach USD 200 billionmark by 2020. The industry accounts for about 10% of the output of the Indian manufacturing sector,

13% of Indias total exports, and 9% of the countrys total imports. In terms of segmentation, basic chemicals is the largest sector with total revenues estimated at US$ 43 billion, equivalent to about two-third of the industrys overall value in 2010. Within this, the contribution of small and medium enterprises (SME) in terms of production of the chemical sector is estimated to be as high as 40% an indication of the signification of SMEs, and as a corollary, the importance of this sector in employment generation. India has traditionally been a net importer of chemicals, a situation which can be reversed with sustained efforts from the industry backed by an enabling policy mix from the Government . The industry needs to look beyond the domestic shores in a more proactive manner. In this context, an adoption of a two pronged approach that would entail market diversification and expansion along with mapping of international demand for chemical products so as to identify an ideal product market strategy mix needs to be undertaken. Strong domestic demand, driven by increasing purchasing power parity in the country, is one of the main pillars of the Indian Manufacturing sector, and India is expected to maintain a healthy growth in the years to come. Indias geographic location provides easy access to the world markets; and lowcost advantage, availability of talent and skilled manpower make India the destination of choice. The Indian Government is rendering extensive support to give impetus to the Indian Chemical Industry and has set up the Task Force to consider suggestions for National Chemical Policy to ensure steady growth of the countrys chemical sector. India is 13th largest country in terms of ethylene capacity and envisages enhancing the refining capacity to 300mm tpa in 2017 from the current 190mm tpa. India is emerging as Asias refining hub and has become the net exporter of petrochemicals to countries like the Middle East, Korea, Japan and Singapore. Indian Government has set ambitious plans to set up Petroleum, Chemicals & Petrochemicals Investment Regions (PCPIR) in Gujarat, Andhra Pradesh, West Bengal and Odisha to accelerate the countrys industrial growth. The Indian Government has earmarked substantial funds to achieve healthy growth of the countrys upstream and downstream sectors of the chemical industry. During the 11th Five-Year Plan, the Indian government reserved INR 0.626 trillion for refining and marketing sectors and increased that to INR 1.54 trillion during the 12th Five-Year Plan. Chemicals sector has attracted a cumulative FDI of USD 192 million in 2009-10. Inorganic Chemical Industry is growing at approximately 9% p.a. Dyes & Dye Intermediates market is expected to reach 1200 kt by FY-15 Agrochemicals Industry is largely exports-driven with over 60% of exports to U.S.A., U.K. , Russia, EU, South Africa, Bangladesh, Malaysia. Aromatics & Olefins markets to grow at 15% & 10% p.a. respectively over the next 4-5 years. Paints and Coatings Industry is projected to grow at the rate of 11-14% in the next five years. Domestic Specialty Chemical Industry is expected to grow at 15%, almost double the growth of global industry; exports to touch USD 13 billion in 2013. On the above background in order to propagate Brand India Image CHEMEXCIL had organised following events under Market Development Assistance (MDA) and Market Access Initiative (MAI) given by Ministry of Commerce & Industry, Govt. of India.

Some of the major points discussed/decisions taken in the above meetings are listed below :

In order to strengthen the Membership of the Council, the Council should tie up with Local Industrial associations/organizations by holding Awarness Seminars/ Workshops. Committee approved the budget of the Council for the year 2011-12 and also calendar of event to be undertaken by the Council during the same period. Approved Annual Action plan under MDA for the year 2011-12 and also decided to Organize two mega events under Market Access Initiative Scheme. Approved events for 2012-13 under MDA and MAI. Taken up the problems faced by member-exporters with DGFT, Ministry of Commerce & Industry, Customs and Central Excise, Port authorities etc.

Announced results of newly elected members of the CoA for the years 2011-12 and 2012-13 who have been elected unopposed. Discussed about Import duties on raw materials and a presentation was made to the DGFT. Exports of Dyestuffs would grow by 25-30% per year provided Dyes & Dye Intermediates are declared as Focus Product.

10. Suggested that DEPB should be extended till March 2012. 11. Government of India should give little more push to Green chemicals based on Ethanol which can be feed stock for many organic chemicals which has good export potential. 12. Suggested that Government should also allow importation of Urea and MoP freely to the endusers/ actual manufacturers of pigments. 13. Considering the focus on how India can double the exports, it was suggested that those SMEs who would like to upgrade their technology, Government should give subsidies, or offer interest free loans to them so that they can upgrade technology. 14. Discussed problems faced by the manufacturers specially on packaging materials, high cost of transportation, shipping lines, lack of coordination between Excise, Customs, DGFT and Banks.

15. Reviewed CHEMEXCILs Strategy 2011-2015 for doubling of Exports by the MoC&I 16. Suggested that DEPB Scheme and SHIS should continue for the whole of Policy period 200914 and in case the same is not agreed, at least continuation of DEPB Scheme should be linked to introduction of GST (Goods and Services Tax) in the country . 17. Discussed on the anomalies in MAI grants given by Ministry of Commerce to SMEs and Small & Micro manufacturers / exporters for REACH Registration and noted that Whatever improvement required on funding of MAI will be looked into by the MoC&I. 18. Suggested the need to interact with manufacturers exporters of chemicals to EU individually to understand their problems in complying with REACH properly and advise them , which would help to double our export target. 19. Noted that there is no role for ECHA in the contents of agreement between an OR and its Client. 20. Noted that ECHA has come out with the latest notification, according to which, they will accept the data of GLP certified laboratories from countries which are OECD Member States or full adherents to the OECD Mutual Acceptance of Data (MAD) system . 21. Suggested to have interface between CHEMEXCIL and the Ministry Officials and meet them on a regular basis either on monthly or bi-monthly basis to take up issues of our member-exporters. 22. Noted that ASIDE is a good source of mechanism and the Commerce Ministry has close to around Rs.1000 crs which is provided by them for common infrastructure.

REACH
CHEMEXCIL has taken up the issue of disbursement of MAI grant under REACH to those Manufacturers who had registered their substances during the 1st Phase of Registration deadline, i.e. 2010. So far, Applications for disbursement claims of 24 firms whose 57 substances have been registered during the said deadline, have been forward to the Ministry of Commerce & Industry recommending 50% of ECHA fee to all (irrespective of Large, Medium,Small & Micro) and 50% LoA cost to Medium Scale Manufacturers and 80% LoA cost to Small & Micro Scale Manufacturers [keeping the value cap for each exporter for ECHA Registration fee upto Rs. 50 lakhs per annum as per para 7.3.1 of the MAI guidelines and our proposal recommending a value cap of Rs. 10 lakhs per product for a maximum of 5 products or upto Rs. 50 lakhs per Company (i.e. Medium, Small & Micro Scale manufacturers)].

Since the Empowered Committee of the Ministry of Commerce & Industry has sanctioned MAI grant under REACH only to Small & Micro Scale Manufacturers, the Council has again taken up the issue with the Ministry of Commerce & Industry requesting to consider data cost involving toxicological/ ecotoxicological studies for Chemicals also on par with clinical studies for all categories of firms, irrespective of Large, Medium, Small or Micro Enterprises. Outcome of our letters to the Ministry is awaited.

The European Chemical Agency (ECHA) has come out with a Notification, according to which, they will accept the data of GLP certified laboratories from countries which are OECD (Organisation for Economic Co-operation and Development) Member States or full adherents to the OECD Mutual Acceptance of Data (MAD) system, thus avoiding the duplication of animal testing. REACH Regulation requires that ecotoxicological and toxicological tests and analyses are carried out in compliance with the principles of GLP.

Central Excise :
During the year 2011-12, the Council had received 25 representations from our member-exporters on various problems faced by them. We have scrutinized the cases and strongly recommended them to the respective offices of Central Excise in Mumbai.

Customs :
During the year 2011-12, the Council had received 7 representations from the member-exporters on various problems faced by them on Customs. The same have been suitably recommended to the respective Departments of Customs from time-to-time.

Council takes up grievances of exporters in the Grievance Committee meetings being held from time to time. The Council circulates Trade Notices/Customs Notifications etc. from the above departments to our member exporters from time-to-time.

Trade Disputes :
The Council attends to trade disputes (viz Non-payment of overseas commission, supply of substandard materials etc.), and makes its efforts to settle the same amicably with the help of Indian Missions. Wherever settlement could not be arrived at, such cases were referred to the Trade Dispute Settlement Cell in the DGFT, New Delhi. During the period under review, Council processed 7 cases of Complaints/Arbitrations.

EXPORT ASSISTANCE :
The Council received following applications for fixation of DEPB, enhancement of DEPB, Fixation of adhoc Norm, Fixation of Input Output Norms etc., from the member exporters. INTERNATIONAL TENDERS AND TRADE ENQUIRIES

Overseas trade enquiries received through Faxes/letters/Emails both from potential importers/Indian Missions directly were disseminated by Email/mass mail to the appropriate manufacturers. During the year CHEMEXCILs Bulletins were sent to all members of the Council by Email/post.

CERTIFICATE OF ORIGIN:
A number of Member-Exporters had approached the Council for issuance of Certificate of Origin and Attestations on connected documents like Export Invoice in respect of different products exported by them to various overseas countries. The Council scrutinized the applications received from these member-exporters and issued certificates accordingly. During the year under review, 190 Certificates of Origin were issued to the member-exporters.

RECOMMENDATION LETTERS FOR VISA:

A number of applications were received by the Council from the Member-Exporters for recommendation letters to overseas missions located in India for issuance of Visa. The applications were duly scrutinized and recommendation letters totaling 545 were issued to Embassies/ Consulates & High Commissions.

LIBRARY:
The Council has been maintaining Trade Information Library having collection of Technical publications (viz. United State Pharmacopoeia, British Pharmacopoeia, European Pharmacopoeia, Hand Book of Chemical Technology, Colour Index, Merck Index, Martindale Extra Pharmacopoeia, Kirk Orthmer Encyclopedia and other informative Books on Dyes, Cosmetics, Chemicals, Essential Oils and Medicinal Plants). The Council also maintains Various Indian/ International Magazines received from different Associations and Organizations for reference purpose of Member Exporters as well as to the visitors. During the year under review, a number of parties visited the Councils Library. Services of the Councils Library are also utilized by Member Exporters, Research Students, Overseas Buyers, new entrepreneurs etc.

EXPORT PROMOTIONAL ACTIVITIES OF REGIONAL OFFICES DURING APRIL 2011 TO MARCH 2012

AHMEDABAD :
Sl. No. 1 2. Activities/Events RBSM coincided with India Chem Gujarat 2011 at Mahatma Mandir, Gandhinagar; from 13th to 15th October, 2011. Co-organized Asia Interdye in Ahmedabad from 8th - 10th December 2011. Round about 112 distinguished exhibitors from the world of Dyes, Pigments m Textile Chemical Industry form China, Taiwan, Singapore, U.K. and India met under one Roof. About 3,400 professional visitors including International visitors from Pakistan, Turkey, Iran, Bangladesh and Brazil visited the exhibition. During this event, an Memorandum of Understanding (MOU) was signed by Mr. Satish Wagh, Chairman- CHEMEXCIL and Mr. Najamuddin Chughtai, Chairman- PCDMA (Pakistan Chemicals & Dyes Merchant Association) in the presence of Mr. Maheswar Sahu, Principal Secretary (Industry and Mine),Govt. of Gujarat and Mr.K.Jose Cyriac, Secretary, Dept. of Chemicals & Petrochemicals, Ministry of Chemicals a & Fertilizers, Govt. of India. 3. Participated in The India Show organized by FICCI in collaboration with Ministry of Commerce & Industry, Government of India held at Lahore, Pakistan from 11th - 13th February 2012. Work carried out for CHEMEXCIL Institute from October 2011 to February 2012. The Councils officers visited Ankleshwar, Vatva, Vapi and Bardoa industrial Area. * Indian Chemical Exhibition in Kuala Lumpur , Malaysia from 13th & 14th March 2012. Total 40 Member Exporters participated in this exhibition. * Organised Buyer Seller Meet in Sydney, Australia. On 16th March 2012. 6 Attended Grievance meetings held at DGFT office regularly.

RCMC
During the period under review, the Regional Office has issued 107 Fresh RCMC, renewed 129 RCMC and incorporated 52 Amendments.

SAPTA/ CERTIFICATE OF ORIGIN

During the period under review, the Regional Office has issued 39 Non Preferential Certificate of Origin.

BANGALORE :
During the period under review, the Regional Office of the Council provided effective service to the member exporters of the region on the export forefront in close co-ordination with other Government bodies, Trade Associations, Chambers of Commerce and Industry and other organizations connected to export trade. The following are the major activities of the Regional Office during the review period.

Activities/Events The Regional Officer was entrusted with a project namely Dye + Chem Bangladesh International Exhibition held at Bangabandhu International Conference Centre, Dhaka, Bangladesh from 20-23rd July, 2011. The preparatory work prior to the Exhibition was done and 16 member exporters confirmed their participation. The Regional Officer attended a program Industry Consultation on Sectoral Tariff Negotiations in WTO with special focus on issues relating to import tariff reduction in select sectors on 8th June, 2011 organized by FICCI in association with other Export Promotion Councils. An Export Management Training Program was organized by VITC & FKCCI at Capitol Hotel on the 17th October, 2011 which was attended by the Senior Assistant. A Trade Meet was organized by New Mangalore Port Trust in association with FKCCI on the 9th December, 201 at Crescent Hotel, Bangalore. Dr. P. Tamilvannan, Chairman, New Mangalore Port Trust addressed the gathering. The program was attended by the Senior Assistant. A workshop on Export incentives application procedure, was jointly organized by FIEO and VITC on the 16th Dec, 2011 at Bangalore. The entire program was designed to focus awareness amongst the business community by imparting requisite knowledge. The program was attended by the Senior Assistant. The Senior Assistant represented the Council at the State Level Export Award function organized by Department of Industries, Government of Karnataka on 21st March, 2012

During the period under review, a number of visitors called on the office and sought clarification on various export related matters. These visitors were promptly attended and their queries suitably clarified. The Regional Office also disseminated information relating to MDA /MAI schemes to memberexporters and urged them to participate in council sponsored events. Member-exporters/ new entrepreneurs visiting the Regional Office were briefed on the role of the council in the export front and assisted in locating overseas buyers / indigenous sourcing. In concurrence with a decision taken by the Councils Secretariat to increase the membership of the Council, the Regional office initiated a sustained action plan which resulted in addition of 39 new members. During the review period, the Regional Office of the Council ensured submission of monthly statement of accounts for the funds received from Head Office and amount expended with supporting documents including Bank statements. During the period under review, the Regional Office mass mailed various circulars issued by the Head Office in respect of export promotional events to all members and ensured successful implementation of the projects. This apart, the Regional Office attended the Grievance Committee/Facilitation Committee meeting from time to time and represented the grievance of the member-exporters.

REGISTRATION
The Regional Office received 80 applications for issue of registration cum membership certificate out of which 39 applications were for fresh issue and balance 41 for revalidation. All the applications were duly noted and processed and registration certificate were issued promptly. The Regional Office also issued Certificate of Origin to member exporters.

KOLKATA :
During the period under review, the Regional Office of the Council maintained a close rapport with different Government bodies, Trade Associations, Chambers of Commerce and Industry and other organizations related to Export Trade and provided effective service to the member constituents of this region. The following are the activities of the Regional Office during the review period.

REGISTRATION CUM MEMBERSHIP CERTIFICATE

During the review period the Regional Office received 23 (Twenty three) applications for issue of RCMC/Renewal. It was duly noted in the register, scrutinized and processed before issuance. During the period communication was also sent to registered exporters holding valid registration certificate to renew their membership with the council so as to retain the validity of the RCMC. A number of registered exporters renewed their RCMC on its expiry.

VISITORS DETAILS
During the period under review, a number of visitors called on the office and sought information relating to exports. These visitors were courteously attended and their queries suitably clarified. Assistance was given to the intending exporters in regard to locating overseas buyers/indigenous sourcing etc. The intending exporters were also assisted with Statistical data wherever product specific export potentiality was desired. This apart, the role of the council and the Government Schemes viz. MAI / MDA were also emphasized. The visitors were also highlighted about the Calendar of events of the Council throughout the year. As regards member-exporters, who are unable to locate markets for their product, necessary assistance was given about the market and mode of approach too.

MEMBERSHIP OF THE REGION

Concerted efforts to mobilize new members yielded 8 new members during the period under review.

STATISTICS
During the period under review, the Regional Office collected the monthly statistics of Foreign Trade (Principal Commodities and Countries) from the Office of the Directorate General of Commercial Intelligence and Statistics, Kolkata regularly and forwarded the same to Head Office. Till date the Monthly statistics (principal countries /commodity up to December 2011 have already been sent to Head Office. The Regional Office of the council also interacted with the Office of the DGCI&S Kolkata in regard to the yearly data provided by them and have already given the code wise list of products coming under the purview of the council so as to enable them to generate export/import data for Councils basket of items more precisely. It is expected that henceforth Council will be provided with data both import and export for the Councils items. A meeting of all Epcs with Dr. Dipankar Sinha Director General

was held in presence of Shri A.K. Arora, Dy. Secretary, Ministry of Commerce, Government of India, New Delhi in regard to issues relating to data dissemination. Council was represented by Shri Raju Verghese, Section Officer, Mr. H.K. Pandey, Section Officer and the Regional Officer. Council informed the Director General on issues relating to classification/codification of commodities under Chapter 15 and 29 and requested to examine the same. Further, it was noted that there were some anomaly in the Monthly Statistics provided by DGCI&S, Kolkata. The Regional Officer had taken up the matter with the Director DGCI&S and pointed out the discrepancy. We have since received a communication from Dr. Amitava Saha, Director DGCI&S that the data from April 2011 are being revised as there has been some downward revision and the revised data would be provided in due course.

STATEMENT OF ACCOUNTS
The Regional office ensures submission of monthly statement of accounts showing the funds received and expended supported by relevant cash memos and vouchers. A statement of accounts for the respective months obtained from our Bankers is also appended to the Statement.

MEMBERSHIP RENEWAL COLLECTION INITIATIVE

In order to ensure maximum collection of membership renewal from the members of this region, the Regional Office initiated a massive mass contact programme of contacting individual memberexporters of the region. Circulars and letters were issued to individual members and regular follow up action was done. This exercise yielded quite encouraging response and membership renewal collections were received at the Regional Office Kolkata. The membership renewals collected at this office were duly recorded in the register separately maintained for the purpose and the cheques/ demand drafts as the case may be were sent to Head Office for their further action. As on date the Regional Office had forwarded to Head Office an amount of RS 6.00 lakhs approximately excluding membership and entrance fees received from new members enrolled. A detailed list showing the membership renewals collected by the Regional Office was also sent.

In order to ensure timely renewal of membership / registration certificate, this office had issued a circular to members whose registration expired on 31.3.2012.

EXPORT PROMOTIONAL ACTIVITIES

Regional Office is constantly on the look out to organize export promotional programmes for the benefit of the member exporters of this region. During the review period, Regional Office, Kolkatta was assigned an overseas project work relating to Dye + Chem Bangladesh Exhibition in the month of July 2011. The Regional Office undertook the task of mobilizing participants for the above Exhibition and could garner a 16 participants for the Exhibition. The undersigned was deputed by the Councils Secretariat to attend the Exhibition. An exhaustive report along with trade enquiries collected from Bangladesh was sent to Councils Head Office. The Regional Officer was also entrusted with another project, namely Agri Intex organized by CODDISIA, at Coimbatore. Council had booked a stall in the exhibition and the Regional Officer was deputed to attend the same. A detailed report along with trade enquiries received was sent to Head Office for circulation.

During the review period the Regional Officer was transferred to Bangalore and assumed charge on and from 1st June, 2011. The Regional Officer contacted all the members of the Southern Region and interacted with them on various matters concerning exports. The Regional Office mass mailed circulars issued by the Councils Secretariat to the members of the region and put concerted efforts in mobilizing participants for successful implementation of various projects undertaken by the council. Activities / Events Regional office is also helping our Member Exporters in getting their documents attested / legalized from Ministry of External Affairs and Embassies of respective countries for the registration of their products abroad. In addition to above regular follow-ups were made and meetings were held with officials of various Ministries regarding Policy Matters, Grievances of Member exporters relating to EXIM POLICY, DEPB, SION, Duty Drawback, Customs and Central Excise related issues etc. Efforts were made to increase our Membership base and 25 New Members have been added during the year 2011-12. Besides this regular followups were made with existing members for renewal of their RCMCs. Regional office participated in various Sub-Committee / EC meetings held in the Ministry of Commerce for approval of Projects under MAI. Follow-ups were made regularly during the year with various departments / Sections in the Ministry of Commerce (EP-CAP, E&MDA, Finance, Pay & Accounts etc) for release of MDA & MAI Grants and Settlement of accounts.

To, The Members Basic Chemicals, Pharmaceuticals and Cosmetics Export Promotion Council (Limited by Guarantee) 1. We have audited the attached Balance Sheet of BASIC CHEMICALS, PHARMACEUTICALS AND COSMETICS EXPORT PROMOTION COUNCIL (Limited by Guarantee) as at 31st March, 2012 and also the Statement of Income and Expenditure of the Council for the year ended on that date annexed thereto. These financial statements are the responsibility of the Committee of Administration of the Council. Our responsibility is to express an opinion on these financial statements based on our audit. We conducted our audit in accordance with auditing standards generally accepted in India. Those Standards require that we plan and perform the audit to obtain reasonable assurance about whether the financial statements are free of material misstatement. An audit includes examining, on test basis, evidence supporting the amounts and disclosures in the financial statements. An audit also includes assessing the accounting principles used and significant estimates made by the Committee of Administration, as well as evaluating the overall financial statement presentation. We believe that our audit provides a reasonable basis for our opinion.

We draw your attention to: a) Note no.1.7 (b) regarding Council policy of accounting of Grant- in-Aid on receipt basis and Note no. 18.3 regarding adjustment as may be necessary on Government audit observations/ non partial fulfillment of certain eligibility conditions, in respect of such grant received / utilized from time to time. Read together with what is stated in Note no.1.7 (b) regarding Councils policy of accounting of Grant-in-Aid on receipt basis, in our opinion, proper books of account as required by Law, have been kept by the Council so far as it appears from our examination of those books and proper returns adequate for the purposes of our audit have been received from the regional offices not visited by us. The Balance Sheet and Statement of Income and Expenditure dealt with by this report are in agreement with the books of account and returns from the Regional Offices. The Balance Sheet and Statement of Income and Expenditure have been prepared in compliance with the Accounting Standards referred to in Section 211 (3C) of the Companies Act, 1956 (hereinafter referred to as the Act), to the extent applicable. In our opinion, the internal control procedures and internal audit system need to be strengthened to be commensurate with the activities of the Council including that the Council needs to regularise its statutory compliances; to have the Information Systems Audit to ensure the security, authenticity etc. of the various data, documents and records maintained

by the Council and disaster management of the data .[Refer Note No.18.11(a),(b) & (c) of Notes to Financial Statements] f) In our opinion and to the best of our information and according to the explanations given to us, the said accounts subject to our comments at paragraph 3(a) & (e) above, the impact whereof on the financial statements is presently not ascertainable and read with Note No. 18.10 (a) regarding pending confirmations, reconciliations and adjustments, if any in respect of certain receivables, payables and advances as appearing in Note No. 18 Notes to Financial Statements and other sub-notes included in the schedules (Notes) and those appearing elsewhere in financial statements give the information required by the Act, in the manner so required and give a true and fair view in conformity with the accounting principles generally accepted in India:

In our opinion, Section 227 (3) (f) of the Act, in respect of reporting on disqualification of Directors as provided under Section 274 (1) (g) of the Act, is not applicable to the Council, there being no Directors and the Council is registered under Section 25 of the Act and managed by the Committee of Administration. As the Council is registered under Section 25 of the Act, the clauses under the Companies (Auditors Report) Order, 2003 are not applicable and hence, not reported.

Notes forming Part of Financial Statements
1. 1.1 SIGNIFICANT ACCOUNTING POLICIES: Company Information: The Council is registered under section 25 of the Companies Act, 1956 with the objective of promoting export activities in specified industries such as organic and inorganic chemicals, dyes, cosmetics and other allied products. 1.2 General: a) The financial statements are prepared on the basis of historical cost convention, in accordance with applicable accounting standards and on the principle of a going concern. All income and expenses to the extent considered receivable and payable, respectively with reasonable certainty are accounted for on accrual basis. Membership subscription which remains unpaid as at the close of the year is not accounted for except the amount actually received out of such unpaid subscriptions approximately one month prior to the approval of the financial statements by the Committee of Administration. Entrance Fees receipts are credited to General Reserve. Library books are charged to Income & Expenditure Account in the year of purchase.

d) e) 1.3 Use of Estimates: The preparation of financial statements is in conformity with Generally Accepted Accounting Principles (GAAP). It requires Management to make estimates and assumptions that affects the reported amounts of assets and liabilities and the disclosure of contingent liabilities on the date of financial statements and reported amounts of revenue and expenses for that year. Actual results could differ from these estimates. Any revision to accounting estimates is recognized prospectively. 1.4 Fixed Assets (Tangible and Intangible): Fixed Assets are stated at cost of acquisition less accumulated depreciation/amortisation without any adjustment for Government Grant received, if any, for their purchase. 1.5 Depreciation/Amortisation and Impairment: a) Depreciation on Fixed Assets is provided on written down value method at the rates and in the manner as prescribed in Schedule XIV to the Companies Act, 1956 (hereinafter referred to as the Act). Impairment of Assets: i. The Council assesses the carrying amount of assets at each Balance Sheet date to determine whether there is any indication of impairment. If such indication exists, the council estimates the recoverable amount of the assets. The recoverable amount is estimated as the higher of the net realizable value and the value in

use with an impairment loss being recognized whenever the carrying amount exceeds the recoverable amount. ii. A previously recognized impairment loss on assets is reversed if there has been a change in the estimates used to determine the recoverable amount, however not to the extent higher than the carrying amount that would have been determined had no impairment loss been recognized in prior years.

Investments: Non-current Investments are stated at cost less provision made for permanent diminution in their carrying value.

Revenue Recognition: a) Contribution from Members: Contributions receivable from Members for participation in Exhibition, Delegation, Seminar, Pre-Registration, Late Pre-Registration and Annual Maintenance Fees are recognized as income as and when the respective activities are completed and/or on receipt basis in view of uncertainty. The cost of Publications of the Council is charged to Statement of Income and Expenditure in the year of incurrence of such expenses and the income in respect of the same is taken into account as and when their sale is effected. b) Government Grants: Grants from Government are credited to Income and Expenditure Account on receipt basis as it is not possible to ascertain, the quantum of Grant receivable from/refundable to the Ministry of Commerce and Industry with reasonable certainty/accuracy.

Transaction in Foreign Currency: Transactions in foreign currency are recorded at the rate of exchange in force at the time of occurrence of the transaction. Monetary - Current assets and current liabilities in foreign currency at the year-end are stated at the rate of exchange in force as on that date and the resultant gain / (loss) is recognized in the Income and Expenditure Account.

Employee Benefits: a) b) c) Contribution for Provident Fund (based on a certain percentage of salary) is funded into an approved Trust. Gratuity is charged to Income and Expenditure Account on the basis of actuarial valuation as at the year end and funded into an approved Trust. Leave Entitlement Benefits are provided for on accrual basis as per the Councils rules.

1.10 Provision and Contingent Liabilities: a) Provisions are recognized for liabilities that can be measured only by using a substantial degree of estimation, if a. b. c. The company has a present obligation as a result of a past event; A probable outflow of resources is expected to settle the obligation; and The amount of the obligation can be reliably estimated.

Where some or all of the expenditure required to settle a provision is expected to be reimbursed by another party, such reimbursement is recognized to the extent of provision or contingent liability as the case may be, only when it is virtually certain that the reimbursement will be received. Contingent liability, if material, is disclosed in the case of: a. b. A present obligation arising from a past event, when it is not probable that an outflow of resources will be required to settle the obligation. A possible obligation, unless the probability of outflow of resources is remote.

18. Notes to Financial Statements: 18.1 The Council has been registered as a Company under the provisions of the Companies Act, 1956 (hereinafter called as the Act). By virtue of the licence granted to the Council by the Central Government under Section 25 of the Act the word LIMITED is not required to be suffixed to its name. Further, the Council is continuing to hold the registration certificate under Section 12AA of the Income Tax Act, 1961. Even after the amendment in Section 2(15) of Income Tax Act, 1961 modifying the meaning of the word Charitable Objects and Public Utility Services, the assessment of the Council has been done under scrutiny for the assessment year 2009-10 during the current financial year, wherein no demand of income tax has been raised on the council. Relying upon the assessment order, no provision has been made in financial statements for the current financial year and in respect of earlier financial years.

18.2

The Council is occupying premises at Jhansi Castle (5th Floor), Mumbai as a tenant since 1971. It has filed a suit in the Civil Court for non-acceptance of rent cheques by the M/s Prakriti Trading Co. Private Limited since May,2008 (as also questioning their ownership) and allowing the Council to deposit the rent cheques in the Court. An amount of ` 1,800,279 is lying in the stale cheques account included in Current Liabilities Note No. 4 hereof. The expenses in respect of code-activities are subject to sanction / confirmation of the Government of India and Grant-in-aid received from the Ministry of Commerce and Industry is subject to adjustments in the light of Government Audit observations, non/ partial fulfillment of certain conditions for eligibility of such Grant-in-aid, clarifications by the Council and final decision of the Ministry. The Council classifies its expenditure in accordance with the format suggested by Ministry of Commerce and Industry, Government of India. Pursuant to the approval by the Ministry of Commerce and Industry for grant of Marketing Development Assistance (MDA) to individual exporters under certain eligible schemes, the Council has during the year received ` 32,678,000 for 2011-12 (Previous year ` 30,000,000) and reimbursed to the members ` 16,842,236 and un-utilized grant in aid of previous year ` 13,429,759 refunded and the balance amount ` 23,796,442 (Previous Year ` 21,281,787) is being disclosed as Amount due to members under Current Liabilities. ` 152,463 (Previous Year ` 408,463) being the amount of membership subscription receivable as on 31st March, 2012 and received subsequently up to cut-off date (27th July 2012) has been included in the Trade Receivables. During the year, ` 50,000 was paid to Directorate General of Commercial Intelligence & Statistics (DGCI & S) for obtaining import-export statistics of Councils items to be supplied by them as and when asked for by the Council and was debited to Books &

Periodical Account. An aggregate balance of ` 62,016 (Previous year ` 17,176) as at the year end is still lying with them which would be utilized in due course of time. 18.8 Pay and Allowances in Note 16 Establishment Expenses includes ` 287,527 (Previous year ` 155,386) being payments made to certain persons employed on consolidated pay basis/contract. The Company has not received any intimation from suppliers regarding their status under the Micro, Small and Medium Enterprises Act, 2006 and hence disclosure, if any, relating to amounts unpaid as at the year-end together with interest paid/payable as required under the said Act has not been given.

18.10 a) The accounts of certain Receivables, Payables & Advances are subject to confirmation, reconciliation and adjustments, if any, having consequential impact on the surplus for the year, assets and liabilities, the amount whereof is presently not ascertainable. The management, however, does not expect any material difference affecting the current years financial statements. In the opinion of the Committee of Administration, the assets other than Fixed Assets and non-current investments are approximately of the value stated, if realized in the ordinary course of business unless otherwise stated. The provision for depreciation and other known liabilities is adequate and not in excess of what is required.

18.11 a) Presently, Internal Audit System is not commensurate with the activities of the Council, however the same is in the process of being strengthened in terms of intensity of verification and various reconciliations. Internal Control System is in the process of being strengthened including in respect of statutory compliances and secured information technology system. Physical verification of fixed assets at its registered office and regional offices were not carried out during the current financial year. However, the same was conducted in the month of July, 2012 and no discrepancies were noticed. The management has not come across, noticed or reported during the year any instance of fraud on or by the Council. The Council has taken various commercial premises under cancelable Operating Leases. The Lease Agreements are usually renewable by mutual consent on mutually agreeable terms. The rental expenses in respect of Operating Leases are charged as rent under Note 17-Other expenses.
