Terms and conditions associated with the
American Physical Society Grant of Publication Rights

Subject to the terms and conditions set out herein, and to the acceptance of the Article for publication in a journal of the APS, the Controller of Her Majesty's Stationery Office, London, hereby grants to the APS the following non-exclusive and perpetual worldwide rights and license to:

  1. Publish the original and unpublished Article, any associated supplemental material, and subsequent, if necessary, errata, including the abstract forming part thereof in the [above] identified Publication. In addition, the Employer grants to the APS the right to publish and sell the Article in all media, including print, electronic, microfilm and other formats that may be developed, and to use the Article in conjunction with computer systems and/or programs including reproductions or publications in machine-readable form and/or incorporation in retrieval systems.
  2. Reproduce and authorize reproduction of the Article in whole or in part by others, including reprints and photocopies.
  3. Permit document delivery services and abstracting and indexing services to include the Article in whole or in part in their services.
  4. Translate, or have translated, the Article into any language and to publish the Article as translated.
  5. The APS recognizes the retention by the Employer of copyright, patent and trademark rights or rights to any process or procedure described in the Article.
  6. The rights and license granted herein to the APS shall be for the full term of copyright and may be exercised at the sole discretion and election of the American Physical Society and without reference, consent of, notice, or payment either to the authors, the Employer, or the United Kingdom Government or to Her Majesty's Stationery Office.
  7. The Employer agrees that credit to the Journal, the Article and the APS will be given where appropriate. The Employer represents and warrants that it has the full right, power, and authority to enter into this license agreement on behalf of the Authors and their employers and on behalf of the United Kingdom Government and the Controller of Her Majesty's Stationery Office, London and that the American Physical Society’s exercise of any rights granted to it pursuant to this license agreement will not infringe, violate, or conflict with the rights of any third parties.
  8. The Employer warrants that the Article contains no libelous or other unlawful statements, and does not infringe on the rights of others. If excerpts from copyrighted works are included, the Employer has obtained or will obtain written permission from the copyright owners prior to publication and will credit the sources in the Article. The American Physical Society may assign any or all of its rights herein in whole or in part at its sole discretion and election without notice to the Employer, the Authors, or the United Kingdom Government, or Her Majesty's Stationery Office.
  9. If the Article was prepared jointly with other authors, the person signing [hereunder] on behalf of the Employer is signing as the agent for those authors who are employed by the Employer or the United Kingdom Government. Appropriate permissions should be sought separately from all other authors.
