CISA No FEAR Act Reporting

Fostering belonging, diversity, inclusion, and equality is one of the core principles of the Cybersecurity and Infrastructure Security Agency (CISA). The Office of Equity, Diversity, Inclusion and Accessibility (OEDIA) directs and integrates the application of the Civil Rights Act of 1964 and other antidiscrimination federal laws that prohibit discrimination against employees and applicants the basis of race, color, religion, sex (including pregnancy, transgender status, and sexual orientation), national origin, age (40 or older), disability or genetic information. 

OEDIA leads through policy formulation, implementation, and strategic management of the civil rights, language access, reasonable accommodation, accessibility, affirmative employment, diversity and inclusion programs for CISA. OEDIA also reviews and investigates equal employment opportunity (EEO) complaints and enforces corrective actions where necessary. OEDIA Mission is to cultivate a culture of inclusion where diverse talent is leveraged to advance cybersecurity and infrastructure security for the nation. 

5 CFR 724.202 requires federal agencies to publish this notification in the Federal Register. This Federal Register publication specifically provides notice to the general public that individuals seeking to pursue an Equal Employment Opportunity (EEO) complaint must contact a Department of Homeland Security EEO counselor within 45 calendar days of the alleged discriminatory action, or, in the case of a personnel action, within 45 calendar days of the effective date of the action.

Notice of Rights & Protection

Section 202(a) of the Notification and Federal Employee Antidiscrimination and Retaliation (No FEAR) Act, Pub. L. 107-74, Title I, General Provisions, Section 101(1), requires each federal agency to provide written notification of the rights and protections available to federal employees, former federal employees, and applicants for federal employment under federal antidiscrimination and whistleblower laws listed in the No FEAR Act. In support of this requirement, Secretary Napolitano issued a memo to all Department employees reiterating the Department’s commitment to the No FEAR Act of 2002. In addition, the Secretary issued a new anti-discrimination policy statement. CISA fully supports and follows the DHS No Fear Act Policy

Notice of Violations

The Elijah E. Cummings Federal Employee Antidiscrimination Act of 2020 amended the No FEAR Act and requires Federal agencies to post findings of discrimination (including retaliation) from any final action of the Department of Homeland Security (DHS), the Equal Employment Opportunity Commission (EEOC), or a court of jurisdiction, once all appeals are exhausted. Agencies must publish such notices for one year. Findings of discrimination, if any, are listed below:

No FEAR Act Report

Pursuant to Title III of the No FEAR Act and 29 CFR § 1614, federal agencies are required to post quarterly on their public Web sites certain summary statistical data relating to equal employment opportunity complaints filed against the respective agencies. In compliance with this provision of the No FEAR Act, the Department of Homeland Security (DHS) and its agencies post the respective statistical data for equal employment opportunity complaints on their public Web sites. Prior FY22 3rd Quarter, DHS Headquarters EEO Office fully serviced CISA employees. A link to statistical data for complaints that originated at CISA is posted below. This data is updated on a quarterly basis.
