Mobile: You can listen to 5 Live on your smartphone if you visit http://www.bbc.co.uk/5live via your mobile browser. Our mobile site also provides access to our schedule, clips and more.

Please note: Streaming radio is a data intensive service. Whilst the BBC does not charge for its mobile content, your operator's charges for using the internet over 3G may apply. Connecting via WiFi is recommended where possible.

International listeners

You can listen to 5 Live online and via the BBC Sounds app if you live outside of the UK. However, some programmes – such as certain sports commentaries - maybe restricted due to rights reasons.

Why does the BBC need to collect my personal data?

When you interact with 5 Live, the personal data the BBC collects includes personal details like your name and where you’re from, but also the views, opinions or personal stories you wish to share with us. You can get in touch with us over the phone or via email or social media.

We will use your personal data to get in touch with you should we need further information about what you’ve sent to us.

If you appear on-air, this may include the programme being available online and/or on demand, and your contribution may be used again in a future broadcast. We may use your on-air appearance for promotional purposes on the BBC’s social media sites.

What personal data will the BBC collect?

Depending on your interaction with the BBC, we may collect and process the following personal data about you:

  • Name
  • Contact details (phone number, email, or social media account name)
  • Location
  • Your views, opinions, and any biographical information you wish to share
  • A broadcast recording of your voice, if you appear on-air

Depending on what you share with the BBC, we may also collect the following special category data about you, such as:

  • Health information
  • Sexual orientation
  • Religious or philosophical beliefs
  • Political opinions
  • Trade union membership

Who is the Data Controller?

The BBC is the “data controller” of your personal data. This means that the BBC decides what your personal data is used for, and the ways in which it is processed. For the avoidance of doubt, your personal data will be collected and processed solely for the purposes set out in this privacy notice. As the data controller, the BBC has the responsibility to comply, and to demonstrate compliance with, data protection law.

Contributions and communications sent to the BBC through other third-party social media services; third-party messaging services such as WhatsApp; or email are also subject to the terms and conditions and privacy policies of the service you choose to use. Lawful basis for processing your personal data

The lawful basis on which the BBC processes your personal data is the performance of its public task. The BBC’s role is to act in the public interest and to serve all audiences with content which informs, educates and entertains. This is in line with its public purpose commitment to, “accurately and authentically represent and portray the lives of the people of the United Kingdom today and raise awareness of the different cultures and alternative viewpoints that make up its society.”

The additional processing condition under which the BBC processes any special category data is substantial public interest (S1 p13 of the DPA 2018) related to ‘Journalism, academia, art and literature’.

We also have a legal obligation to retain personal data for regulatory and compliance purposes.

Sharing your personal data

The BBC works with our approved third-party providers who help us to provide some of our services. These partners only use your personal data on behalf of the BBC and not independently of the BBC.

We may share personal data with a third-party where required or permitted by law.

Retaining your personal data

If you feature in a BBC broadcast, or in associated content, this will be retained and archived in perpetuity.

We will keep your personal data for up to one (1) year for phone calls and emails; six (6) months for WhatsApp messages; ninety (90) days for social media messages and two (2) years for text messages.

Your personal data will be stored in the UK and the European Economic Area (EEA).

You have rights under data protection law:

  • You can request a copy of the personal data the BBC stores about you.
  • You have the right to request that we rectify any inaccurate or incomplete personal data that we hold about you.
  • You have the right to ask for the personal data we collect about you to be deleted, however there are limitations and exceptions to this right which may entitle the BBC to refuse your request.
  • In certain circumstances you have the right to restrict the processing of your personal data, or to object to the processing of your personal data.

Dependent on the nature of your display picture and your privacy settings, it is possible that the BBC will also collect and process sensitive information, also known as special category data that you choose to disclose. This might include for example:

  • Your race or ethnicity
  • Your health information
  • Your religious or philosophical beliefs
  • Your sexual orientation
  • Political opinion

Setting your WhatsApp display picture settings to private

Please note if you allow everyone to see your display picture in your WhatsApp account, the BBC may see this information too. You are encouraged to change your privacy settings to ‘contacts only’ to minimise the personal information you share through WhatsApp with us.

Who is the Data Controller?

The BBC is an independent data controller of any personal information provided to us by you that is stored on BBC devices and systems.

WhatsApp is an independent “data controller” of any data that you send via the app. Please be aware that you are also subject to WhatsApp’s Privacy Policy and Terms of Service. WhatsApp may share your data within the Meta Companies.

Each controller decides to the extend it is processing your personal information what it is used for, and the ways in which it is processed. For the avoidance of doubt, your personal information will be collected and processed by the BBC solely for the purposes set out in this privacy notice. Each controller has a responsibility to comply, and to demonstrate compliance with data protection law.

We rely on consent to use the personal data about you. This is because you have actively decided to opt-in to our WhatsApp Channels broadcast. . In circumstances where the BBC is processing special category data based on your display picture settings, the processing condition is explicit consent Should you wish to stop receiving these broadcasts you can withdraw your consent at any time by removing yourself from the channel.

The BBC will not share your personal data with any third parties without your permission.

The BBC will process your personal data for the period during which it is necessary to fulfil the purposes set out in this privacy notice.

Text vote terms + conditions

5 Live Text Vote

From time to time 5 Live will ask you to give your opinions on various topics by way of a text vote. To take part you should listen carefully to the announcements given out on air.

Opening and closing times along with how to cast your vote and when the result will be announced will be made clear on air.

Please be aware that each vote may only be open for a short period of time and that votes cast outside the announced times will not be counted but will still be charged. Please listen carefully to announcements, instructions and opening and closing times given out on-air.

Terms & Conditions

1. Listeners can take part in the vote by sending a text message to 85058, following the instructions given out on air. Texts will be charged at your standard message rate. Please ask the bill-payer’s permission before voting.

2. Only one vote per listener will be permitted – one vote per mobile phone number. Any further votes will not count but you will still be charged. Listeners cannot vote by any other method.

3. The vote opening and closing times will be announced on air. Any votes registered outside the announced voting times will not count but you will still be charged. The result will be announced on 5 Live.

4. This is not a competition and there will be no prize for participation in the vote.

5. The BBC reserves the right to disqualify entries or suspend voting if it has reasonable grounds to suspect that fraudulent voting has occurred or if it considers there has been any attempt to rig the voting. The BBC has the right to substitute an alternative selection method at its absolute discretion.

6. If, for any reason, there is a technical problem with the voting, the vote may be suspended or a contingency plan may be actioned.

7. The BBC reserves the right to change, cancel or suspend this vote at any time.

8. The BBC, its sub-contractors, subsidiaries and/or agencies cannot accept any responsibility whatsoever for any technical failure or malfunction or any other problem with any telephone network or line, system, server, provider or otherwise which may result in any vote being lost or not properly registered or recorded.

9. Please note that any BBC staff members or their close relatives, or anyone who is directly connected in any way with the production is not eligible to vote.
