Can my granddaughter quit her tenancy if her housemate stays on?

Q. I am guarantor for my granddaughter’s 12-month assured shorthold tenancy agreement. She has given notice to leave at the end of the tenancy but the other tenant wants to stay on. Do both tenants have to give notice?

A. Most assured shorthold tenancies are granted for fixed initial periods — 12 or 24 months, typically. Strictly speaking, tenants do not have to give notice to end their tenancies at the end of this period. But if they stay on, their tenancies are converted into assured shorthold periodic tenancies under section 5 of the Housing Act 1988. After that, the tenants remain liable for all the rent until the tenancy is ended, either by the landlord or the tenants.
